MECHANICS' LIEN MECHANICS' LIEN CLAIM NOW COMES on this 31" day of July, 2006, John F. Walter Excavating, Inc. ("Claimant"), by and through the undersigned counsel, and files this claim of mechanics' lien against Hersha Group, pursuant to the Mechanics' Lien Law of 1963, as amended, against the improvements and the property at Hampton Court, known as the Residence Inn Project, Middlesex Township, Cumberland County, Pennsylvania for the payment of all debts due Claimant as a contractor for labor and materials furnished in the construction of the improvements. In support of the claim, the Claimant makes the following statements: The Claimant is John F. Walter Excavating, Inc., having its principal office at One Mill Road, Newville, Cumberland County, Pennsylvania. 2. The owners or reputed owners of the property and improvements against whom the claim is fled is Hersha Group, t/d/b/a 44 Carlisle Associates (the "Owner"). 3. Claimant makes this claim as a sub-contractor. Claimant provided certain work, labor, equipment and materials related to the excavating of Owner's property. Invoices, which describe the work performed in detail, are attached hereto as "Exhibit A" and are incorporated herein. 4. Claimant completed the furnishing of the work, labor and materials that are the subject of this claim on or about November 9, 2005. The Claimant has not finished the project as of this date. 5. The total amount claimed to be due and owing is $8,193.91 for work performed. 6. The property subject to the lien is Residence Inn, Middlesex Township, Cumberland, County, Pennsylvania, Parcel I.D. No. 21-07-0467-041, Deed Book 00273, Page 03687, including all equipment that as part of said structure constitutes fixtures, together with the lot or curtilage appurtenant thereto belonging to the same Owner. 7. This lien is claimed from March 31, 2005, the date Claimant commenced performance of the work on the property herein described and against the Owner's interest in that property. WHEREFORE, Claimant files this claim for mechanics' lien in the amount of $8,193.91 plus filing and Sheriff's service costs in the amount of $114.00 with interest as provided by law. Undersigned counsel was just informed by the York County Sheriff on August 25, 2006, that Hersha Group moved location on August 22, 2006.
