AND NOW corne Sead and Sandra Jusufovic and files the following Complaint
and in support thereof, avers as follows:
1. Sead and Sandra Jusufovic are adult individuals who reside at 146 N.
Spring Garden Street, Carlisle, P A.
2. Allison Murray is an adult individual who resides at 1404 Bradley Drive B
314, Carlisle, PA_
3. Sead and Sandra Jusufovic are the owners of real estate located at 1404
Bradley Drive B 314, Carlisle, PA.
4. Sead and Sandra Jusufovic are the landlords of the real estate located at
1404 Bradley Drive B 314, Carlisle, PA.
5. Allison Murray is the tenant at1404 Bradley Drive B 314, Carlisle, PA.
6. Plaintiff and Defendant entered into a lease agreement dated _October 7,
2005-, which states that Defendant is to pay $_750.00_ a month
for the rental of said property on the _1 st_ of each month. A copy of
said lease is attached hereto as Exhibit I.
7. Defendant has failed to pay the amounts due under the lease for the
following months: July, 2006.
8. Plaintiff has given Defendant the required notice to vacate the property as
required by law.
9. Defendant is still in possession of said premises and refuses to pay the
required amount of rent due under the lease.
WHEREFORE, Plaintiff requests this Honorable Court to enter judgment in hislher favor
and require Defendant to vacate the premises and pay the rent amount due for the periods
Defendant was in possession of said property and for the month after vacating the
property as allowed by law, in the amount of$1500.00.

ANSWER
1. Admitted.
2. Denied. Defendant now lives at 318 E. North Street, Carlisle, P A 17013.

5. Denied. Defendant moved out of the premises on September 1, 2006.

7. Denied. Pursuant to her appeal, Defendant paid rent found due into an escrow
account with the Prothonotary.
8. Admitted.
9. Denied. Defendant has moved and the required rent due under the lease has
been paid to the Prothonotary.
WHEREFORE, Defendant prays that this Honorable Court dismiss Plaintiffs'
Complaint and enter judgment on behalf of the Defendant.
NEW MATTER
10. Paragraphs 1-9 are incorporated herein by reference hereto.
11. From the inception of the lease, Defendant complained to Plaintiffs about a
broken toilet.
12. The toilet ran continually, wasting water and causing an increase in water
consumption.
13. Despite said complaints, Plaintiffs made only token repairs with duct tape
which failed to alleviate the problem.
14. As an additional consequence of the broken toilet, other members of the
household would have to use the toilet in the Defendant's room, waking her up at odd
hours of the night.
15. In addition to the leaking toilet, Defendant's air conditioner, when in use,
leaked to the point where Defendant was filling and emptying 20 gallon buckets with
excess water.
16. Despite repeated complaints to the Plaintiffs about the toilet and the air
conditioner, Plaintiffs failed to take any action to make repairs, except as previously
noted.
17. In addition to the toilet and air conditioner leaks, the ceiling in the bathroom
leaked all winter, causing the paint to bubble.
18. Despite notice to the Plaintiffs ofthe condition of the water leaks from the
ceiling, the Plaintiffs made no repairs.
19. Prior to regaining possession of the leased premises, Plaintiffs came into
Defendant's home with their real estate agent, Jan Verow, without notice, while a guest
was showering.
20. Said intrusion embarrassed the Defendant and her guest and caused them
emotional harm.
COUNTERCLAIMS
1. IMPLIED WARRANTY OF HABIT ABILITY
21. Paragraphs 1-20 are incorporated herein by reference hereto.
22. Due to Plaintiffs' failure to repair the toilet, the air conditioner, and the
ceiling leaks in the bathroom, Plaintiffs breached the implied warranty of habitability, a
part of every residential lease.
23. As a result of this breach, Defendant was unable to use parts of her leased
premises, notably the bathroom, and therefore reducing the value of the premises to her
on a monthly basis.
24. As a result of Plaintiffs' breach, Defendant overpaid her rent during the time
she was in residence, in the following amounts:
a. November/December (2005) - $80.00
b. January/February (2006) - $100.00
c. March/April- $130.00
d. May/June - $180.00
e. July/August - $180.00
Total: $670.00
WHEREFORE, Defendant prays that judgment be entered in her favor and against the
Plaintiffs in the amount of Six Hundred and Seventy Dollars ($670).
II. UNFAIR TRADE PRACTICES ACT
25. Paragraphs 1-24 are incorporated herein by reference hereto.
26. By representing to Defendant, either expressly or impliedly, that the leased
real estate was up to acceptable standards of quality for human habitation, and by making
repairs that failed to resolve the problems complained of, while alleging that they did,
Plaintiffs violated the Pennsylvania Unfair Trade Practices Act, at 73 P.S.S201-
2( 4 )(ii),(iii),( v),( vi ),( vii),(xxi).
27. Plaintiffs actions were egregious and justify a claim for three times the
amount of Defendant's damages set out in Count I above.(73 P.S.g201-9.2(a))
WHEREFORE, Defendant prays that judgment be entered against the Plaintiffs in
the amount of $2010.00.
III. COVENANT OF QUIET ENJOYMENT
28. Paragraphs 1-27 are incorporated herein by reference hereto.
29. By entering the leased premises without notice, Plaintiffs beached the
covenant of quiet enjoyment inherent in every residential lease in Pennsylvania.
30. Said breach humiliated Defendant and her guest who was showering at the
time.
WHEREFORE, Defendant prays for damages against the Plaintiffs and in favor of
the Defendant in the amount of Two Hundred Dollars ($200.00).
