Schiffman, Esquire, and the law fin. of Serratelli, Schiffman, Brown & Calhoon, PC, and in support of this Complaint, avers thc following: 1. Plaintiff is COMMERCE BANK/HARRISBURG, N.A., a corporation organized and doing business under the National Banking Act, with offices located at 100 Senate Avenue, Camp Hill, Cumberland County, Pennsylvania, 17011. 2. Defendant is WILLIAM A. HOOVER, an adult individual with a current mailing address of 57 Westwood Court, Enola, Cumberland County, Pennsylvania, 17025. 3. The Defendant is the owner of a certain property known as 52 Westwood Court, Enola, Cumberland County, Pennsylvania, 17025. 4. The Defendant is obligor to the Plaintiff by virtue of a certain promise and agreement made on May 21, 2001. 5. The certain promise and agreement between the Plaintiff and the Defendant was reduced to writing. A hue and correct copy of the writing appears as Exhibit "A" attached hereto. 6. The writing of Exhibit "A" is a Promissory Note, wherein the Defendant promised to pay his debt to the Plaintiffin regular monthly installments with certain interest on the 1st of each month beginning July l, 2001, and continuing until the debt was repaid except that any remaining indebtedness if not paid sooner was due and payable on June l, 2016. 7. The Promissory Note is secured by a Mortgage on the property situate at 57 Westwood Court, Enola, Cumberland County, Pennsylvania, 17025. 8. The Defendant is in default on the said Promissory Note because he has failed to make monthly payments of $558.00. 9. Plaintiff, on October 4, 2001, by certified mail, return receipt requested, gave notice to Defendant of its intention to foreclose the Defendant's Mortgage in the event the note was not brought current thirty (30) days from the mailing date of the notice. The Notice also proved to Defendant Notice of the Homeowners Emergency Mortgage Assistance Act of 1983. A true and correct copy of the form of notices mailed by the Plaintiff are attached hereto as Exhibit "B". 10. The entire principal amount outstanding has been accelerated. The principal amount, accrued interest thereon, escrow, and late charges are now due and payable by the Defendant. The sums due are as follows: Principal Interest through 2/3/02 Late Charges Attorneys' Fees TOTAL $50,300.00 $ 2,745.04 $ 167.40 $ 5.321.24 $58,533.68 WHEREFORE, Plaintiff demands judgment against Defendant for the total sum of $58,533.68, plus costs to be added.
