PERSONAL PROPERTY
Each inmate shall be responsible for authorized personal property in his/her possession. The
institution will not be responsible for articles lost or stolen.
When transferred from one facility to another, all property will be properly inventoried and packed by the
inmate in the presence of the officer. Both will sign the inventory sheet.
At the receiving institution, the property will be unpacked and re-inventoried by the inmate in the presence
of an officer. Both will sign the inventory sheet.'
In the case of an unauthorized temporary absence, (ATA), such as going to court, which is expected to last
more than one day, the inmate will be furnished cardboard box(es) in which to pack personal,property.
All persOnal property will be packecl prior to release and placed in an orderly manner in the celll The inmate
will be responsible for packing his/her own items and sealing the boxes with sealing tape~iWhen the boxes
are sealed, he/she should make an appropriate mark of some type, including hiS/her full name and
number, over the tape so that it can be determined whether the boxes have been opened. The Housing
Officer will issue a receipt for the number of boxes only. The inmate shall also sign the receipt. The boxes
will remain at the institution.
NOTE: In those cases where the inmate cannot be physically present during inventory procedures, the
property officer and another employee shall process the property and both shall sign the form. In those
cases where an inmate refuses to sign the appropriate fo~ ms, two employees shall process the property and
certify that the inventory is correct. A notation shall be made that the inmate refused to sign the form.
RIOTS, HOSTAGES ~ DISRUPTIVE BEHAVIOR
No inmate will in any manner impede, obstruct, or handlcap an employee in the performance of his/her
duties; nor engage singularly or in concert with others in action or conspiracy to.escape, riot, or disrupt
nom~al institution routine; nor detain nor hold as hostage any other person.
It is the policy of the Department of Corrections that there will be no negotiation until the institution is
brought under control and hostages, ff any, released.
Furthermore, any employee taken as a hostage loses his/her rank, identity, and authority as an official
while being held as a hostage. Any orders or requests made by such hostage will not be recognized nor
acted upon by other staff.
During a hostage situation there will be no change in policies of the institution. The standing orders and
functions of all employees not held hostage will remain unchanged. Taking hostages and making threats
will not cause or aid in release of or meeting demands made by those holding hostages. There will be no
amnesty given. Persons holding hostages will not be excused from prosecution.
H. GENERAL INFORMATION
CLASSIFICATION SYSTEM
(Brief Description)
Throughout the Department of Corrections a standard classification system is used to indicate the custody
level or program level of each inmate. You will be assigned a classification by the staff. Each level specifies
the restrictions or freedoms which apply to inmates at that level The current classification system is known
as PACT which stands for Pern$. sylvania Additive Classification Tool. The classification system places
inmates in housing units based upon their behavior; inmates who adjust poorly will be placed into higher
security type housing, while those who maintain proper behavior will generally be assigned to less
restrictive housing. A simplified description of these levels is: (See page 9).

(ii) Participation of community organizations in meaningful institutional
programs.
(iii) The use of volunteers who are trained and supervised in structured
activities.
(iv) Speak~ng engagements by jail administrator and staff.
. i(v) Participation in community activities by inmate speakers, panels,
choirs, and sP°r5 teams.
(2) Members of the news media with proper credentials should be encour-
aged to visit the jail. Such occasions should be utilized by the jail administra-
tor, custodial, and professional' staff to orient newsmen to jail management,
inmate behavior, t~ehabilitation efforts, and to problems and limitations of the
jail.

§ 95.245. Incoming publications.
Recommended guidelines. The following are the recommended guidelines for
incoming publications:
(1) The jaii administrator should give a wide latitude in allowing outside
magazine~, newspapers, reference materials, training manuals, religious tracts
.and pamphlets, fiction and nonfiction books, and legal publications to enter the
jail whether a part of the library or as personal inmate purchase·
(2) A decision to declare a publication unacceptable should be based on a
'clear' showing that admission of.the publication shall jeopardize the discipline
and good order of the jail.
(3) All prisoners should be permitted a reasonable quantity of reading
materials and all legal materials necessary for research or preparation of his or
her case, to be retained in his or her cell, locker, or dormitory. Neatness and
good order should be of primary concern rather than a specified number of
publications. ExCessive qUantities should be disposed of by amicable agree-
ment with the. inmate if at all possible.

§ 95.246. Investigations of deaths.
Minimum requirements. The following are the minimum requirements for
investigations of deaths of prisoners or jail staff:
(1) Whenever a prisoner or staff member dies within the jail or on jail
property, whether, the death be. from suicide, violence, accident, or natural
causes, an investigation by the local police or an appropriate law enforcement

Receipt of your appeal to the Superintendent of Grievance No. 10817 is acknowledged. In
preparing this response, I have reviewed your original grievance, the grievance officer's
response, and your appeal to this office.
Surely you have been around long enough to know that there are restrictions on the amount of
legal materials you are permitted to have in your possession at a given time. You are expected to
prioritize your work to current cases and we will store additional materials and will allow you to
access them on a one-for-one exchange as needed. This must be done for fire/safety reasons.
You are apparently interpreting Title 37 to permit you unlimited physical access in your cell to
your legal materials. This simply is not practical and you will be expected to comply with
Department of Corrections policy like everyone else. It appears there are six boxes of legal
materials in question, which you cannot keep in your cell at one time.
Based on the foregoing, your appeal is denied.

Dear Mr. Fortune:
This is to acknowledge receipt of your appeal to final review of the above numbered
grievance.
In accordance with the provisions of DC-ADM 804, effective January 1, 2001, I have
reviewed the entire record of this grievance; including your initial grievance, the grievance
officer's response, your appeal from initial review and the superintendent's response. I
have also carefully reviewed the issues you raise to final review.
Upon completion of this review, it is the decision of this office to uphold the
responses provided by staff at the institutional level. The response presented to you by Unit
manager Hamberger is accurate and consistent with policy and you are clearly aware that
the confiscation of your legal materials was within the authority granted under policy. Your
property is being held in storage and may be exchanged on a one for one basis in
accordance with established procedures.
The responses provided at the institutional level are appropriate and in accordance
with Department of Corrections policies and procedures. Accordingly, your appeal to final
review must be denied. ,
