COMPLAINT
Comes now the Plaintiff, Andrew H. Cline, and demands judgment again4 the
Defendant, Deborah Paproky, upon the following claim:
1. Plaintiff is an adult individual residing at 1706 Kathryn Street, New
Cumberland, Cumberland County, Pennsylvania.
2. Defendant is an adult individual residing at 12 Grinnel Drive, Camp Hill,
Pennsylvania, Cumberland County, Pennsylvania.
3. Plaintiff is the owner of a 1999 328i BWM automobile, Pennsylvania
registration number GBY9327.
4. On April 6, 2006, at approximately 3:00 p.m., Plaintiff's daughte Haley
Cline was operating the automobile, driving east on Carlisle Road in Lower Allen
Township, Cumberland County, Pennsylvania.
5. As Haley Cline entered the interesection of West Shore Dirve and arlislf
Road, Defendant entered the intersection from West Shore Drive and struck Plaintiff's
automobile.
6. The intersection of West Shore Dirve and Carlisle Road is
stop sign facing West Shore Drive.
3. The rules of the road require that, to proceed from a stop sign into
intersection, a driver must have a clear view of approaching traffic and must
right of way to any vehicle in the intersection or approaching so closely as to
hazard, entering the intersection only when it is safe to do so. 75 Pa. C.S. 3323(b
4. Defendant failed to observe these rules of the road, unlawfully
intersection, and struck and damaged Plaintiffs automobile.
5. As a result of Defendant's negligence, Plaintiff has suffered and
suffer: general damages in the form of the loss of use of his car, the loss of
and/or income, inconvenience, and disruption of his life; and special special dai
the form of the cost of repair of his vehicle, $1612.81, the cost of a comparable
replacement vehicle while his is being repaired, $300.00, and any other out-of-]
expenses attributable to Defendant's negligence.
WHEREFORE, Plaintiff demands judgment against in his favor
against Defendant in the amount of his general and special damages plus interest
costs, which amount does not exced $35,000.00.
