STIPULATION AGAINST LIENS
THIS AGREEMENT, made the ~ro'r day of June, 2006, by and between
S&A CUSTOM BUILT HOMES, INC.
hereinafter referred to as Contractor,
AND
JAMES FAILOR, SR. and SHANNON L. FAILOR,
68 N, Middleton Rd., Carlisle, P A 17013
hereinafter referred to as Owner,
Whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot
of ground situate in North Middleton Township, Cumberland County, Pennsylvania, being known as Lot
No.2 on a Sketch Plan prepared by C. W. Junkins Associates, and more particularly set forth in Deed Book
267, Page 1925.
Being further identified as Tax Parcel No. 29-14-0877-021
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above-described, and the said Contractor, for themselves, their subcontractors and others
under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien,
shall be an independent covenant.

ALL THAT CERTAIN tract of land situate In North Middleton Township, Cumberland County, Pennsylvania,
bounded and described according to a Sketch Plan prepared by C. W. Junkins Associates, Inc., dated
January 1, 2004, and set forth as follows:
BEGINNING at a steel pin set at the northwestern corner of Lot No.1 as shown on the hereinabove
mentioned Plan; thence along land now or formerly of John W. & Susan C. Grenoble, North 30 degrees
59 minutes 02 seconds West 137.25 feet to a steel pin set; thence alon9 Lots Nos. 3 and 4 as shown on
the hereinabove mentioned Plan, North 64 degrees 04 minutes 25 seconds East 471.66 feet to a steel pin
set; thence along land now or formerly of Nelson L. Minich, South 50 degrees 49 minutes 03 sl!COnds
East 115.31 feet to a steel pin set; thence along lands now or formerly of Sylvester M. & Doris M. Wilson,
South 69 degrees 00 minutes 00 seconds West 324.49 feet to a steel pin found; thence along same,
South 25 degrees 55 minutes 35 seconds East 59.98 feet to a steel pin set; thence along said Lot No.1,
South 64 degrees 04 minutes 25 seoonds West 184.81 feet to a point, the Place of BEGINNING.
BEING Lot No.2 on the hereinabove mentioned Plan and containing 1.214 acres.
