TRI-BORO CONSTRUCTION SUPPLIES Defendant CLERK'S TAXATION OF COSTS December 28, 2004 Pending for taxation is the defendant's bill of costs in the amount of$2,031.98 for deposition expenses, witness fees and photocopying charges. The plaintiff claims in timely filed objections that he should be excused from paying any taxable costs because he lacks the financial resources to do so, and that certain items listed on the bill of costs are not taxable in any event because they wen:; .not pertinent to the court's swnmary judgment decision. For the following reasons, costs will be taxed in favor of the defendant and against the plaintiff in the amount of$I,806.98. Ability to pay is an equitable factor that may pennit reducing or denying a valid claim for costs if the losing party produces evidence and the court articulates reasons for departing from the presumption that costs will be awarded in full measure to the prevailing party. In re Paoli Railroad Yard PCB Litil!lltiolJ, 221 FJd 449,468 (3d Cir. 2000). Here, the evidence of indigence consists solely of the plaintiff's assertion that he lacks the ability to pay taxable costs. The plaintiff has failed to tender the evidence of indigence required for a fmili waiver. Furthermore, even if his lack of ability to pay were presumed (a conclusion not readily drawn from the . A " existing record) other equitable considerations such as apparent lack of bad faith and absence ofWlfair litigation tactics on the defendant's part suggest that taxable costs should be awarded here. Therefore, the plaintiffs request for a waiver from paying taxable costs due to indigence is denied. The burden is on the party opposing a verified bill of costs to establish that a claim is "incorrectly stated, unnecessary or unreasonable." LR 54.4(10). In all cases, however, it is the prevailing party's duty to establish that the costs claimed are authorized by statute. Green ConstIUction Co. v. Kansas Power & Li~ht Co., 153 F.R.D. 670, 675 (D.Kan. 1994). The reporters fees, wi1ness fees, and copying charges for swnrnary judgment exhibits fall within the narrow class of litigation expenses that may be reimbursed Wlder 28 U.s.c. S 1920. Such costs are taxable whether or not they are admitted into evidence or incurred solely for the pwpose of conducting discovery. ~ LR 54.4(3). However, the copying charges claimed for items provided to the plaintiff in the course of discovery ($225.00) are not taxable. ~ Sphere Drake Insurance PLC v. ~,66 F.Supp.2d 1088, 1093 (D.Minn. 1999) (papers in party's possession produced during discovery are not "obtained for use in the case" within the meaning of S 1920). THEREFORE, IT IS ORDERED THAT costs are taxed against the plaintiff and in favor of the defendant in the amoWlt of $1 ,806.98.
