PETITION TO TRANSFER OWNERSHIP OF VEHICLE
AND NOW. comes the Petitioner, the Pennsylvania State Police ("PSP") as an agent
of the Commonwealth of Pennsylvania, represented by its attorney, Assistant Counsel
Thomas F. Jakubiak, from the PSP's Office of Chief Counsel, to respectfully request that this
Honorable Court issue an order authorizing the Commonwealth of Pennsylvania to take
ownership of the above-referenced vehicle pursuant to Title 75 Pa.C.S. ~ 7105(c), In support
hereof, the PSP avers as follows:
1. On (or about) October 18, 2004, John C. Dailey. Cumberland County Assistant
District Attorney, filed a motion for disposal of property ("Exhibit A") in the Court
of Common Pleas of Cumberland County, Pennsylvania regarding One 1987
Chevrolet Suburban, true VIN 1GNEV16K4MF116625..
2. On (or about) October 26, 2004, the Honorable Judge Kevin A. Hess granted
the motion and issued an order of court regarding One 1987 Chevrolet
Suburban, true VIN 1GNEV16K4MF116625.
3. The order directed for the disposal by sale or destruction of the 1987 Chevrolet
Suburban, true VIN 1 GNEV16K4MF116625.

The vehicle remains in custody of PSP after PSP applied for title to the 1987
Chevrolet Suburban, true VIN 1 GNEV16K4MF116625, for disposal by sale or
destruction.
5. The Pennsylvania Department of Transportation rejected the application to title
this vehicle as the court order dated October 26, 2004, did not specify to whom
the vehicle was to be entitled.
WHEREFORE, Petitioner. Pennsylvania State Police, respectfully requests this
Honorable Court to issue an order authorizing the Commonwealth of Pennsylvania to take
ownership of One 1987 Chevrolet Suburban, true VIN 1 GNEV16K4MF116625, with the
vehicle to be titled in the name of the Department of General Services.

2. While attempting to obtain surance for thevehic1e,

Bramble discovered discrepa ies with the vehicle's Vehicle
Identification Number, (VIN), and contacted Pennsylvania
State Police, (PSP).
3. The PSP determined that the ublic VIN placard
(1GNER16H1HF177882), locate on the windshield, did not
match the manufacturer's VIN (lGNEV16K4MFl16625) that
belonged to that vehicle and that the true public
manufacturer's VIN placard h d been removed and replaced
with a VIN placard from anot er vehicle.
4. The PSP investigation reveal d that a confidential VIN
hidden on the vehicle and th vehicle's engine number
matched. By tracing the his ory of that true VIN it was

discovered that the Suburban was reported stolen from Tony
Kelly Auto, 4300 Erdman Ave., Baltimore, Maryland, on
January 6, 1997.
5. On January 6, 2003, the PSP seized Bramble's Suburban and
Erie Insurance paid Bramble's claim for loss of his
vehicle.
6. The PSP investigation indicated that Tony Kelly Auto is no
longer in business and all attempts by PSP and Maryland
State Police Auto Theft Unit to locate the rightful owner
have been unsuccessful. (Exhibit 1).
7. After exhausting all means of contacting Tony Kelly Auto,
PSP sent a Notice of Motor Vehicle Recovery via certified
mail to the last known address of Tony Kelly Auto and the
letter was returned indicating that the attempted recipient
was not known.
8. The Suburban remains in PSP custody and PSP is requesting
permission from this Court to dispose of the vehicle.
WHEREFORE, the Commonwealth respectfully requests your Honorable
Court to direct disposal by sale or destruction of said 1987
Chevrolet Suburban (VIN: 1GNEV16K4MF116625), as described in the
within petition.

