PETITION FOR ESTABLISHMENT OF NEW VOTING DISTRICT
IN EAST PENNSBORO TOWNSHIP
TO THE HONORABLE, Judges of Said Court:
AND NOW, comes the Petitioners, residents of the Election Precincts of Upper and Enola,
located in East Pennsboro Township, Cumberland County, by and through the undersigned counsel,
COYNE & COYNE, p,c., and hereby petition your Honorable Court for the creation of a new election
district for western portions of the precincts of Upper and Enola pursuant to Sections 502 and 503 of the
Pennsylvania Election Code, 25 P,S, ~~ 2702 and 2703, et seq" and in support thereof state as follows:
I, Petitioners are the Board of Commissioners of East Pennsboro Township (hereinafter
referred to as "The Township") the legal representatives of the citizens of East Pennsboro Township, a
Township of the First Class, Commonwealth of Pennsylvania, with its principal place of business being
located at 98 S, Enola Drive, Pennsylvania 17025 and registered voters residing with the Upper Precinct
and Enola Precinct of the Township,

2, According to the precinct registration summary on the street list as of October 19, 2005,
the Upper Precinct of the Township contained 2,935 registered electors,
3, According to the precinct registration summary on the street list as of October 19,2005,
the Enola Precinct of the Township contained 2,924 registered electors,
4, According to the April I, 2000 U.S, Census, 4,097 people reside in the Upper Precinct of
the Township,
5, According to the April I, 2000 U.S, Census 4,118 people reside in the Enola Precinct of
the Township,
6, Voting for the Upper Precinct is currently held at the Midway Fire Company, 17 East
Manor Avenue, Enola, East Pennsboro Township, Pennsylvania 17025,
7, Voting for the Enola Precinct is currently held at the Citizens Fire Company, 225 North
Enola Drive, Enola, East Pennsboro Township, Pennsylvania 17025,
8, Section 502 of the Pennsylvania Election Code, 25 P,S, ~ 2702, provides, in part, that:
"[T]he court of common pleas of the county in which the same are located, may
form or create new election districts by dividing or redividing any borough,
township, ward or election district into two or more elections districts of
compact and contiguous territory.... Except for good cause shown, election
district so formed shall not contain more than one thousand two hundred (1,200)
registered electors," Id,
9, Section 503 of the Pennsylvania Election Code, 25 P,S, ~ 2703, further provides, in part,
that:
"[U]pon the petition of twenty registered electors of any township, borough,
ward or election district, to the court of the proper county, praying for the
division or redivision of such township, borough, ward or election district .., the
said court shall refer the said petition to the county board of elections, which
shall make a full investigation of the facts, and shall report to the court its
findings and recommendations as to the division ,.. prayed for, If the court
board shall find that a division '" of election districts will promote the
convenience of the electors and the public interests, it shall recommend a proper
'.
division '" which must have clearly visible physical boundaries, and shall
accompany its report with a map and a verbal description of the boundaries, as
well as a certification of the number of electors registered in each of the resulting
election districts for the immediately preceding general or municipal election,"

10. The Petitioners are registered electors in the precincts of Upper and Enola, East
Pennsboro Township, believe it is necessary and appropriate to create a new voting precinct from the
western portion of the precincts of Upper and Enola, East Pennsboro Township, for the following
reasons:
a, The Upper Precinct, with 2,935 registered electors, is double the statutorily
recommended number of 1,200 registered electors for each election precinct;
b, The large number of registered electors who must cast their votes at this precinct creates
undue and extended delays during primary and general elections and discourages prospective electors
from exercising their right to vote, In fact, in the 2005 primary and general elections, numerous voters in
this precinct came to the polling place and left without voting because of the long lines and length of time
to cast their votes, It is also believed is therefore averred, that some voters do not even bother to vote
because of their knowledge of these long lines,
c, The Upper Precinct continues to experience growth in both its housing and population
and it is therefore believed and averred, that the present situation discourages residents from voting, will
only worsen, unless relief is granted and a new voting precinct is created;
d, Adding additional election booths or polling tables at the existing precincts will not
alleviate the long lines or unreasonable waits by voters in the Upper Precinct, since Section 1220 of the
Pennsylvania Election Code, 25 P.S, ~ 3060(a), prohibits more than ten (10) voters at anyone time in the
polling place (the room provided for voting), outside of the enclosed space of any primary or general
election;

