PETITION FOR APPEAL FROM IMPOSITION OF
IGNITION INTERLOCK REQUIREMENTS
1. Appellant herein is Sharon L. Myers, residing at and having a mailing address of: 31
Buttonwood Lane, Carlisle, Pennsylvania 17013.
2. Appellee herein is the Department of Transportation of the Commonwealth of
Pennsylvania, having a mailing address of: Pennsylvania Department of Transportation, Office of
Chief Counsel, Third Floor, Riverfront Office Center, Harrisburg, Pennsylvania 17104-2516.
3. By letter or notice dated February 27, 2002, a copy of which is attached hereto as
Exhibit A, the Department of Transportation sua sponte imposed ignition interlock requirements
before Appellant's operating privileges could be restored. The effective of suspension was
March 29, 2002 and Appellant appeals hereto from that date.
4. Imposition of ignition interlock requirements is unlawful in that it was done by
PennDOT without legal authority and in the absence of imposition of those requirements by this
Court.
5. On January 11, 2002, the Honorable Judge Pellegrini in the Commonwealth Court of
Pennsylvania, held that "because the trial court has jurisdiction over driver license suspension
appeals and because the plain language of the Act does not permit PennDOT to have independent

authority to impose installation of an ignition interlock device, the decision of the trial court is
affirmed." Schneider v. Commonwealth, 790 A.2d 363 (Pa. Commonwealth 2002).
WHEREFORE, Appellant respectfully requests that this matter be set down for a
hearing and that the imposition of ignition interlock requirements imposed on Appellant by
PennDOT be set aside.

In this appeal of an action taken by Appellee, Commonwealth of Pennsylvania,
Department of Transportation, Bureau of Driver Licensing (hereinafter Department of
Transportation or Appellee), Appellant requests that this court rescind that part of a
license restoration requirements notice that required, as a prerequisite to scheduled
restoration of Appellant's driving privilege, that Appellant equip each of the vehicles
owned by her with an ignition interlock system.
For the reasons stated in this opinion, Appellant's appeal will be sustained.
DISCUSSION
The facts in the present case are not in dispute. In an underlying criminal case,
Appellant, having pled guilty on January 2, 2001, to driving under the influence, was
sentenced to pay the costs of prosecution and a fine, to undergo a tei-ii~ of imprisonment
of thirty days to twenty-three months in the county prison, and, as a prerequisite to
restoration of her driving privilege, to complete an alcohol treatment program.~ The

sentencing court did not include a requirement that Appellant install ignition interlock
systems in her vehicles.2
Subsequent to this sentencing order, the Department of Transportation sent
Appellant a restoration requirements letter dated February 27, 2002, that detailed
prerequisites to restoration of her driving privilege. The Department of Transportation
required, as a prerequisite to scheduled restoration, that Appellant install an approved
ignition interlock system in each vehicle that she owned.3 The notice stated, in relevant
part, as follows:
You are required to have an approved Ignition Interlock System installed in
all of your vehicle(s). Approximately 30 days before your ELIGIBILITY
DATE, you should contact one of the following approved vendors listed
below to make arrangements to have the System installed.

- Consumer Safety Technology, Inc. - 1-877-777-5020
- National Interlock, Inc. (serving Eastern PA) - 1-866-342-4984
- American Court Services (serving Central/Western PA) - 1-888-565-6227
- Guardian Interlock Systems - 1-800-499-0994
- Draeger Interlock, Inc. - 1-800-385-8666
You will need to provide the vendor with the following court information
before the System can be installed.

On April 25, 2002, Appellant filed a Petition for Appeal from Imposition of
Ignition Interlock Requirement.5 A hearing was held on Appellant's appeal on July 29,
2002.

In Schneider v. Pennsylvania Department of Transportation, 790 A.2d 363 (Pa.
Commw. Ct. 2002), the Commonwealth Court stated:
Although [the appellant] had two DUI offenses and pursuant to
Section 7002(b), the trial court was required to order installation of an
ignition interlock device, that failure does not mean that PennDOT has been
given authority to override the trial court's order and require installation.
Section 7002 provides that only "the court shall order the installation on an
approved ignition interlock device .... "Because this provision gives a court
the sole authority, PennDOT has no unilateral authority to impose ignition
interlock device requirements if the trial court fails to do so.
Id. at 366 (footnotes and citations omitted) (emphasis omitted). Accordingly, the
Commonwealth Court affirmed the trial court's order rescinding the ignition interlock
system provision in the suspension notice issued to the appellant by the Department of
Transportation. Id.
On this issue, Schneider is indistinguishable from the present case and,
accordingly, the same result must obtain herein. Appellant's appeal will be sustained,
without prejudice to Appellee's right to pursue a challenge to this holding, as prescribed
by Schneider, on appeal.
For the foregoing reasons, the following order will be entered:

IGNITION INTERLOCK LICENSE

In this appeal of an action taken by Appellee, Commonwealth Of Pennsylvania,
Department of Transportation, Bureau of Driver Licensing (hereinafter Department of
Transportation or Appellee), Appellant requests that this court rescind that part of a
license restoration requirements notice that required, as a prerequisite to scheduled
restoration of Appellant's driving privilege, that Appellant equip each of the vehicles
owned by her with an ignition interlock system.
For the reasons stated in this opinion, Appellant's appeal will be sustained.
DISCUSSION
The facts in the present case are not in dispute. In an underlying criminal case,
Appellant, having pled guilty on January 2, 2001, to driving under the influence, was
sentenced to pay the costs of prosecution and a fine, to undergo a term of imprisonment
of thirty days to twenty-three months in the county prison, and, as a prerequisite to
restoration of her driving privilege, to complete an alcohol treatment program.~ The

sentencing court did not include a requirement that Appellant install ignition interlock
systems in her vehicles.2
Subsequent to this sentencing order, the Department of Transportation sent
Appellant a restoration requirements letter dated February 27, 2002, that detailed
prerequisites to restoration of her driving privilege. The Department of Transportation
required, as a prerequisite to scheduled restoration, that Appellant install an approved
ignition interlock system in each vehicle that she owned.3 The notice stated, in relevant
part, as follows:
You are required to have an approved Ignition Interlock System installed in
all of your vehicle(s). Approximately 30 days before your ELIGIBILITY
DATE, you should contact one of the following approved vendors listed
below to make arrangements to have the System installed.

