MECHANICS' LIEN CLAIM
AND NOW comes Claimant, Whisler's Well Drilling, Inc. ("Claimant'), by and through the
undersigned counsel, and files this claim of mechanics' lien against George Ward, pursuant to the
Mechanics' Lien Law of 1963, as amended, against the improvementsand the property at 1402
Longs Gap Road, Carlisle, Cumberland County, Pennsylvania for the payment of all debts due
Claimant as a contractor for labor and materials furnished in the construction of the improvements.
In support of the claim the Claimant makes the following statements:
1. The Claimant is Wbisler's Well Drilling, Inc., having its principal office at 366-1 Green
Springs Road, Newville, Cumberland County, Pennsylvania.
2. The owners or reputed owners of the property and improvements against whom the
claim is filed is LAURA E VAZQUEZ (the "Owner").
3. The Contractor, G & W Building, having its principal office at 4-B Jefferson Lane,
Whiting, New Jersey 08759 is under contract by the Owner to

7. The property subject to the lien is a 1402 Longs Gap Roadl Carlisle, Cumberland,
County, Pennsylvania, Parcel I.D. No. 29-05-0425-048, Deed Book 00270, Page 04818, including all
equipment that as part of said structure constitutes fixtures, together *ith the lot or curtilage
appurtenant thereto belonging to the same Owner.
8. This lien is claimed from February 2, 2006, the date Claim#t commenced performance
of the work on the property herein described and against the Owner'slinterest in that property.
WHEREFORE, Claimant files this claim for mechanics' lien 0 the amount of $7,702.42
plus filing and Sheriff's service costs in the amount of $114.00 with iai erest as provided by law.

THIS AGREEMENT made and concluded this /9 day of October, 2005,
between Laura E. Vazquez, of 95 Orient Way #51), Rutherford, NJ 07070, party of the
first part (hereinafter called Owner), and George Ward, of 4-13 JetTerson Lane, Whiting,
NJ, 08759, party of the second part (hereinafter called Contractor).
WEHREAS, the said parties have by a duly executed Agreement under seal, dated
f _U entered into a written contract for the construction
and completion of a single-family dwelling located at 1402 Longs Gap Road, Carlisle,
Pennsylvania.
NOW THIS AGREEMENT WITNESSETH, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by
the said Owner to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar, to Contractor paid by Owner, it is
agreed that no lien shall be filed against the building by the Contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.

DEFENDANT'S PRELIMINARY OBJECTIONS PURSUANT TO 49 P.S. & 1505

ENGLE, ESQUIRE
YOU ARE HEREBY NOTIFIED TO FILE A WRITTEN RESPONSE TO THE
DEFENDANT'S PRELIMINARY OBJECTIONS WITHIN TWENTY (20) DAYS FROM
SERVICE HEREOF OR A JUDGMENT MAY BE ENTERED AGAINST YOU.
AND NOW, comes Laura Vazquez, by and through her attorneys, MARTSON LAW
OFFICES, and files the following Preliminary Objections to the Mechanics' Lien Claim filed in the
above-captioned matter by Whisler's Well Drilling, Inc.:
Defendant, Laura Vazquez, is an adult individual residing at 95 Orient Way,
Apartment 5D, Rutherford, New Jersey.
2. Claimant Whisler's Well Drilling, Inc. is a business located at 366-1 Green Springs
Road, Newville, Cumberland County, Pennsylvania.
3. On or about September 1, 2005, Defendant accepted a proposal ("Contract") from
George Ward, the contractor for G&W Builders and Contracting ("General Contractor"), for the
construction and completion of a residence located at 1402 Longs Gap Road, Carlisle, Cumberland
County, Pennsylvania. A copy of the Contract is attached hereto and incorporated as Exhibit "A."
4. On or about October 19, 2005, Defendant and George Ward, as the Contractor for
G&W Builders & Contracting, entered into a Stipulation Against Liens.
5. The Stipulation Against Liens was filed at Docket No. 05-5473 on or about October
20, 2005. It was also indexed in the Prothonotary's Office with Defendant and the Contractor each
being listed as the Owner and Contractor. A copy of the Stipulation Against Liens and proof of its
indexing are attached hereto and incorporated as Exhibit "B."
6. Claimant, as a subcontractor of General Contractor, upon information and belief,
provided work, labor and equipment related to excavation, plumbing and heating for the construction
of Defendant's residence at 1402 Longs Gap Road.
7. Upon information and belief, Claimant commenced work on Defendant's residence
on February 2, 2006.
8. Pursuant to 49 P. S. § 1402(a), "[a] written contract between the owner and contractor
... which provides that no claim shall be filed by anyone shall be binding; but the only admissible
evidence thereof, as against a subcontractor, shall be ... proof that such contract ... was filed in the
office of the prothonotary prior to the commencement of the work upon the ground ... [and] indexed
in the name of the contractor as defendant and the owner as plaintiff and also in the name of the
contractor as plaintiff and the owner as defendant."
9. Pursuant to 49 P.S. § 1402(b), if the prothonotary's office indexed the contract
electronically so that it is "retrievable regardless of whether the parties are designated as plaintiff or
defendant," then it "may be indexed in the name of the contractor as defendant and the owner as
plaintiff or in the name of the contractor as plaintiff and the owner as defendant."
10. Pursuant to the terms of the Stipulation Against Liens, Defendant and its Contractor
agreed that no lien would be filed against the residence either by the Contractor or by any sub-
contractor.
11. According to 49 P.S. § 1402, the Stipulation against liens is enforceable against
Claimant. Consequently, Claimant's Mechanics' Lien Claim has been made against property which
is exempt or immune from lien.
12. As a result of Claimant's Mechanics' Lien, Defendant has suffered, and continues to
suffer, difficulty in obtaining financing for the completion of her residence.
WHEREFORE, Defendant respectfully requests this Honorable Court sustain these
Preliminary Objections and order that the Claimant's Mechanics' Lien Claim be stricken.

THIS AGREEMENT made and concluded this (9 +tl day of October, 2005,
between Laura E. Vazquez, of 95 Orient Way #51), Rutherford, NJ 07070, party of the
first part (hereinafter called Owner), and George Ward, of 4-13 Jefferson Lane, Whiting,
NJ, 08759, party of the second part (hereinafter called Contractor).
WEHREAS, the said parties have by a duly executed Agreement under seat, dated
1 , _U entered into a written contract for the construction
and completion of a single-family dwelling located at 1402 Longs Gap Road, Carlisle,
Pennsylvania.
NOW THIS AGREEMENT WITNESSETH, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by
the said Owner to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar, to'Contractor paid by Owner, it is
agreed that no lien shall be filed against the building by the Contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any labor.
or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
