Pennsylvan' , entered into a contract with Zimmer Grove Homes, Inc., of Dauphin County, Pennsylvania, to
provide ma erials and perform labor necessary for completion of a '\esidential dwelling situate upon lot of
ground loca ed: CO" ffl--t'r? fZI)'l ....,.....,.
Lot 64, Me hanicsburg, PA 17050, City, CUMBERLAND County, PENNSYLVANIA, as more particularly
set forth in xhibit "A" attached hereto.
NOW, THE EFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor
or material an, nor any other person furnishing labor or materials to the said contractor under this contract
shall file a Ii n for work done or materials furnished to the said building or any part thereof.
This stipulat on is made and intended to be filed with the County Prothonotary within ten (I) days after date, in
accordance ith the requirements of the Act of Assembly of Pennsylvania, in such case provided.
The General Contractor hereby agrees to waive any defects in the filing and indexing of this Lien Waiver in the
Office of th Prothonotary where it is to be filed pursuant to Section 1402 of the Mechanics Lien Law of 1963
and agrees t at it will not contest the validity of this Lien Waiver based upon any such defects and hereby
agrees to th' waiver of defects on behalf of any of the Subcontractors, materialmen or suppliers that may
provide any abor or materials under the General Contractors Agreement with the owner and who, but for the
same. waive, would be entitled to assert Mechanics Liens against the owners property under the Mechanics
Lien Lawof 963.
The General Contractor also hereby agrees to provide actual Notice of the Lien Waiver to all subcontractors,
materialmen and suppliers prior to providing any labor or material by them to the project and will further
provided for a written acknowledgment by each of these persons of the Lien Waiver prior to providing any
labor or mate ials to the project.

ALL that certain piece, parcel or lot of land, together with improvements, situated
in H pden Township, Cumberland County, Pennsylvania, and bounded and described as
follow :
BEGINNING at a point on the Eastern right-of-way line ofJennifer Circle (50.00
feet wi e), said point being located at the Southwestern comer of Lot No. 65; then along the
Southe boundary line of Lot No. 65 North 75 degrees 40 minutes 13 seconds East, for a
distanc of 117.33 feet, to a point in line of other lands now or fonnerly of The McNaughton

and n bered as Lot No. 64 on the Final Subdivision Plan for Good Hope Farms South - Phases
X and , which is recorded in Cumberland County in Plan Book 89, Page 90.
BEIN APART of the same premises which Thomas W. Gaughen, d/b/a! TWG Real Estate
Manag ment Services, conveyed to The McNaughton Company, a Pennsylvania Corporation, by
deed d ted October 5, 1994 and recorded in Cumberland County in Record Book 112, Page
1058.
ER AND SUBJECT TO:
(a) Any and all easements, licenses, leases, exceptions, reservations,
covenants, agreements, conveyances and restrictions which affect
the premises and are visible by inspection of the premises.
(b) Any and all easements, licenses, leases, exceptions, reservations,
covenants, agreements, conveyances and restrictions contained in
any and all prior documents, agreements, instruments, deeds,
grants and conveyances affecting the premises.
(c) The Declaration of Covenants and Restrictions, recorded in
Cumberland County in Miscellaneous Book 711, Page 1307
as may be applicable to the above described property.
OGETHER with all and singular the Streets, Alleys, Passages, Ways, Waters,
Waterc urses, Rights, Liberties, Privileges, Hereditaments and Appurtenances whatsoever
