Benning, beneficiary, of 844 Mountain Top Road, _ Collegeville, Pennsylvania 19426, does hereby acknowledge ~~ receipt from Hershey Trust Company, Executor, under1;;he Last Will and Testament of the above named decedent; of t~ ; following: U) Two Hundred Ninety-Eight Thousand Five Hundred Forty-Three and 53/100 ($298,543.53) Dollars In full satisfaction of my share of residuary of the Estate of Yvonne E. Reimer. Under the Last Will and Testament of my late mother, Yvonne E. Reimer, dated October 16, 2002, in accordance with ITEM THREE, gifts to beneficiaries under thirty (30) years of age are to be held in trust by the Hershey Trust Company of Hershey, Pennsylvania, which was appointed Trustee by ITEM FIVE. I have requested that Hershey Trust Company, Executor, release my share of the Estate of Yvonne E. Reimer to me directly and not in trust under ITEM THREE (b). I understand that in accordance with ITEM THREE (d) of the Last Will and Testament of my late mother, Yvonne E. Reimer, if my share of my mother's Estate were held in trust and I died before reaching thirty years of age, then the undistributed principal and income of my trust would have been distributed to my issue, then living at the date of my death, and if none, to my sister or her issue, per stirpes. I understand that by taking my share of the Estate of Yvonne E. Reimer directly and not in trust I am k!J .' forfeiting my rights and my issue's rights under ITEM THREE (d). I understand that upon the death of my sister distribution of her assets will be in accordance with her Last Will and Testament, or if none, then in accordance with the Intestacy laws of the State in which she resides. I agree to indemnify and save harmless the said Executor on behalf of myself, my issue, and my sister's issue for any amounts I, my issue, or my sister's issue may have been entitled to under ITEM THREE (d). IN CONSIDERATION of said full payment and to the extent thereof, the undersigned does hereby release, remise, quit claim and forever discharge the said Executor of and from all actions, suits, payments, accounts, reckonings, claims and demands whatsoever for or by reason thereof, or any other account, matter, cause or thing whatsoever relating to the Estate of the said decedent. AND the undersigned does hereby agree to indemnify and save harmless the said Executor, to the extent of the full distribution received, against any and all losses, damages, costs, verdicts, judgments, awards, expenses and tax liability which said Executor may suffer, incur, be put to, payor layout by reason of having made full distribution to the undersigned and agrees to refund said distribution to the Executor upon receipt of such a request from the Executor. AND the undersigned does hereby release all real estate of the decedent and of the said Executor from all liens, claims, actions, suits, payments, accounts, reckonings and demands whatsoever for or by reason thereof, or of any other account, matter, cost, thing or whatsoever. It is the intention of the undersigned to be legally bound by this instrument.