- National Interlock, Inc. (serving Eastern PA) - 1-866-342-4984

You will need to provide the vendor with the following court information
before the System can be installed.

If you choose not to install the Ignition Interlock System in your vehicle(s),
your driving privilege will remain suspended for an additional year.4
On April 25, 2002, Appellant filed a Petition for Appeal from Imposition of
Ignition Interlock Requirement.5 A hearing was held on Appellant's appeal on July 29,
2002.

In Schneider v. Pennsylvania Department of Transportation, 790 A.2d 363 (Pa.
Commw. Ct. 2002), the Commonwealth Court stated:
Although [the appellant] had two DUI offenses and pursuant to
Section 7002(b), the trial court was required to order installation of an
ignition interlock device, that failure does not mean that PennDOT has been
given authority to override the trial court's order and require installation.
Section 7002 provides that only "the court shall order the installation on an
approved ignition interlock device .... "Because this provision gives a court
the sole authority, PennDOT has no unilateral authority to impose ignition
interlock device requirements if the trial court fails to do so.
Id. at 366 (footnotes and citations omitted) (emphasis omitted). Accordingly, the
Commonwealth Court affirmed the trial court's order rescinding the ignition interlock
system provision in the suspension notice issued to the appellant by the Department of
Transportation. Id.
On this issue, Schneider is indistinguishable from the present case and,
accordingly, the same result must obtain herein. Appellant's appeal will be sustained,
without prejudice to Appellee's right to pursue a challenge to this holding, as prescribed
by Schneider, on appeal.
For the foregoing reasons, the following order will be entered:

6 hearing in the case of Myers versus Commonwealth of

8 Licensing at No. 02-2018 Civil Term. This is an appeal from
9 license suspension, and more exactly, it is an appeal
10 requesting the recision of the ignition interlock requirement
11 on a notice of license suspension. We will let the record
12 indicate that the appellant is present in court with her
13 counsel, Paul B. Orr, Esquire; the Commonwealth is represented
14 today by George H. Kabusk, Esquire. Mr. Kabusk.
15 MR. KABUSK: Good morning, Your Honor. What has
16 been marked as Commonwealth Exhibit 1 is a packet of documents
17 under seal and certification, I provided a copy to Mr. Orr.
18 The first one is an official notice of suspension dated and
19 mailed 3/15/01, effective 2/27/01.
20 That notice of suspension to Sharon L. Myers
21 notifies her that her driving privilege was going to be
22 suspended for a period of 1 year as the result of her 1/2/2001
23 conviction of violating Section 3731 of the Vehicle Code
24 relating to driving under the influence on 6/20/2000.
25 Additionally, it informed her of the requirement

to have all vehicles owned by her equipped with an approved
ignition interlock system before her driving privilege could
be restored. Sub-exhibit 2 is a report of the Clerk of Courts
of Cumberland County convicted 1/2/01, seal attached to the
original. I will draw your attention to Sub-exhibit No. 2
under block G, Act 63 Ignition Interlock required, block no is
checked.

case, other than that it is on appeal to the Supreme Court?

the order that Sharon have her license restored. She did, in
fact, do her year, and I think we filed our appeal from her
restoration letter requirement that she received after doing
her one-year suspension. She has already done approximately a
year and 4 months on the initial conviction.
THE COURT: Mr. Kabusk, if I do an order
rescinding the portion of the notice dealing with the
interlock system, will that result in restoration of her
privileges?
MR. KABUSK:

AND NOW comes petitioner, Sharon L. Myers, by and through her attorneys,

requesting this HONORABLE COURT to order respondent to reinstate her privilege to
operate a motor vehicle in the Commonwealth of Pennsylvania and respectfully avers the
following:
1. Respondent (PennDOT) ordered petitioner (Ms. Myers) to install ignition
interlock devices on all vehicles owned by her as a result of Ms. Myers' DUI conviction.
2. On April 25, 2002, Ms. Myers appealed PennDOT's ignition interlock
requirement to this Court.
3. By order dated July 29, 2002, this Court sustained Ms. Myers' April 25th appeal.
4. PennDOT filed a timely appeal of this Court's July 29~ order to the
Commonwealth Court of Pennsylvania and did not reinstate Ms. Myers' driving
privileges.
5. On August 29, 2002, Ms. Myers filed a motion in this Court requesting this Court
to order PennDOT to reinstate her driving privileges pending PennDOT's appeal in the
Commonwealth Court.
6. On September 5, 2002, this Court issued an order upon PennDOT to show cause
why the relief Ms. Myers requested in her August 29th motion should not be granted.
PennDOT was to respond to this order within 20 days of service of the order.
7. As of October 10, 2002, PennDOT has not shown cause as to why Ms. Myers is
not entitled to the relief sought in her August 29th motion.
8. As of October 10, 2002, PennDOT has not reinstated Ms. Myers' driving
privileges.
WHEREFORE, petitioner respectfully requests this HONORABLE COURT to
make the rule of September 5, 2002, absolute and to order respondent to reinstate her
driving privileges immediately pending respondent's appeal before the Commonwealth
Court.
