WILLIAMS; MAJOR GARRETT; } LIEUTENANT KELLY; } LIEUTENANT MEINTEL, IN THEIR } OFFICIAL AND PRIVATE CAPACITY,) Defendants COMPLAINT CIVIL ACTION -AT LAW JURY TRIAL DEMANDED DOCKET NO. -38 7 q 1 Plaintiff invokes this court's original jurisdiction to hear this matter sounding in tort violation of state and federal constitutional law and rights. 2. Plaintiff is a state prisoner presently confined, unlawfully so, at SCI-Camp Hill, 2500 Lisburn Rd, Camp Hill, PA 17001. 3. Defendants are state prison employees of the Pennsylvania Department of Corrections, and can be found at 2520 Lisburn Rd, Camp Hill, PA 17001. Some defendant's names are unknown, at this time. 4. On or about March 1, 2004 defendant Beard and his agents, consisting of, but not limited to, defendant Blandford, made a decision pursuant to defendant Beard's Policy 6.5.1. to transfer and to continue plaintiff to the Restricted Housing Unit, labeled the `SMU,' without providing plaintiff due process of law, required by codified law 37 Pa. Code 9§ 3-11. 5. Plaintiff was not provided the opportunity to confront the decision makers, to rebut the decision to transfer and confine him to the SMU, before he was so transferred, and confined to atypical and significant hardship. 6. Defendant's Beard and his agents, consisting of, but not limited to, Unit Manager Blandford further intent was to circumvent plaintiffs civil suit against them filed at Bronson v. Horn. No. 01-0026 (M.D. Pa), in federal court. 7. On July 1, 2004 defendants Marsh. Kelly, and Patton did render a decision that plaintiff be confined to the Restricted Housing Unit labeled the `SMU' because plaintiff was considered a safety and security threat to "any DOC facility." 8. No such reason as used by defendants for confining plaintiff to the SMU existed under Policy DC-ADM 802, governing administrative custody confinement. 9. Defendants were limited to mandatory reasons that were clearly defined, for confining prisoners to administrative custody segregated confinement, and had no discretion not to provide plaintiff with due process of law, as required by codified law 37 Pa. Code 93.11. 2 10. Plaintiff was never provided with a notice of confinement or hearing before commitment to the SMU, to contest the commitment. 11. In purporting to apply the relevant standards, for confinement to the Restricted Housing Unit, labeled the SMU, defendants did deny plaintiff written notice of the charges against him, an opportunity to present witnesses and documentary evidence in his favor, an opportunity to confront and cross-examine adverse witnesses, representation, and a written decision stating the reasons for confinement to the SMU. He was thus deprived of due process of law. 12. On October 1, 2004 defendant Kelchner condoned the July 1, 2004 decision of defendants Marsh, Kelly and Patton to confine plaintiff to the SMU, for non-disciplinary purposes. 13. All of plaintiff's subsequent review hearings conducted by defendants Marsh, Kelchner. Patton, Klaus Hoffinan. Cole Brannigan Sunday Rosenhgrar. Williams Kelly Garrett. Homer, and Meintal ;were meaningless, as a matter of law. 14. At plaintiffs 30 day review hearings, defendant failed to present any independent evidence justifying their arbitrary decisions not to release plaintiff from the SMU. 15. The reasons that were employed were vague, bald, and pure conclusions. Plaintiff was not provided with the who, what, where and when facts to allow him the opportunity to rebut the retention decision of the defendants. 16. Defendants further failed to identify any criteria for plaintiff to meet in order for him to be released from the SMU. 3 17. All written review reports, from plaintiff's review hearings, contained wrote recitations and bald conclusions. These static recitations are used on all SMU prisoners review reports, thus failing to provide individualized consideration and assessment of plaintiffs 18. There were no emergency circumstances present at any time precluding the application of due process to plaintiffs confinement to segregated confinement in the SMU. 19. Defendants ignored the proscription and 37 Pa. Code §93.11(b), prohibiting unitive elements in plaintiff's non-punitive condition of confinement, and placed plaintiff in disciplinary conditions of confinement for no legitimate penological reason. 20. As a result of defendants acts and actions plaintiff was made to suffer atypical and significant hardship in relationship to the normal routine prison life in Pennsylvania Prisons. 21. Plaintiff exhausted his prison administrative remedies to no avail. 22. Defendants acts and actions violated and deprived plaintiff of his rights under codified law 37 Pa. Code §93.11, to due process of law. 23. Defendants acts and actions violated and deprived plaintiff of his rights under Pennsylvania's state constitution; and amendments one (1") and fourteenth (14") to the United States Constitution. 24. Plaintiff seeks a declaratory judgment under the Declaratory Judgment Act, that defendants' policy, practice, and procedures are unlawful. 25. Plaintiff seeks a preliminary and permanent injunction requiring defendants to release plaintiff from segregated confinement, whereever his segregated confinement is located, back to his Level 3 Housing status in general population. 4 26. Plaintiff seeks compensatory damages of $250,000 dollars, and punitive damages in the amount of $250,000 dollars, against each and every defendant. 27. Plaintiff invokes this court's original jurisdiction to hear this matter sound- ing in constitutional torts violating plaintiff's rights under the Pennsylvania and United States Constitutions. 2. Plaintiff, a state prisoner, is presently housed at SCI-Mahanoy, 301 Morea Rd. Frackville, Pa. 17932 3. Defendants Office of Chief Counsel, and Laura J. Neal, are located at 55 Utley Dr. Camp Hill, Pa. 17011. 4. Defendants Beard and Watson, can be found at 2520 Lisburn Rd. Camp Hill, Pa. 17001. 