Would you plea5!l review the attached copy of this report reference the recovery of a
Chevrolet Suburban. As per the report, the public VIN in the windshield is not the VlN
that belongs on the vehicle and it appears it has been that way for quite a while. I Was
able to determine the true VIN of the vehicle and discovered that it had been stolen from
. a dealership in Baltimore, MD in January 1997 . 1 found the engine number of the vehicle
and also the confidential VIN and they both match which leads me to believe that I have
the complete vehicle except for the VlN plate. r obtained a copy of the theft report from
Baltimore,. MDand there was no indication that the vehicle had ever been recovered.
According to the Baltimore report, the vehicle was stolen from Tony KELLY Used Cars,
4300 Erdman A ve,Baltimore. MD. I have attempted to contact Tony KELL Y Used Cars
and have been unsuccessful. I tried several different phone numbers to include the one on
the report and the numbers have either been disconnected or now belong to another
residence/business. 1 have checked the internet for the dealer name, .addtess and phone
number and have found nothing. As a last resort, I sent a certified tetter to the address for
the victim listedonthe Baltimore Police report and it came back to me labeled
"ATIEMPTED, NOT KNOWN". It appears as if the dealership no Jongerexists. Would
it be possible for the Commonwealth to obtain a court order fur the vehicle so we can get
rid of it? After reviewing, would you please advise me. The incident number for this
investigationis H02. 13 0 1961.

SYNOPSIS:
Theabpve listed victim discovered several descrepancies with the above listed vehicle and brooght the
descrepanciesto the. attention of this officer.l did a preliminary inspection of the vehicle and found that
there was adescrepancy between the public V1N and the confidential V1N. I then checked both VINs
through the National Insurance Crime Bureau (NICB) and found that the confidential VIN came back to a
. stolen vehicle from Baltimore, Maryland.
NARRATIVE:
On 12/11/02. the victim left a message at PSP Harrisburg for me to con tact same. Several days later I
contacted BRAMBLE and he advised me that he had recently purchased a 1987 Chevrolet Suburban
from AFFORDABLE Cars and Trucks, Inc., in Harrisburg, PABRAMsLE related that after the purchase
he contacted his insurance company to give them all of the info on the vehicle including the VIN, The
insurance agent performed a VIN check and advised BRAMBLE that theVIN. came back to a two wheel
drive and the engine size waste be a 305 cubic inch V8. This is when BRAMBLE noted the
descrepancies as the vehicle he had was a 4 wheel drive and the engine was a 350 cubic inch VB.
Through speaking with BRAMBLE, he advised that he knows enough about vehicles to say that the 4
wheel drive system. on the vehicle was factory installed, BRAMBLE requested that I check the VIN and
the vehicle to make SUfe all was valid. 1 advised BRAMBLE that J would check the vehicle as soon as I
could.
, I was able to obtain secondary VIN locations for this vehicle through the National Insurance Crime
i Bureau (NICB) and 0001/02103, I stopped at BRAMBLES' residence to inspect the. vehicle. I first
checked the public VIN plate and noted that the rivets used to attach this plate appeared to be square in
shape and nota rosette style rivet as used by the factory. I also notee:! the public VIN plate as having a
rusted appearance and there appeared to be a gouge on the dash surface behi nd this plate. I then
located the confidential VIN and found same to be CMF116625. This confidential VIN is to be a
derivative of the VIN arid the derivative that I obtained did not match that of the pUblic VlN.
On 01/03/03, I entered both the publicVIN and the confidentialVIN through the NICS database. The
public VI N (177882) only indicated shipping information and the confidential VIN (116625) indicated a
purged NCIC theft record. The location of the loss was Baltimore CilyPolice Dept. and the date of loss
was 01/04/97. The OCA fOf thethefl was 974A03624. I also performed VIN decoding on both V1NS, and
found the publicVIN was listed as a 1987 conventional cab 4X2 with a 5.0 Litre (305) va, while the
confidential VIN was listed as a 1991 conventional cab 4X4 with a 5.7 Litre (350) VB.
On 01/03/03, I contacted the Records Depl. of the Baltimore City Police Dept..(410} 396~2359, and

