COMPLAINT
AND NOW, thists;~-~ay of April, 2002, comes the Plaintiff, CHARLENE R.
LIDDICK, by her attorney, Francis M. Socha, Esquire and files this Complaint and respectfully
avers the following:
1. Plaintiff, Charlene R. Liddick (hereinafter "Liddick"), an adult individual residing at
310 Summit Ridge Drive, Middletown, Dauphin County, PA 17057.
2. Defendant, Kathleen M. Rathbun(hereinafter "Rathbun"), an adult individual who
resides at 23 Nelson Drive, Carlisle, Cumberland County, PA 17013.
3. The facts and events that this action is based on occurred on or about November 14,
2001.
4. On the above date and time, Liddick owned and was operating a 1989 Plymouth
Voyager SE Van. At such time, Liddick was stopped at red light in the northbound lane of Rte.
11 on the Carlisle Pike in Hampden Township, Cumberland County, Pennsylvania.
5. On the above date, time and place, while Liddick's motor vehicle was stopped,
Rathbun failed to slow down the vehicle she was operating as she approached the red light and
struck Liddick's vehicle in the rear, as a result, causing the Plaintiff to suffer physical injuries.
6. The collision and all of the physical injuries and damages hereinafter related are the
direct and proximate result of the careless, reckless, and negligent manner in which Rathbun
operated her vehicle. The negligence, carelessness, and recklessness of Rathbun consists of, but
is not limited to, the following.
Failing to have the vehicle under proper and adequate control at the time
and place of the accident;
Operating the vehicle under a high and excessive rate of speed under the
circumstances; '
c. Failing to keep a proper look-out;
Failing to use due-care and acting without regard for the right, safety and
position of the vehicle in which Liddick was operating at the time and
place of the accident;
e. Traveling too fast for conditions;
Following too closely at an excessive rate of speed;
Failing to apply her brakes in time to avoid striking the vehicle in which
Liddick was operating; and
Otherwise operating her vehicle in a manner endangering persons and
property, and with careless disregard for the rights and safety of others,
and in violation of the Motor Vehicle Code of the Commonwealth of
Pennsylvania.
7. As a direct and proximate result of the aforesaid collision, Liddick suffered injuries
which are serious and permanent, including, but not limited to, a displaced trimalleolar fracture
of the left ankle.
8. As a result of the aforesaid injuries she received in this accident, Liddick has
undergone in the past, is undergoing in the present, and will undergo in the future great pain and
suffering.
9. As a result of this collision, Liddick has incurred reasonable and necessary medical,
rehabilitative costs and expenses, and lost wages.
WHEREFORE, the Plaintiff, Charlene R. Liddick, demands judgment against the
Defendant, Kathleen Rathbun, in an amount in excess of Thirty-five Thousand Dollars
($35,000.00), exclusive of interest and costs and in excess of any jurisdiction amount requiring
compulsory arbitration.
