HomeMy WebLinkAbout02-1769 THX$~REE~EHTmade the by and between STIPULATION AGAINST LIENS Owner, whereby the former undertook and agreed to erect and construct NOW T~REFORE, THIS AGReemENT WITNESSETH= That the said Contractort for and in consideration of the sum of ($1.00) Dollar to in handpaid by owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all par~ies acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintainedby them or any of them against the said building~ and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of ~hem under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. HRUSKA ALL that certain tract of land situate in Monroe Township, Cumberland County, Pennsylvania. and more particularly identified as follows: BEGINNING at a point along the southern right of way line of Lisburn Road SR 2004 (50 feet right of way) on the dividing line of Lot No. 5 and Lot No. 6 of the aforementioned Plan; thence along said Lisbum Road North 72 degrees 58 minutes 28 seconds West a distance of 200.00 feet to a point at the dividing line between Lot No. 6 and Lot C of said Plan; thence along said dividing line North 17 degrees 01 minutes 32 seconds East a distance of 406.76 feet to a point; thence South 48 degrees 12 minutes 49 seconds East a distance of 77.07 feet to a point; thence North 71 degrees 49 minutes 51 seconds East a distance of284.18 feet to a point; thence South 18 degrees 10 minutes 09 seconds East a distance of 102.15 feet to a point on the dividing line of Lot No. 5 and Lot No. 6 of said Plan; thence along said dividing line South 71 degrees 33 minutes 05 seconds West a distance of 197.81 feet to a point on the dividing line of Lot No. 5 and Lot No. 6 of said Plan; thence along said dividing line South 17 degrees 01 minutes 32 seconds West a distance of 340.00 feet to a point on the southern fight of way line of Lisburn Road, the point and place of BEGINNING. LOT NO. 6 on the Final Subdivision Plan for LISBURN MEADOWS ESTATES - SOUTH. recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania. in Plan Book 75, Page 128 et. seq., the metes and bounds description for which lot is attached hereto as Exhibit "A", incorporated herein by reference and made a part hereof. UNDER AND SUBJECT, NEVERTHELESS, to the conditions, restrictions and easements as noted on the hereinabove mentioned Final Subdivision Plan; AND SUBJECT, FURTHER to the Declaration of Protective Covenants. Conditions, Restrictions and Reservations for Lisbum Meadows Estates - South dated October 28, 1997, and recorded in the Office of the Recorder of Deeds. aforesaid, in Misc. Book 561, Page 585, including but not limited to: All drainage easements and detention basins applicable to the herein described lot and detailed on said Final Subdivision Plan.
