STlPULATION AND WAIVER OF MECHANIC'S UENS
Made thiS~ay of July, 2006, by Harold Cassell d/b/a HOC
Construction hereinafter referred to as Contractor, for the benefit of the
Shippensburg Non-Profit Housing Corporation, hereinafter referred to as Owner,
whereby the former will undertake and has agreed to a remodel a residential
dwelling on that certain lot of ground situate in Shippensburg Borough,
Cumberland County, Pennsylvania known as 105 East Orange Street,
Shippensburg Borough, Pennsylvania.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in
consideration of the sum of One ($1.00) Dollar, in hand paid by the Owner, the
receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid for himself and his subcontractors, and all
parties acting through or under them, covenants and agrees that no mechanic's
liens or claims shall be filed or maintained by them or any of them against the
said dwelling and the lot of ground appurtenant thereto for or on account of any
work done or materials furnished by him or any of them under said contract or
otherwise, for towards, in, or about the remodeling and construction work on the
said dwelling on the lot above described, and the said Contractor, for himself, his
subcontractors and others under them hereby expressly waive and relinquish the

right to have, file, and maintain any mechanic's lien or claims against the said
dwelling and agree that this instrument waiving the right of lien, shall be an
independent covenant.

Nothing herein however shall extinguish or limit any other civil remedy
available to Contractor to recover any money due and this waiver is given to
assure first lien position to any mortgage lender and in no other way than set
forth herein shall Contractor's right and remedies be limited.
