STIPULATION AGAINST LIENS

THIS AGREEMENT made the 22 day of APRIL, 2002
by and between RICHARD B. DAVIS GENERAL CARPENTRY
hereinafter referred to as Contractor,
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, in NORTH MIDDLETON TWP, CUMBERLAND COUNTY, PENNSYLVANIA, LOT #92
NORTHRIDGE SUBDIVISION
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and
in consideration of the sum of ~ Dollar to it in hand paid
by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument,
waiving the right of lien, shall be an independent covenant.

~.LL THAT CERTAIN lot of land situate in North Middleton Township,
Cumberland County, Pennsylvania, more particularly bounded and
described as follows:
BEGINNING at a point on the eastern side of Cedar View (50 feet) at
the southwestern corner of Lot No. 91 on the hereinafter mentioned
Plan of Lots; thence by Lot. No. 91 South 85 degrees 49 minutes 37
seconds East 147.43 feet to a point at Phase Three; thence by Phase
Three South 11 degrees 12 minutes 00 seconds west 111.60 feet to a
point at Lot No. 93; thence by Lot No. 93 North 78 degrees 48 minutes
00 seconds West 109.98 feet to a point on a cul-de-sac at the end of
Cedar View: thence by the cul-de-sac and Cedar View the following
three courses and distances: (1) by a curve extending to the left in a
northwesterly direction and having a radius of 45 feet an arc distance
of 53.11 feet; (2) by a curve extending to the right in a
northwesterly direction and having a radius of 11.00 feet an arc
distance of 10.33 feet; (3) North 04 degrees 10 minutes 23.seconds
East 41.95 feet to the place of beginning.
Containing 13,582.73 square feet.
BEING Lot No. 92 on a Final Subdivision Plan for North Ridge Phase II
made by Hartman and Associates, Inc., for Fred A. Gettys and recorded
in Cumberland County Plan Book 76, Page 74.
UNDER AND SUBJECT, also, to all restrictions, reservations,
conditions, and easements set forth on the recorded Plan of Lots or
appearing in prior instruments of record.
BEING a part of the premises which Robert L. Noll and Mary E. Noll,
his wife, by their deed dated December 31, 1986, and recorded in
Cumberland County Deed Book K, Vol. 32, Page 875, granted and conveyed
unto Fred A. Gettys, one of the Grantors herein.
