PURSUANT TO 54 Pa.C.S.A ~701, et seq.
AND NOW, this ,,q,~" day of March 2002, come the Petitioners, KIMBERLEY MARIE SHREINER
and SHARON SHREINER, by and through their undersigned counsel, Johnson, Duffle, Stewart & Weidner,
and request this Honorable Court order a change of name for the minor child of Kimberley Marie Shreiner
pursuant to 54 Pa.C.S.A. §701, et seq., and in support thereof represent as follows:
1. The Petitioners, Kimberley M. Shreiner and Sharon Shreiner, are adult individuals residing at
135 Second Street, West Fairview, Cumberland County, Pennsylvania 17025.
2. Petitioner Kimberley Marie Shreiner is the natural mother of Clarence Edgar Weibley, IV
(d.o.b. January 6, 1997).
3. Petitioner, Sharon Shreiner, and David E. Shreiner, husband and wife, are the natural parents
of Kimberley Marie Shreiner, and the maternal grandparents of Clarence Edgar Weibley, IV.
4. Clarence Edgar Weibley, III, is the natural father of Clarence Edgar Weibley, IV. Clarence
Edgar Weibley, III, is an adult individual who is currently incarcerated in the Huntingdon County Prison,
having served five (5) years of a twenty (20) year prison sentence.
5. The natural father, Clarence Edgar Weibley, III, has not seen the minor child, Clarence Edgar
Weibley, IV, since the child was several weeks old, as shortly thereafter he was convicted and imprisoned
for a period of twenty (20) years.
6. Since the minor child was one (1) month of age, the minor child has resided with Sharon
Shreiner and David E. Shreiner, his maternal grandparents, and Kimberley Marie Shreiner, his natural
mother, at 135 Second Street, West Fairview, Cumberland County, Pennsylvania 17025.
7. Petitioner Kimberley Marie Shreiner was seventeen (17) years of age at the time of the minor
child's birth, and relied on her parents, the minor child's grandparents, to assist her in raising the child while
she finished her education at Susquenita High School. In fact, Petitioner Kimberley Marie Shreiner
graduated in June 1998 from Susquenita High School.
8. Shortly after the minor child was born, the child was referred to by his maternal grandparents
and his natural mother, the Petitioners, as Clayton Michael Shreiner.
9. The minor child knows his name only to be Clayton Michael Shreiner ("Clay") and is unaware
of his birth name, Clarence Edgar Weibley, IV.
10. It would be in the minor child's best interest that the minor child's name be changed from
Clarence Edgar Weibley, IV, to Clayton Michael Shreiner, to strengthen the bonds between the minor child
and his natural mother and maternal grandparents, primary caregivers and Petitioners herein.
11. At five (5) years of age, the minor child is able to understand the significance of a name
change, and would not view the name Clayton Michael Shreiner as a name change, but rather a
reaffirmation of the name that he has recognized since birth.
12. Due to the age of the minor child, the fact that the natural father will be served Notice of the
Petition and hearing, and proof thereof will be filed with the Court, and that all other relatives or adult
individuals who have stood in Ioco parentis to the minor child have all either been set forth as aPetitioner or
will be served accordingly with the Notice and Petition, the Petitioners ask this Honorable Court to consider a
waiver of the publication requirements contained in C.C.R.P. 5.
WHEREFORE, Petitioners respectfully request this Honorable Court enter a Decree changing the
name of the minor child, Clarence Edgar Weibley, IV, to Clayton Michael Shreiner. Furthermore, Petitioners
request that this Honorable Court schedule a hearing as provided by Local Rule and that the Petitioners be
relieved of the responsibility of making publication pursuant to C.C.R.P. 5.