requested that they check thisOCA to see .if their records indicate if the vehicle had. ever been
recovered. They located the report and advised me that according to the report this vehicle had never'
been r~coliered. I then requested a copy faxed to me and I received the fax of this re port the same day,
A copy of the theft report isatlached to the station copy of this report. I reviewed the'report and the VIN
listed on the theft report did match that of the secondary VIN that I obtained from the victims vehicle. The
report also indicated t~aUhis vehicle had been stolen from a used car lot in Baltimore.
Based on the fact that there was a descrepancy betw~ the public VIN and the confidentail VIN, and
the fact thatthe pUblic VINappearedto be tampered with, I would need to seize this vehicle. I contacted
BRAMBLE and advised him what.l had learned to date and that I would need to seize the vehicle.
BRAMBLE related that he had numerous personnal items in the. vehicle so I advised him that he could
remove these items and then bring the vehicle to PSP Carlisle for same to be placed in impound until
the conclusion of this investigation.
On 01/06/03, BRAMBLE arrived at PSPCarlisle with the vehicle in question. I was not available at the
time so Tpr. Roger HALL, PSP Carlisle, completed Property Record H2-8485 and gave BRAMBLE a
copy of same to shoW receipt of same. Along with the vehicle, also entered into evidence was a key ring
with various keys and black fob, and a white envelope containing PA registration card. Insurance
card,MV4ST, and a copy of the contract from AFFORDABLE Cars and Trucks, Inc,
I have not yet notified Baltimore City PO of this recovery as I have to determine if this is the complete
stolen vehicle or justthe frame. I need to check several other things on the vehicle to determine same,
Investigation continues as I need to verify the engine and transmission numbers on the above Jisted
vehicle which will assist in identification.

On 01106103 at approximately 0815 hclurs, JoshuaJ{MIO) BRAMBLE WINIM DOB: 03138171 31
'OA arrived at PSP Carlisle. He adVised me that he had spoke to Tpr. Trent HURlEY from Auto Theft
lnd was adviSed that he needed totum his Chevrolet Suburban is'as evidence. I received.the vehicle as
lvidence along with a key ring with 6 keys and a blaCk key fob, and a white envelope containing a
'ennsylvania Registi'atlQn Card, an insurance card from Erie Insurance. an MV~T or pink slip for the
iale of the vehicle, and a yellow paper that was a contract from Affordable Cars And Trucks Inc. All of
his was placed into evidence under Property Number H2-8465 and a copy of the Property Record ;s
Ittached to this report. Also attached to this repOrt is a CO)>y of the registration card, insurance card, MV-

On 01/28/03. I was able to locate the eogine number on the above listed vehicle. This number was
found to be CMF116625. This number which is a derivative of the V1N was found to bathe same as the
confidential V1N that I.localed on the frame of the vehicle. This now leads me to believe that this is the
complete stolen vebic\elisted stolen by the Baltimore P.O. on 01/06197. It appears that the publicVlN
plate that is now affixed to the dash of this vehicle was placed. there to hide the true identity of the
vehicle. .
No message was sent to CLEANlNCIC to remove fro!" the files as this vehicle was purged from the
system in December 2001.
The license plate from this vehicle whDe. owned by the victim. PA reg- FF33192 was removed from the
vehicleaod retumedto BRAMBLE as he has since purchased another vehicle and wanted to transfer
this tag to the other vehicle. BRAMBLE also advised me that he is insured by ERIE Insurance and they
paid him a claim in the amount. that he purchased the vehicle.

Upon reviewing the title histories forthe VlN numers involved in this Investigation, I found that the
previous owner afthis Suburban (VIN:.1 GNER16H1HF177882) was Uoyd MCCUMBER Jr, 1057
Kitzmiller Road, G1enviHe, PA 17329. On 04/16/03, I contacted MCCUMBER via ceHular phone (443-
60+2546) and advised him that I am conducting an Investigation involving this vehicle. MCCUMBER
confirmed that he~oWJied this vehicle and related he Used same asa third vehicle primarily USed for
towing his trailer. According to records, Affordable Cars and Tl1Jcks, Inc, took possession afthls vehicle
from MCCUMBER on 07118/02 via trade. MCCUMBER related that if he reme~red correctly; he
owned the vehicle for approx 6 years which would indicate he owned the vehicle from approx 1996 to
2002 when he traded same, I asked MCCUMBER if he had any documentation from when he purchased
the vehicle and he said he didn't believe he did as it was a private sale. I adVised MCCUMBER the
reason I needed this was because the date of theft listed on the theft report frQm the Baltimore Police
Department indicated the theft of the vehicle bearing VlN 1GNEV16K4MF116625. which is the VlN
currently di8play~ on the frame of this vehicle, occurred 01104-01/06197 which would be during the time
that MCCUMBER said he owned the vehicle. MCCUMBER related that he thoughttha individual he
purchl!sed the vehicle from in Maryland was a doctor but that is all he remembers.
On 04/24103, I contacted Agent Dan PERRON, .Erie Insurance, (717) 657,.2081, and adVised him of the
status of the investigation.. Erie Insurance paid victim BRAMBLE for the loss and therefore has interest in
the disposition of the vehicle.
Investigation continues.

