Douglas Enck and Patricia Enck, husband and wife, hereinafter
referred to as OWners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the, certain lot of ground
situate in HlUIIPden TownShip, CUmberland Cljlunty, Commonwealth of
Pennsylvania, and more fully described in" Exhibit "A" which is
attached hereto and made a part hereof (llnd known as Lot #39
pinehurst Hills, Hechanicsburg, HlUIIPden Township, cumberland
County, Pennsylvania.

NOW THEREFORE, THI:S AGREEMI!:NT WITNESSETH, That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by OWner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself o,r themselves and its,
his or their subcontractors, and all part~es acting through or
under them, covenant and agree that no mech~nic's liens or claims
shall be filed or maintained by them or a~v of them against the
said buildings and the lot of ground appurt~pant thereto for or on
account of any work done or materials furni~hed by them or any of
them under said contract or otherwise, for,itowards, in, or about
the erection and construction of the said.. buildings on the lot
above described, and the said Contractor, ~or itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Corporation by himself as such President.

ALL THAT CERTAIN tract of land situate in Hampden Tfnship, Cumberland
County, Pennsylvania, in accordance with a plan entitled .oF al Subdivision Plan
for Watts Tract", dated August 19, 1999 and last revised Ju . 25,2000, said parcel
being Lot 39 and more fully described as follows: i
BEGINNING at a concrete monument on the northern righ. of way of Smith Drive
(T -600) at the southeast corner of unit 38; thence along unit! 8 the following three
(3) courses and distances: 1. North 06 degrees 41 minutes 1 seconds West, a
distance of 160.18 feet to a point; 2. South 87 degrees 03 mutes 08 seconds West,
a distance of 202.53 feet to a point; 3. South 05 degrees 47 nl/iuutes 04 seconds West,
a distance of 238.22 feet to a point on the northern right of way of Smith Drive (T-
