COMPLAINT
AND NOW, comes the Plaintiff by its Attorney, Robert P. Reed, Esquire, and makes
claim against the Defendant as follows:
1. Plaintiff, Motorists Mutual Insurance Company, is a corporation organized and
existing under the laws of the State of Ohio and having its principal place of business
at 471 East Broad Street, Columbus, Franklin County, Ohio 43215.
2. At all times material to the Plaintiffs cause of action the Plaintiff was authorized to
do business in the Commonwealth of Pennsylvania and to issue policies covering
property casualty in the Commonwealth of Pennsylvania.

3. Defendant, Joseph Osbeck, is an adult individual residing at 2413 Logan Street,
Harrisburg, Dauphin County, Pennsylvania 17110.
4. At all times material to the Plaintiffs cause of action the Plaintiff insured a property
belonging to one, Evelyn Burkey, which property was located at 216 State Street,
West Fairview, Cumberland County, Pennsylvania 17025. Said property was insured
under policy number 77.55985540.
5. At all time material to the Plaintiff s cause of action, the Defendant was a tenant in
the aforesaid property at 216 State Street.
6. On Friday, August 5, 2005 a fire occurred at the aforesaid property at 216 State Street
resulting in the damages and repairs hereinafter related.
7. Upon investigation, it was determined that said fire was caused by the negligence,
recklessness and carelessness of the Defendapt in that he:
a. Permitted a lit cigarette to come in contact with a futon and cushions located on
the property;
b. Permitted a lit cigarette to remain in contact until a general conflagration
occurred; and
c. Failed to remain attentive to the situation or to extinguish the fire before it could
spread resulting in general damages to the property.
8. By reason of the aforesaid negligence, carelessness and recklessness of the
Defendant, said property required repair and contents required cleaning as detailed,
and in the amounts, itemized in the estimated attached hereto as Exhibit A.
9. The Plaintiff has now paid on behalf of its subrogor the sum of$6,581.63, which sum
it is entitled to recover from the Defendant.
WHEREFORE, Plaintiff demands judgment against the Defendant in the sum of
$6,581.63 together with interest from August 5, 2005 and the costs of this action, which
sum is within the jurisdictional limits for compulsory arbitration in Cumberland County.

Enter Default Judgment in favor of the Plaintiff, Motorists Mutual Insurance Company,
and against the Defendant, Joseph Osbeck, for his failure to plead to the complaint in this
action within the required time. The complaint contains a Notice to Defend within
twenty (20) days from the date of service thereof. The Defendant Osbeck was served
with the complaint by the sheriff on August 22, 2006, and his answer was due to be filed
on September 11,2006. To date, Defendant Osbeck has not filed or served an answer to
the Plaintiffs complaint.
Assess damages and enter judgment against Defendant Osbeck in the following amount,
being the amount demanded in the complaint:
