WHEREAS, DP Industrial, LLC, c/o DP Partners, 200 North 3rd Street - Suite 1402, Harrisburg,
PA 17101, hereinafter called "Owner", has or is about to execute~ontemporaneOUSlY with R. S.
Mowery & Sons, Inc., of 1000 Bent Creek Boulevard, Mechani sburg, Pennsylvania, 17050,
hereinafter called "Contractor", a contract for the construction an. . or erection of improvements
upon certain lands of Owner located in North Middleton To hip, Cumberland County,
Pennsylyania, more particularly described as Lot 6 in the final Subdivision Plan for
Logisticenter at Carlisle, recorded with the Recorder of Deeds Oftce of Cumberland County on
August 1,2003, in Plan Book 87 page 88, and located at 1400 Di .. 'bution Drive, Carlisle, PA.
Now effective this eighteenth day of July 2006, a the time of and immediately
before the execution of the principal contract, and/or before any a$thority has been given by the
Owner to the Contractor to commence work on said improv~' nts or land, or to purchase
materials for the same, and before any such work has actually co . enced, it is hereby stipulated
and agreed by and between said parties as part of said contract a d the further consideration of
One Dollar to Contractor paid by Owner, that neither the ndersigned Contractor, any
subcontractor or materialman, nor any other person furnishing abor or materials to the said
Contractor under the contract entered into between said parties shll file a lien for work done or
materials furnished to said improvements, land or any part thereof, ,and any right to so lien which
otherwise might exist is hereby expressly waived. WITNESS our ds and seal the day and year
aforesaid.
