WHEREAS, Contractor has undertaken and agreed to perform the construction of a
residential dwelling on that certain parcel of land situate in Lower Allen Township, Cu~land
County, described more fully on Exhibit A. . -- ~[ ~
NOW, THEREFORE, THIS AGREEM~ENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One ($1.00) Dollar in hand paid to it by Owner, the receipt
whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for itself and its subcontractors, and ail parties acting through or under it or them,
covenants and agrees that no mechanic's liens or claims shall be filed or maintained by it or any
of them against the said building and the lot of ground appurtenant thereto for or on account of
any work done or materiais furnished by it or any of them under said contract or otherwise, tbr,
towards, in or about the installation of the said sewage treatment plant on the lot above described,
and the said Contractor, for itself, its subcontractors and others under it hereby expressly waives
and relinquishes the right to have, file, and maintain any mechanic's liens or claims against the
said building or any of the improvements, and agrees that this instrument, waiving the right of
lien, shall be an independent covenant.
IN WITNESS WHEREOF, the parties hereto intending to be legally bound have hereunto
set their hands and seals the day and year first above written.

ALL THAT CERTAIN piece or parcel of land situate in Lower Allen Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the southern fight-of-way line of Sconsett Way, twenty-five feet (25')
from the centerline of the same and at the northeastern comer of Lot No. 138;
THENCE along said fight-of-way, along a curve to the right having a radius of one thousand nine
hundred twenty-five and zero one-hundredths feet, an arc length of sixty-nine and twenty-three
one-hundredths feet, following a chord bearing of South fifty degrees thirty-three minutes eight
seconds East, a distance of sixty-nine and twenty-three one-hundredths feet (R- 1925.00';
A=69.23'; S 50° 33' 08" E-69.23') to a point on the same, being at the northwestern comer of
Lot No. 136;
THENCE leaving said fight-of-way and along Lot No. 136, South forty degrees twenty-eight
minutes forty-one seconds West, a distance of one hundred eighty and ninety-eight one-
hundredths feet (S 40° 28' 41" W 108.98') to a point on line of lands of Phase 3 of the Heights of
Beacon Hill.
THENCE along said lands, North forty nine degrees fifty-one minutes twenty-five seconds West.
a distance of sixty-five and thirty three one-hundredths feet (N 49°~ 51' 25" W - 65.22') to a point
at the southeastern comer of Lot No. 138.
THENCE along Lot No. 138, North thirty-eight degrees twenty-five minutes three seconds East,
a distance of one hundred eight and nineteen one-hundredths feet (N 38° 25' 03" E-108.19') to
a point on the southern right-of-way line of Sconsett Way, being the point and place of
BEGINNING.
CONTAINING 7,318.49 square feet, or 0.168 acres.
BEING Lot No. 137 on the Final Subdivision Plan of the Heights of Beacon Hill, Phase 2,
prepared by Melham Associates, P.C., dated August 14, 1998, last revised May 15, 2000, and
recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in
Plan Book 82, Page 47; also being known as Unit No. 137 as shown on the Declaration Plat
recorded in Right of Way Plan Book 12, Page 130.
