PETITION FOR WITHDRAWAL OF PETITION FOR RELIEF REMOVING
RESPONDENT ROBERT G. FREY AS EXECUTOR OF THE ESTATE OF
LINWOOD B. PHILLIPS. JR.
And now comes the Petitioner, ALICE R. PHILLIPS, by and through her
attorneys, JAMES, SMITH, DIETTERICK AND CONNELLY, LLP, and files this
Petition for Withdrawal of Petition for Relief and hereby sets forth the following:
1. Petitioner filed a Petition for Relief to enjoin the Respondent, ROBERT G.
FREY, from disposing of any assets ofthe Estate as Executor of the Estate of Linwood B.
Phillips, Jr., with this Honorable Court on May 11, 2006.
2. The parties have reached a mesne resolution of these matters.
3. Petitioner hereby desires to withdraw its Petition for Relief filed in this matter
without prejudice.
WHEREFORE, Petitioner respectfully requests that this Honorable Court enter an
Order withdrawing Petitioner's Petition for Relief.
