STIPULATION AGAINST LIF~NS
IN THE COURT OF COMMON PLEAS
CUMBERLAND COUNTY,
PENNSYLVANIA
WHEREAS, Wheatland Custom Homes, Inc., of 447 Granite Run Drive, Lancaster,
Pennsylvania, is about to execute contemporaneously herewith, a contract with Wheatland Custom
Homes, Inc. of 447 Granite Run Drive, Lancaster, Pennsylvania, for the erection of a dwelling upon
a lot of land situate as follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, being more particularly bounded and described as follows,
to wit:
BEGINNING at a point on the eastern right-of-way of Sommerton Drive at the
common front property comer of Lot No. 132 and Lot No. 133 as shown on the hereinafter
mentioned plan of lots; thence along said right-of-way line of Sommerton Drive North 56 degrees
07 minutes 05 seconds East, a distance of 59.02 feet to a point; thence by a curve having a radius of
i25.00 feet and an arc length of 36.89 feet; thence North 39 degrees 12 minutes 40 seconds East, a
distance of 15.76 feet to a point; thence by a curve having a radius of 10.00 feet and an arc length
of 15.84 feet to a point on the southern dedicated right-of-way line of Jerusalem Road; thence along
said dedicated right-of-way line of Jerusalem Road South 50 degrees 03 minutes 14 seconds East,
a distance of 100.53 feet to a point; thence South 55 degrees 48 minutes 20 seconds West, a distance
of 150.45 feet to a point at the dividing line between Lot No. 132 and 133; thence along said dividing
line North 34 degrees 11 minutes 40 seconds West, a distance of 94.17 feet to a point, said point
being the Place of BEGINNING.
CONTAINING 13,160.37 square feet and shown as Lot No. 133 on Final
Subdivision Plan of Hampden Hearth Phase IV Subdivision Plan, prepared by Grove Associates and
recorded for the County of Cumberland in Plan Book 68, Page 66.
BEING KNOWN as
Pennsylvania 17055.
Sommerton Drive, Mechanicsburg,
UNDER AND SUBJECT to Declarations recorded in Miscellaneous Book 340, Page
491, and Miscellaneous Book 433, Page 942, in Cumberland County, Pennsylvania.
UNDER AND SUBJECT, nevertheless, to easements, restrictions, reservations,
conditions and rights-of-way of record and as shown on the above-mentioned Plan of Lots.
NOW, the / ~ ~ day of April, 2002, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Wheatland
Custom Homes, Inc., to the said Wheatland Custom Homes, Inc. to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract with
Wheatland Custom Homes, Inc. and the further consideration of One Dollar, to Wheatland Custom
Homes, Inc. paid by Wheatland Custom Homes, Inc., it is agreed that no lien shall be filed against
the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or
any other person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.