e, The county committees of Democrat and Republican Parties are organized by electing
one male and one female committee person at the voting district level. The registered Democrats and
Republicans in the Upper Precinct are under-represented on their respective county committees for
organizational and endorsement purposes;
f. Since each party elects only two county committee members for this voting district the
large population creates an undue burden upon them in communications with the voters of this voting
district.
11. The Petitioners are registered electors in the Enola Precinct, believe it is necessary and
appropriate to create a new voting precinct from the western portion of the precincts of Upper and Enola,
East Pennsboro Township, for the following reasons:
a, The Enola Precinct with 2,924 registered electors has more than double the statutorily
recommended number of 1,200 registered electors for each election precinct;
b, The large number of registered electors who must cast their votes at this precinct creates
undue and extended delays during primary and general elections and discourages prospective electors
from exercising their right to vote, In fact, in the 2005 primary and general elections, numerous voters in

12, The existing geography and demographics of the precincts of Upper and Enola naturally
suggest the aforesaid western portion of the Precincts of Upper and Enola could easily support a separate
election districts, and be referred to as "East Pennsboro Township Enola West Precinct."
13, Petitioners believe and therefore aver, the River of God Church, located at 747
Wertzville Road, Enola, East Pennsboro Township, Pennsylvania 17025, would be suitable as a polling
place to serve the new voter polling place for the "East Pennsboro Township Enola West Precinct," and
the facility is also handicap accessible,
14. The East Pennsboro Township Upper Precinct could continue to be served by the
existing polling place at the said Midway Fire Company, 17 East Manor Avenue, Enola, East Pennsboro
Township, Pennsylvania 17025,
15, The western portions of voting precincts of Upper and Enola, which may constitute a
new voting precinct, is depicted on the East Pennsboro Township map attached hereto as Exhibit "A,"
which illustrates the township and its voting precincts,
16, The East Pennsboro Township Enola Precinct could be renamed the "East Pennsboro
Township Enola East Precinct" and could continue to be served by existing polling place at the said
Citizens Fire Company, 225 North Enola Drive, Enola, East Pennsboro Township, Pennsylvania 17025,
17, Although dividing the Precincts of Upper and Enola and the creation of a new elector
precinct portions, as requested, may result in the precincts of Upper, Enola East and Enola West
exceeding 1,200 registered electors for each district as provided for under the Pennsylvania Election
Code, 25 P,S, ~ 2702, the Petitioners believe and therefore aver, that good cause exists as that term is
used under the said Section 2702 of the Election Code, to exceed this recommendation, Furthermore,
many other voting precincts in Cumberland County, which have voter registration numbers like those
being proposed, presently exceed 1,200 registered electors in their districts and do not experience voter
inconvenience and delay like that presently experienced in the precincts of Upper and Enola of the
Township,
18, Petitioners request that new election district be created in order to accommodate the
convenience of the registered electors and to promote the public interest and participation in elections by
registered electors,
19, Petitions were circulated by electors of the Upper and Enola Precincts for establishmenty
of new voting precincts in the Township, (Attached as Exhibit "B"),
WHEREFORE, the Petitioners, and the Board of Commissioners of East Pennsboro Township
through their undersigned counsel, respectfully pray that this Honorable Court direct the County Board of
Election to investigate fully and promptly the facts as alleged in this Petition and to report to this
Honorable Court its findings and recommendations as to a creation of a new election district known as
"East Pennsboro Township Enola West Precinct" and "East Pennsboro Township Enola East Precinct" in
order to promote and serve the convenience of the registered electors and public interest.

