COMPLAINT IN CIVIL ACTION
1. At the special instance and request of the defandant(s),
plaintiff sold and delivered to the defendant(s) merchandise and
services, on the dates, of the kinds, in the amounts and for the
prices set forth in a true and correct copy of plaintiff's books of
original entry attached hereto, made part hereof, and marked
Exhibit "An.
2. Defendant(s) accepted said merchandise and services
without complaint.
3. The prices set forth in Exhibit "A" are the market prices
for the said merchandise and services, and are the prices i!which the
defendant(s) agreed to pay therefor.
4. All the credits, if any, to which
is(are) entitled are set forth in Exhibit "A".
5. Plaintiff has made demand upon the defenda t (s) for
payment of the amount due, but the defendant(s)
and refused and still refuse (s) to pay the same or any part
thereof.
6. Plaintiff is also entitled to reimbursement of the couft
costs in the amount of $145.50.
WHEREFORE, plaintiff claims of the defendant(s)
amount of $9,831.21, plus court costs in the amount qf $145.50
totaling the sum of $9,976.71, together with interest qp attorney
fees.

AND NOW COMES THE DEFENDANT, Jeffrey A. Wilbur Plumbing and
Heating, Inc, by and through their attorney, the Office of Fenstermacher and
Associates, P,C. and makes the following Preliminary Objections to Plaintiff's
Complaint.
I. Demurrer rtP8.R.C.P. 1028 (8)(2)1 on Count 1
1. Pa,R.C.P. 10199(h) requires that a contract claim is based upon an
agreement and the pleading shall state specifically if the Agreement was written or oral.
2, Count I Plaintiff's Complaint alleges breach of contract by
Defendants,
3, Plaintiff's Complaint neither references whether the Contract was
oral or in writing and further, if it is in writing, fails to attach a copy of that writing as is
required under Pa.R.C,P 1019(i).
WHEREFORE, Defendant respectfully requests that the Honorable Court
dismiss the Plaintiff's Complaint.
II. Preliminary Obiection in the Nature of Insufficient Specificity of Pleadina
[PA.R.C.P. 1028(a)(3)1 Counts I. II and III
4. Paragraphs 1 through 3 are incorporated fully herein by reference,
5, PaRC.P. 1028 (a)(3) requires that averments oftime, place and
special damages must be specific.
6, In the Plaintiff's Complaint, there are no such averments of time,
place and/or specificity of damages.
THEREFORE, Defendant requests this Honorable Court to dismiss the
Complaint or, alternatively, require Plaintiff to amend such Complaint with sufficient
specificity to satisfy the requirements of Pa.R.C.P. 1028 (a)(3).
III. Preliminary Obiection in Nature if a Motion to Strike
Reauest for Attorney's Fees and Interest
7. Paragraphs 1 through 6 are incorporated fully herein by reference.
8. Defendants assert in the Complaint claims for attorney's fees and
interest.
9. Defendants have failed to set forth any basis for recovery of legal
fees which is recognized by the Courts of the Commonwealth of Pennsylvania nor any
basis for the payment of pre-judgment interest.

AMENDED COMPLAINT IN CIVIL ACTION
1. At the special instance and request of the defendant(s),
plaintiff sold and delivered to the defendant(s) merchandise and
services, based upon an oral agreement evidenced by invoices and
work orders, on the dates, of the kinds, In the amounts and for the
prices set forth in a true and correct copy of plaintiff's books of
original entry attached hereto, made part hereof, and marked
Exhibi t "A".
2. Defendant(s) accepted said merchandise and serVlces
without complaint.
3. The prices set forth in Exhibit "A" are the market prices
for the said merchandise and services, and are the prices which the

defendant(s) agreed to pay therefor.
4. All the credits, if any, to which the defendant(s)
is(are) entitled are set forth in Exhibit "A".
5. Plaintiff has made demand upon the defendant(s) for
payment of the amount due, but the defendant(s) has (have) failed
and refused and still refuse (s) to pay the same or any part
thereof.
WHEREFORE, plaintiff claims of the defendant(s) the sum of
$9,831.21 together with interest of 1.5% per month as conspicuously
stated and listed on the invoices attached and labeled Exhibit "A".
VERIFICATION
PAUL M. SCHOFIELD, JR., ESQUIRE, hereby states that he is the
attorney for the Plaintiff(s) in this action and verifies that the
statements made in the foregoing pleading are true and correct to
the best of his knowledge, information and belief.

