LAST WILL AND TESTAMENT OF RUTH A. STAKE
I, RUTH A. STAKE, of the Borough of Mechanic:sburg, County of
Cumberland and State of Pennsylvania, being of sound and disposing mind,
memory and understanding, do make, publish and declare this my Last Will
and Testament, hereby revoking and making void any and all former Wills
by me at any time heretofore made.
1.
I direct the payment of all my just debts and funeral expenses
as soon after my decease as the same can be conveniently done.

2.
All the rest, residue and remainder of my estate, real, per-
sonal and mixed, of whatsoever nature and wheresoever the same may be
situate, I give, devise and bequeath to my husband, JOIlN R. STAKE,
absolutely and unconditionally.
3.
In the event my said husband, JOllN R. STAKE, should predecease
me, or should he die within thirty (30) days of my death, I give, devise
and bequeath my entire estate, real, personal and mixed, whatsoever and
wheresoever situate, in equal shares, to my children.
4.
LASTLY, I nominate, constitute and appoint my husband, JOHN
R. STAKE, Executor of this, my Last Will and Testament, and in the event
he should predecease me, or should he be unable or unwilling to serve in
such capacity for any reason, I nominate, constitute and appoint my
daughter, CAROL L. HOY, to be the Executrix of this, my Last Will and
Testament, in his place and stead.
IN WITNESS WHEREOF, I have hereunto set my hand and seal

~ 3326. Administrator D.B.N. and D.B.N.C.T.A.
An administrator de bonis non, with or without a will annexed, shall have the power to recover the assets of the estate from
his predecessor in administration or from the personal representative of such predecessor and, except as the will shall provide
otherwise, shall stand in his predecessor's stead for all purposes, except that he shall not be personally liable for the acts of his
predecessor. When he has been required to give bond, no proceeds of real estate shall be paid to him until the court has made an
order excusing him trom entering additional security or requiring additional security, and in the latter event, only after he has
entered the additional security.

When an entire vacancy occurs in the office of personal representative before administration is completed, the register, in a
case of intestacy, shall grant letters of administration de bonis non, and in the case of testacy, letters de bonis non cum testamento
annexo, to the person or persons entitled thereto.

This takes the place of Sections 3(b) and (c) of the Fiduciaries Act of 1917. No reference is
made to the rights of the executor of a deceased executor as in Section 3(b) of the 1917 Act or to the powers of
administrators d.b.n. or d.b.n.c.t.a. as in Section 3(e) of the 1917 Act. These are included in Sections 514 and 517 [20
Pa.C.S. 99 3324, 3326], infra. As in Section 308 [20 Pa.C.S. ~ 3158] "the person or persons entitled thereto" refers to
the persons listed in Section 305 [20 Pa.C.S. ~ 3155].
