THIS AGREEmenT made the (~ of ~ , 2002, by and
between CARLSON CONSTRUCTION, INC., ~.o~=rc~
ANNE M. HAMLIN, hereinafter referred to as Owner, whereby the
former undertook and agreed to erect and construct a single
family dwelling on that certain lot of ground known as:
Lot K-3, Saratoga Place, Floribunda Heights, East Pennsboro
Township, Cumberland County, Pennsylvania
NOW THEREFORE, T~IS AGREEMENT WITNESSET~: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to Carlson Construction, Inc. in hand paid by Owner, the receipt
whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right o~ lien, shall be
an independent covenant. ~

ALL THAT CERTAIN piece or parcel of land situate in East
Pennsboro Township, Cumberland County, Pennsylvania, more
particularly bounded and described as follows, to wit:
BEGINNING at a point on the southern side of Saratoga Place at
the northwestern corner of Lot No. K-2 on the hereinafter
mentioned Plan of Lots; thence along the western line of Lot No.
K-2, South 12 degrees 04 minutes 54 seconds East, a distance of
157.07 feet to a point at the lands now or formerly of Floribunda
Associates; thence along those same said lands, South 73 degrees
50 minutes 00 seconds West, a distance of 104.52 feet to a point
at the southeastern corner of Lot No. K-4 on the hereinafter
mentioned Plan of Lots; thence along the eastern side of Lot No.
K-4, North 10 degrees 17 minutes 25 seconds West, a distance of
167.18 feet to a point on the southern side of Saratoga Place;
thence along the southern side of Saratoga Place, North 79
degrees 42 minutes 35 seconds East, a distance of 66.23 feet to a
point along the said same southern side of Saratoga Place; thence
along the southern side of Saratoga Place by a curve to the right
having a radius of 1,050.00 feet and an arc length of 32.83 feet
to a point, the point and place of BEGINNING.
CONTAINING 16,447.354 square feet.
BEING Lot No. K-3, on the Final Subdivision Plan of Floribunda
Heights, Phase II, Sections K & H, dated October 5, 1999,
prepared by Melham Associates, P.C., and recorded in the Office
of the Recorder of Deeds, Cumberland County, Pennsylvania, in
Plan Book 80, Page 45 and revised on February 17, 2000 and
re-recorded in Plan Book 80, Page 104.
UNDER AND SUBJECT, NEVERTHELESS, to all easements,
restrictions, encumbrances and other matters of record or that
which a physical inspection or survey of the premises would reveal.
BEING PART OF THE SAME PREMISES which unto Floribunda
Associates Limited Partnership, a Pennsylvania limited partnership,
by their deed to be recorded simultaneously herewith, in the office
of the Recorder of Deeds of Cumberland County, granted and conveyed
unto Anne M. Hamlin.