IN EAST PENNSBORO TOWNSHIP,

Whereas, based on numerous complaints, the East Pennsboro Township Board of
Commissioners unanimously recommended on January 3, 2006, that the Cumberland County Board
of Elections create a new voting precinct to reduce the incidence of long waits, overcrowding and
traffic congestion at the Upper and Enola voting precincts in East Pennsboro Township __ but County
action has not yet been taken to implement the township's recommendation; and
Whereas, it is the responsibility of the Cumberland County Board of Elections and the
Cumberland County Court of Common Pleas to establish voting precincts and to assure that they are
convenient to the electors and "promote the public interests," and
Whereas, both the Upper and Enola precincts (with more than 2,900 registered electors each)
have far surpassed the recommended maximum number of registered electors per precinct.
Now, therefore, be it resolved that we the undersigned registered electors of East Pennsboro
Township's Upper and Enola voting districts do hereby join with our township commissioners in
petitioning the Cumberland County Board of Elections and Court of Common Pleas to create a new
voting precinct to serve voters from western portions of the Upper and Enola voting precincts to
reduce overcrowding at the Upper and Enola precincts,

RESOLUTION NO. 2006-16
WHEREAS, the Board of Commissioners of the Township of East Pennsboro,
Cumberland County, Pennsylvania (hereinafter referred to as the "Board"), is the governing body
in the Township of East Pennsboro, situate in Cumberland County, Pennsylvania; and
WHEREAS, the Township presently has six voting districts located within its
geographical boundaries, as reflected in Exhibit "A" attached hereto with registered electors
noted in each voting precinct in each district; and
WHEREAS, the Board has received complaints from registered electors in voting
precincts of Upper and Enola as to delays encountered when voting in the primary and general
elections because of the large numbers of registered electors being served in the said precincts;
and
WHEREAS, Section 503 of the Pennsylvania Election Code, 25 P,S, S 2703, authorizes
the twenty registered electors of an election district to petition the Cumberland County Court of
Pleas ("Court") praying for the formation of a new election district; and
NOW THEREFORE, be it resolved that the Board hereby:
L Accepts the Petitions, containing the signature of II I registered electors, (See
Exhibit "B" attached hereto) that were circulated on May 16, 2006 seeking the
creation of a new voting district by realigning portions of the precincts of Upper
and Enola, and creating a new voter precinct;
2, Requests the Court of Common Pleas of Cumberland County to accept this
Resolution No, 2006-16, dated July 5, 2006 and the attached Petition and refer
the Resolution to the County Board of Electors for the proper consideration; and

3, Authorizes John Pietropaoli, Assistant Township Manager, and Henry F, Coyne,
Esquire, Township Solicitor to take the necessary and appropriate action to

