WHEREAS, SAY, Ltd., of 4444 Carlisle Pike, Camp Hill, Pennsylvania 17011, is about to enter
into a contract with R. S. Mowery & Sons, Inc., of 1000 Bent Creek Boulevard, Mechanicsburg,
Pennsylvania, for the construction of a new BMW Dealership, new Mercedes Dealership, and new
Body Shop to be located on Lots 2 through 11 of the Woods Drive Industrial Park, Silver Spring
Township, Cumberland County, Pennsylvania (as noted on the Subdivision Plan prepared by R. J.
Fisher & Associates, dated 5/15/03, revised 4/19/03, recorded in Deed Book Volume 264, Page
951).
NOW. July 5, 2006, ilt the time of and immediately before the execution of the principal
contract, and before any authority bas been given by the said SA V, L TO., to the said R. S. Mowery
& Sons, Inc., to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with R. S. Mowery & Sons, Inc., and the further
consideration of One Dollarto R. S. Mowery & Sons, Inc., paid by SAY, LTD., it is agreed that no
lien shall be filed against the building or property by the contractor, nor any subcontractor, nor by
any of the material men or workmen nor any other person for any labor, or materials purchased, or
extra labor or materials purchased for the completion of said building, the right to file such liens
being expressly waived.