5. Defendants Gimble, Taggart, Palakovich, and Kelchner can be found at 2500 Lisburn Rd. Camp Hill, Pa. 17001. CLAIM -A 6. On or about Aug. 16, 2007, and Dec. 7, 2007, unbeknowing to plaintiff, defendant Gimble, Neal, and office of Chief Counsel entered into a conspiracy to obstruct and bender plaintiff's access to the courts. 7. Office of chief counsel directed defendant Gimble to accept and refuse to reject plaintiff's incoming check for $501.034 8. Defendants Gimble, Neal, and Office of Chief Counsel knew they had no Power of Attorney Form on file signed by plaintiff authorizing them to accept said check under DOC Policy 11.5.5.a.(2). 9. Defendants knew plaintiff would use said funds to pay court filing fees for civil complaints to be filed against them and DOC employees and officials. 10. On Nov. 14, 2007, plaintiff filed a grievance #207732 challenging the arbitrary seizure of the check, and seeking its release and forwarding to his designated agent, which grievance was white washed and denied all the way to final review level. 11. Plaintiff was made to suffer great anxiety and stress. 12. On Dec. 7, 18, 2007, Jan. 8, 22, and Feb. 11, 2008, defendant Taggart, Kelchner, and Beard, respectively, joined in the conspiracy when they. condoned the acts and actions of Gimble, Neal, and Office of chief counsel. 13. *office of chief counsel acted outside the scope of its authority when it dictated the internal operations of SCI-Camp Hill. 14. As a result of defendants' acts, actions, and reckless disregard of plaintiff's rights, his rights under under state law, and under amendments 1, and 14 to the U.S. Constitution were violated. 15. Plaintiff seeks a declaratory judgment declaring defendants' acts, actions, practices, and policies unlawful. 16. Plaintiff seeks a preliminary and permanent injunction which requires defendants to release said check and forward.it to plaintiff's designated agent. 17. Plaintiff seeks compensatory, punitive, and delay damages against each and every defendant. 18. Plaintiff seeks the. award of expenses, costs, attorney fees, and any other relief the court deems proper and just. 19. Defendant Beard, via his Policy DC-ADM 801, processed 100 Misconduct Reports., which Hearing on same, were defective, in that, defendant and his agents Hearing Examiners used a constitutionally deficient standard of proof of "some evidence., when he knew that state codified Law 37 Pa. Code. §93.10 mandated that a preponderance of --evi ance -criteria--be utiliz-ed. Plairi?tiff received no due process at these Hearings. 20. Subsequently, after plaintiff's contesting of said "some evidence" Policy, defendant on March 30, 2004, changed his disciplinary policy to require the Hearing Examiners to abide by codified Law 37 Pa. Code §93.10. 21. Subsequent to said policy change, defendant continued to allow said Hearing Examiners use of said deficient standard, under the disquise of the phrase of "a. preponderance of evidence is present," when there is really only "some evidence," which does not satisfy the finding of guilt. 8 22. Defendant's agents further fail to note on the rational guilt sheet, ? the cold bare unsworn Report is found to be more creditable, and outweigh, plaintiff's sworn testimony and evidence to the contrary. 23. As a result.of defendant's policies and practices, which are ongoing, plaintiff was made to suffer atypital and significant hardship: when he was arbitrarily confined to the Restricted Rousing Unit, in disciplinary custody for three thousand, six hundred, and sisty five days. 24. As a result of defendant's acts, actions, polices, and practices, plaintiff was deprived of his rights under the 8th and 14th amendments to the U.S. Constitution. 25. Defendant acted with reckless disregard of plaintiff's constitutional rights. 26. Plaintiff seeks a declaratory judgment under state and federal law declaring defendant's acts, actions, practices, and policies unlawful. 27. Plaintiff seeks a preliminary and Ypermanent injunctions requiring defendant to expunge from his and the DOC records, all of plaintiff's 100 Misconduct Reports. 28. Plaintiff seeks the award of compensatory and punitive damages against defendant and his agents. 29. Defendant Beard, via his agents and Policy DC-ADM 802, violated plaintiff's due process tights and liberty interest found under 37 Pa. Code §93.11(b), to remain out of administrative custody (AC) for punitive punishment,' or in administrative custody (AC), under non-punitive conditions of confinement. 31. On Numerous occasions, and ongoing for years at a time, defendant approved plaintiff's confinement to AC segregated confinement in retaliation for the plaintiff's filing of civil actions against him and his employees. 32. Defendant's policy in essence placed plaintiff in disciplinary custody (DC) conditions of confinement (without the .rgquired..di.sciplinary ;due process), but placed a AC label on plaintiff's cell door. 33. Defendant intentionally ignored codified. Law 37 Pa. Code ?93.11(b)'s proscription prohibiting punitive element in plaintif's non-punitive confinement. 34. As result of defendant's arbitrary policy and practice, plaintiff has been deprived of, but not limited to, contact visits, full commissary, normal telephone calls, personal property, employment, group religious services, full law library access, daily showers, access to exercise equipment, unlimited reading material, daily cleaning supplies,"vocational and leasure activities, and medical treatment. 35. Defendant acted with reckless disregard to plaintiff's legal rights, and subjected plaintiff to atypical and significant hardship in relationship to the normal living lifestyle of the general population prison life in Pennsylvania, for no legitimate penological purpose, ongoing for 15 years. 36. Defendant subject plaintiff to physical, and mental torture, of excessive deprivations, causing stress and anxiety. 37.
