STIPULATION AGAINST LIENS
WHEREAS, Follmer Excavating, Inc. (hereinafter "contractor") of Cumberland County,
Pennsylvania, is about to execute contemporaneously herewith, a contract with of The Custer Company
of 2805 Old Post Road, Suite 200, Dauphin County, Pennsylvania 17110, for certain cite work upon a
property of The Custer Company on land situate in Silver Spring Township, Cumberland County,
Pennsylvania, as more particularly described on Exhibit "A' attached hereto.
NOW, Z.V A . 2002, at the time of and immediately before execution
of the principal contract, and before any authority has been given by the said Custer Company, to
commence work, erosion control, excavation, sanitary sewer, storm sewer installation, curbing, and
paving on the said site or purchase materials for the same in consideration of the making of the said
contract with The Custer Company. and the further consideration of One Dollar by The Custer Company
paid by Follmer Excavating, Inc., it is agreed that no lien shall be filed against the land by the
Contractor, or any sub-contractor to Contractor, nor by any of the material men or workmen or any other
person for any labor, or materials purchases, or extra labor or materials purchased for the performance of
any improvements on said property the right to file such liens being expressly waived.

ENTIRE AREA OF DEED BOOK 170 PAGE 938
ALL THAT CERTAIN parcel of land located in the Township of Silver Spring, County
of Cumberland, Commonwealth of pennsylvania being shown and designated as Lands
now or formerly of Frederick Schlosser, Jr, on a plan entitled "Existing Conditions Plan
Of The Manors at Carriage Place", by Dawood Engineering, Inc., plan dated January 17,
2002 and last revised February 14, 2002.
Said parcel being more fully described as follows:
BEGINNING at a point in the centerline of Hogestown Road (SR 0114 - variable width
right-of-way) said point being at the intersection of said centerline-with the southern line
of lands now or formerly of Phico Realty Copomtion, as described in Deed Book 110,
Page 1038;
Thence along said lands, South 63 degrees 43 minutes 13 seconds East, a distance of
1407.13 feet to a stone found on the western line of lands now or formerly of W. Thomas,
Jr. & Terry L. Bryan, as described in Deed Book 33-W, Page 86;
Thence along said lands and also along lands now or formerly of Marie C. Todd as
described in Deed Book U-35, Page 005, South 04 degrees 28 minutes 01 seconds East, a
distance of 435.70 feet to a railroad spike to be set at or near the centerline of Woods
Drive (T-585 - 33' right-of-way width);
Thence along said centerline, South 83 degrees 09 minutes 47 seconds West, a distance
of 1094.32 feet to a railroad spike to be set along the eastern line of lands now or
formerly of James H. Funkhouser, as described in Deed Book H-22, Page 775;
Thence along said lands, North 06 degrees 31 minutes 32 seconds West, a distance of
161.00 feet to an existing iron pin at the northeastern corner of said lands;
Thence continuing along said lands and also along lands now or formerly of Theresa
Marie Starner as described m Deed Book T-32, Page 400, South 83 degrees 18 minutes
45 seconds West, a distance of 140.15 feet to an existing iron pin at the northwestern
corner of lands of Starner;
Thence along said lands of Starner, South 06 degrees 43 minutes 18 seconds East, a
distance of 161.00 feet to a railroad spike to be set at or near the centerline of Woods
Drive;
Thence along said centerline, South 83 degrees 27 minutes 04 seconds West, a distance
of 652.00 feet to a point in the centerline intersection of Hogestown Road and Woods
Drive ;
Thence along said Hogestown Road the following two(2) courses and distances:
1. Along a curve to the right, having a radius of 1146.28 feet, a delta angle of 6 degrees
27 minutes 03 seconds, an arc length of 127.39 feet, and a chord bearing and distance of
North 21 degrees 24 minutes 39 seconds East, 127.33 feet to a point;
2. North 24 degrees 35 minutes 41 seconds East, a distance of 1275.45 feet to a point
along the southern line of lands now or formerly of Phico Realty Corporation;
the PLACE OF BEGINNING.
CONTAINING: 30.7046 acres more or less
Subject to all the right-of-way for Hogestown and Woods Drive, and to all covenants and
agreements of record.
BEING the same premises which the estate of Frederick J. Schlosser by Deed dated
March 19, 2002 granted and conveyed unto The Custer Company, said Deed recorded
in the Office of the Recorder of Deeds of Cumberland County in Deed Book 250, Page 4538,
and which property is more fully described in that certain Subdivision and Land Development
Plan formerly known as the Manors at Carriage Place but now known as Sterling Glen, said
Plan dated January 17, 2002 and last revised on February 14, 2002, which Plan was approved
by the Supervisors of Silver Spring on March 13, 2002, and is recorded in the Office of the
Recorder of Deeds of Cumberland County in Plan Book , page

AND NOW, Monday, June 08, 2009 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Dawn S. Sunday, Esq. , the conciliator,
at_ 39 West Main Street, Mechanicsburg, PA 17055 on Tuesday, July 07, 2009 at 9:00 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.