REPORT OF THE
CUMBERLAND COUNTY BOARD OF ELECTIONS
Pursuant to proceedings initiated by the Board of Commissioners of East Pennsboro
Township, the Board of Elections was directed to make a full investigation of the facts presented
in the Petition and to report to the Court its findings and recommendations as to the division,
redivision, alteration, formation or consolidation of the election districts prayed for by
Petitioners.
The Board of Elections has determined, as of October 9, 2006, that the following are the
number of registered voters in each of the current voting districts in East Pennsboro Township:
East Pennsboro Enola 2950
East Pennsboro Lower East 1934
East Pennsboro Lower West 1288
East Pennsboro Summerdale 2394
East Pennsboro Upper 2979
East Pennsboro W Fairview 641
The Board of Elections agrees that the Upper and Enola voting districts in East
Pennsboro Township contain more registered voters than is statutorily recommended. Section
2702 of the Election Code states as follows: "[E]xcept for good cause shown, election districts
so formed shall not contain more than one thousand two hundred (1200) registered electors." 25
P.S. S 2702.
The Board of Elections is aware that some voters in certain of the voting districts in East
Pennsboro Township have experienced long lines and length of time to cast their votes.
The Board of Elections agrees that East Pennsboro Township will continue to experience
growth in both its housing and population.
The Election Code, 25 P.S. SS 2702 & 2703, require that the formation or creation of new
election districts by dividing or redividing any, township and or election districts into two or
more election districts of compact and contiguous territory must promote the convenience of the
electors and the public interests and must have clearly visible physical boundaries conforming
with the census block lines from the most recently completed Federal decennial census.
The Board of Elections has determined that the boundaries of the proposed new voting
precincts set forth in the Petition do not conform to the census block lines from the most recently
completed Federal decennial census.
The Board of Elections is recommending that the proposed new voting districts in East
Pennsboro Township, as set forth in the Petition, be rejected because they do not conform to the
census block lines from the most recently completed Federal decennial census.
The Board of Elections believes that the convenience of the voting public in East
Pennsboro Township will be better served by the reapportionment and creation of four new
additional voting districts with convenient polling places, as well as the retention of portions of
the current districts.
The Board of Elections is recommending that the existing East Pennsboro Township
voting districts be reapportioned and is recommending that four additional districts be created,
thereby constituting 10 voting districts for East Pennsboro Township.
The Board of Elections is recommending the election districts in East Pennsboro
Township be known as follows:

Precinct boundaries follow the centerline of roads and steams, unless when an extension of a line
is used to extend small segments where there is no road.
East Pennsboro 1 - Beginning at the common boundary of East Pennsboro Township, Camp
Hill Borough and Hampden Township; then northerly along the municipal boundary of Hampden
Township to Conodoguinet Creek; then following the loop ofthe Conodoguinet Creek to Center
Street then southerly on Center Street to the Camp Hill municipal boundary; then following the

East Pennsboro Township, Cumberland County Pennsylvania has been presented to the Court of
Common Pleas, Civil Division, Cumberland County, Pennsylvania, by the Township
Commissioners of East Pennsboro Township, Cumberland County Pennsylvania. Notice is
further given that the Board of Elections is recommending that said Petition be rejected and, in
its Report to the Court, is proposing the reapportionment of the current election districts and the
creation of four additional election districts in East Pennsboro Township, Cumberland County

AMENDED REPORT OF THE
CUMBERLAND COUNTY BOARD OF ELECTIONS
Pursuant to proceedings initiated by the Board of Commissioners of East Pennsboro
Township, the Board of Elections was directed to make a full investigation of the facts presented
in the Petition and to report to the Court its findings and recommendations as to the division,
redivision, alteration, formation or consolidation of the election districts prayed for by
Petitioners.
The Board of Elections conducted its investigation of the facts presented in the Petition
and filed its Report with the Court on October 25, 2006.
At the request of the parties, Judge Hess issued an Order continuing the matter generally.
Thereafter, the Bureau of Elections staff and representatives of the Petitioners conferred
and determined to propose further revisions to the boundaries of four voting districts, being
district numbers 2, 5, 6, and 9,
A public meeting was held at the East Pennsboro Community and Municipal Building on
January 30, 2007 with representatives from the Board of Elections, Bureau of Election staff, East
Pennsboro Township Commissioners and residents of East Pennsboro Township for the purpose
of receiving public input on the modified proposal to increase the number of voting precincts
from the current six to ten precincts.
After careful review of the legal requirements involved and discussions with members of
the East Pennsboro Township Board of Commissioners, the Board of Elections now proposes to
amend its Report by revising the boundaries of the four elections districts.