ANSWER AND NEW MATTER TO PLAINTIFF'S AMENDED COMPLAINT
AND NOW COMES THE DEFENDANT, Jeffrey A. Wilbur Plumbing and
Heating, Inc. by and through their attorney, the Office of Fenstermacher and
Associates, P.C. and hereby answers plaintiffs Amended Complaint and avers
as follows:
1. Denied. It is denied that Plaintiff sold and delivered to Defendant every
merchandise and service set forth in Exhibit "A." No oral agreement authorizing
such orders exist, and Plaintiffs records do not correctly represent work
authorized by Defendant.
2. Admitted in part and denied in part. It is admitted that Plaintiff provided
merchandise and services to Defendant and Defendant did not complain.
However, it is specifically denied that Defendant requested or authorized every
good and service set forth in Exhibit "A."
3. Admitted in part and denied in part, It is admitted that Defendant
agreed to pay market price for certain work to be performed, however such
charges were neither fair, reasonable, or authorized. It is denied that Defendant
orally authorized or agreed to pay for any work not specifically outlined within the
agreement.
4. Denied. The credits set forth in Exhibit "A" do not accurately reflect the
amount properly credited forthe work.
5. Denied. To the contrary, Defendant has paid what is owed Plaintiff for
the work agreed upon in writing and performed.
WHEREFORE, the Defendant requests judgment against Plaintiff,
together with costs and any other relief the Court deems appropriate.
NEW MATTER
6. Defendant Jeffrey A. Wilbur Plumbing and Heating, Inc. incorporates
herein by reference its Answer to Plaintiffs Amended Complaint, paragraphs 1
through 5, inclusive, as though fully set forth.
7. Plaintiff performed and improperly seeks to be reimbursed for work that
was not agreed upon in the written contract.
8. The action for the amount claimed hereunder is barred by the statute of
frauds.
9. The action for the amount calimed hereunder is barred by the statute of
limitations.
WHEREFORE, the Defendant requests judgment against Plaintiff,
together with costs and any other relief the Court deems appropriate.

AND NOW, comes Defendant, Jeffrey A. Wilbur Plumbing and Heating, Inc" by
and through its attorneys, the Offices of Fenstermacher and Associates, P.C" and files
this Motion to Strike Plaintiffs Petition for Appointment of Arbitrators as follows:
1, On August 18, 2005, counsel for Defendant received an Order of Court
signed by the President Judge and dated August 12, 2005 appointing
arbitrators in the above-captioned matter.
2, Prior to that date, counsel for Defendant was not aware that Plaintiff had filed
a Petition for Appointment of Arbitrators, because Plaintiffs counsel never
served a copy of the petition on Defendant's counsel.
3, There has been no activity in this case for more than two years,
4. No discovery has been conducted in this matter.
5, This matter is not ready for arbitration,
WHEREFORE, Defendant respectfully requests that this Honorable Court
enter an Order striking Plaintiffs Petition for Appointment of Arbitrators and
rescinding its Order dated August 12, 2005.

PLAINTIFF'S REPLY TO DEFENDANT'S MOTION TO STRIKE PETITION FOR
APPOINTMENT OF ARBITRATORS
Plaintiff, by and through counsel, files this response to
Defendant's Motion to Strike the appointment of arbitrators, in
support thereof Plaintiff avers the following:
1. Plaintiff initiated this instant lawsuit as a simple
collection matter in May of 2002.
2, Defendant filed preliminary objections to Plaintiff's
complaint and Plaintiff responded with an amended complaint
shortly thereafter,
3. Defendant did not respond within the time allowed under the
rules of civil procedure and Plaintiff sent a 236.1, "10 day
letter", to Defendant and his counsel.
4. Defendant then filed an answer.
5, Plaintiff has attempted to amicably resolve the matter,
however, the Defendant has not been receptive to Plaintiff's
efforts.
6, Defendant has had three years to complete discovery.
7, Defendant has not requested any discovery of the Plaintiff
in over 3 years.
8. Plaintiff is prepared to proceed and has allowed ample time
for Defendant's discovery,
9. plaintiff has complied with Cumberland County Rules of civil
procedure, specifically rule 1302-2 which allow for any
party to petition the court for appointment of arbitrators,
10. Plaintiff should not be prejudiced merely because Defendant
neglected to conduct any discovery.
Wherefore, Plaintiff respectfully requests this Honorable Court
deny Defendant's Motion as it is without merit.