history shows that Uoyd MCCUMBER Jr,1 057 KitZmiHer Road, Glenville, PA, purchased this vehicle on
.11/07196, fromThomas White BROWNING, 1808 Sutton Ave, Baltimore, MD 21227.
On 06/30103, 'checked the TrueVIN, 1GNEV16K4MF116625, via NCIClCLEAN and folJndthat a
vehicle bearing this VlN is currently registered in the state of New York. Same is nllgistered u/'lder the
name of Giovanni LAMENDOLA, 124 Ira Road, Syosset, NY 11791. The NY registration is listed as
. POETRY4U and shows'.-n expiration date of 10/04. The vehicle is lis1ed as a 1991 Chevrolet
Stationwagon, greylred in color.
I then contacted DetediveJim BLANCAl'O, New York Police Dept, Auto Crimes, andrequtMlted a title
search on this "'N. BLANCA TO related that the address listed for this vetlicieis in. Nassau County, NY
and the contact for that area would be the Nassau County Police Dept, Crimes AgainslProperty
DMsion, (516)573'-52.75.
On 07/08103, I contactectNaS$8uCounty ~oIice Depl and spoke with DetectIve SOUTHARD, (516) 573-
5284, fax (516) 573..5289, and advised him that I would like to have the vehicle currenUy registered in
,NY with this VlN inspected based on the fac::tthe VlN is currently on a vehicle that I have impounded.
i SOUTHARD advised that he would do so but requested aD available info faxed to him. He related that
he would check the vehicle as soon as. possible. The information was faxed toSOlITHARO on 07108103.

learned Ihatthey. .(LAMENDOLA) . had traded the vehicle to . MYERS Chevrolet in Queens, NY on

I have been trying to locate the rightful owner of the vehicle that I have impounded at PSP Carlisle, true
V1N 1GNEV16K4MF116625. This is the. vehicle that is referenced in the theft report that I obtained from
the Bal1iomore P.D, The report indicates that this vehicle was stolen 01106197 from Tony KELLY Auto,
4300 Erdman Ave,BaItimore, MD and list a phone number as 41()..4~5150. I tried the phone number
and found same to be cflSCOMected. I also cheCked several sites on theintemetto.see if.1 could come
up With .adcfrtionaJ addresses or phone numbers for this dealership. I located a Tony KELLY and Family
Used Cars, 8322Pulaski Hwy, Baltimore, MD, (410) 682-9600, so I tried that number and found that the
number now belon9ed to Poor BoyseountryStore.1 al~ searched4300 En:/manAve, Baltlrrore,MO,
and found it carnes back to a private listing of David GOMERINGER, (410) 488-5742. .
I then forwarded an E-mail to Tpr. Bill HOLLANDSWORTH of the Maryland State PoIiceAuto Theft Unit,
and requested 8S$istance on locating this dealership or a good phone number. HOLLANDSWORTH
replied and told me to try (410) 488-0406 as that is the number for Tonys Auto Sports, 4300 Erdman
Ave, Baltimore, MD. I tried the number and found that same had been disconnected.
On 09/18/03, I cornpletedthe Notice orMolor Vehicle Recovery and forwarded same certified mail to
4300 Erdman Ave, Bait, MD. I am now waiting to see if this letter will be accepted at the address or if it
will. come back to me with a new forwarding address.

theft as Hated on the police reportthat I had obtained from Baltimore. I have not been able to locate the
owner in ardertosee if they had possessory interest in the vehicle. The rrjalling was sent to tOe address
listed on the theft reporlOn 10/27103,1 received the letter back and it WIIS indicated on the envelope
that the attempted' receipient was not knowl1. .
This investigation continues pending proper disposition of this property.