CUMBERLAND COUNTY BOARD OF ELECTIONS
[Explanation of reason for filing Second Amended Report: (1) The Amended Report designated
an incorrect polling place for East Pennsboro 9 as being Citizens Fire Company. The correct
polling place is: Mary C. Schaner Senior Center East Pennsboro Township Community and
Municipal Building. This designation appears on pages 2 and 4. (2) The Amended Report
incorrectly listed the total registered voters for East Pennsboro 5 and 9. East Pennsboro 5 has
1200 registered voters and East Pennsboro 9 has 1486 registered voters. This data appears on
pages 2 and 3.]
Pursuant to proceedings initiated by the Board of Commissioners of East Pennsboro
Township, the Board of Elections was directed to make a full investigation of the facts presented
in the Petition and to report to the Court its findings and recommendations as to the division,
redivision, alteration, formation or consolidation of the election districts prayed for by
Petitioners.
The Board of Elections conducted its investigation of the facts presented in the Petition
and filed its Report with the Court on October 25,2006.
At the request ofthe parties, Judge Hess issued an Order continuing the matter generally.
Thereafter, the Bureau of Elections staff and representatives of the Petitioners conferred
and determined to propose further revisions to the boundaries of four voting districts, being
district numbers 2,5,6, and 9.
A public meeting was held at the East Pennsboro Community and Municipal Building on
January 30,2007 with representatives from the Board of Elections, Bureau of Election staff, East
Pennsboro Township Commissioners and residents of East Pennsboro Township for the purpose
of receiving public input on the modified proposal to increase the number of voting precincts
from the current six to ten precincts.
After careful review of the legal requirements involved and discussions with members of
the East Pennsboro Township Board of Commissioners, the Board of Elections now proposes to
amend its Report by revising the boundaries of the four elections districts.

NOTICE
Notice is hereby given that a Petition praying for the creation of an additional election district in
East Pennsboro Township, Cumberland County Pennsylvania has been presented to the Court of
Common Pleas, Civil Division, Cumberland County, Pennsylvania. Notice is further given that
the Board of Elections is recommending that said Petition be rejected and, in its 2nd Amended
Report to the Court, is proposing the reapportionment of the current election districts and the
creation of four additional election districts in East Pennsboro Township, Cumberland County
Pennsylvania. The districts as recommended by the Board are depicted on the attached map. As
of October 9, 2006, East Pennsboro Enola Lower East precinct had approximately 2950
registered voters, East Pennsboro Lower East had approximately 1934 registered voters, East
Pennsboro Lower West had approximately 1288 registered voters, East Pennsboro Summerdale
had approximately 2394 registered voters, East Pennsboro Upper had approximately 2979
registered voters, East Pennsboro West Fairview had approximately 641 registered voters. The
Court has set Tuesday, the 6th day of March, 2007, at 11 :00 a.m. in courtroom #4 at the
Courthouse, Carlisle Pennsylvania, as the time and place for a hearing on said Petition and the
Board's 2nd Amended Report, at which time objections thereto will be heard and considered.
Any person desiring to object to the division, creation or realignment of voting districts in East
Pennsboro Township, as proposed in the Petition, the 2nd Amended Report, or both, must file his
objections with the Cumberland County Prothonotary prior to the date of the hearing. (Case No.:

ELECTION BOARDS IN EAST PENNSBORO TOWNSHIP
AND NOW, comes the Petitioner, Cumberland County Board of Elections, by and
through its Solicitor, Edward L. Schorpp, Esquire, and hereby recommends electors for
appointments to vacant positions ofthe district election boards in East Pennsboro Township and
avers the following:
1. By Court Order dated March 6, 2007 signed by the Honorable Judge Kevin A.
Hess; In Re: Petition for New Voting District In East Pennsboro Township, Civil No. 06-4085,
the East Pennsboro Township election districts were reapportioned and four additional election
districts were created, thereby constituting 10 election districts in East Pennsboro Township to be
known as: East Pennsboro 1, East Pennsboro 2, East Pennsboro 3, East Pennsboro 4, East
Pennsboro 5, East Pennsboro 6, East Pennsboro 7, East Pennsboro 8, East Pennsboro 9, and East
Pennsboro 10.
2. Said Order further directed the Board of Elections to recommend electors for
appointment to the district election boards to the Court for its consideration in sufficient time for
service during the 2007 Primary Election and thereafter until elected according to law.
