Plaintiff is Harney Hardware, Inc.,
with an office at 9610 Harney Road,
33592.
a Florida Corporation
Thonotosassa, Florida
2. Mason-Norton, Inc., a Defendant, is a Pennsylvania
Corporation with an address at 310 South Tenth Street,
Lemoyne, Cumberland County, Pennsylvania 17043.
3. Defendant purchased builder's supplies from Plaintiff and
charged them to an account with Plaintiff pursuant to the
Application dated November 9, 1998, which is attached hereto,
marked Exhibit A and made part hereof.
4. Defendant's delinquent balance on the account is $ 604 9.99,
pursuant to the invoices, which are attached hereto, marked
Exhibit B and made part hereof.
5. Because of Defendant I s failure to make monthly payments and
in accordance with the Application, a copy which is attached
hereto, marked Exhibit "A" and made part hereof, Defendant
owes an attorney commission of $907.50 for a total of
$6957.49.
6. Defendant has failed and refused to bring this account
current.
7. Defendant is not a member of the Armed Forces of the United
States of America, nor engaged in any way which would bring
her within the Soldiers and Sailors Relief Act of 1940, as
amended.
WHEREFORE, Plaintiff requests entry of judgment against Defendant
in the amount of $6,957.49 together with costs of suit thereon.

purchased certain supplies from the Plaintiff as more particularly set forth in New Matter and
Counterclaim below.

NEW MATTER
8. As part of a larger contract between the Plaintiff and the Defendant, the Defendant
ordered 417 twenty-four inch towel racks for use on a project located in Scotrun, Pennsylvania.
9. As part of the contract between the parties, Plaintiff agreed to provide a six week
delivery window.
10. The Plaintiff breached the contract by failing to deliver the items within six weeks.
11. The owner and contractor found the time frame for the shipment of the towel racks to
be unacceptable, and back charged the Defendant the sum of $4,650.00 on account of late
delivery.
12. The Defendant lost the sum of $4,650.00 on its contract with the contractor, as a
direct result of the Plaintiffs breach of contract as set forth above.
COUNTERCLAIM
13. Paragraphs 8 through 12 are hereby incorporated as if set forth at length.
14. By reason of the Plaintiffs breach of contract, Defendant is entitled to the sum of
$4,650.00 from the Plaintiff.

WHEREFORE, the Defendant demands judgment in favor of the Defendant and against
the Plaintiff in the amount of $4,650.00, plus interest and cost of suit.
