Whereas, the Owner is about to execute contemporaneously herewith, a contract, with said
contractor, a corporation organized and existing under the laws of the State of Pennsylvania, for
the General Construction work located within the lot of land situate in Middlesex Township,
Cumberland County, Commonwealth of Pennsylvania. Being Lot No. 117 on Phase IV of the
Meadows Residual of Phase 3-A recorded in Cumberland County Plan Book 65, Page 31. Being
the same premises which Charles J. Taylor, TRUSTEE under Declaration of Trust dated October
24, 1979 and Taylor Enterprises, Inc., a Pennsylvania Corporation, Record Owners, and Fred A.
Tiday and Darlene Tiday, his wife, Equitable Owners, by deed dated December 10, 1998 and
recorded December 16, 1998 in the recorder of Deeds Office in and for Cumberland County,
Pennsylvania, in Deed Book 191, page 50, granted and conveyed unto Alfred R. Leal and Judith
A. Jozefiak, husband and wife. Said property is also known and addressed as 143 Fieldstone
Drive, Carlisle, Pennsylvania, 17013.
Now, Therefore, on June "1>>' ,2006, at the time of and immediately before the execution
of the principal contract, and before any authority has been given by the said owner to the said
contractor to commence work on the said project, or purchase materials for the same in
consideration of the making of the said contract with the said contractor and the further
consideration of One Dollar paid to the said contractor by the said owner, it is agreed that no
mechanic's claims or other liens shall be filed against the building and/or ground appurtenant
thereto by the contractor, or any sub-contractor, nor by any of the material men or workmen or
any other person for any labor, or materials purchased, or extra labor or materials purchased or
furnished in connection with the construction of the said project or any part thereof, the right to
file such liens being expressly waived and relinquished herewith,
