NICOLE TIERNEY, Defendant COMPLAINT 1. Plaintiff is DIANE WILLIS, an adult individual, currently residing at 151 Newville Road, Shippensburg, Cumberland County, Pennsylvania. 2. Defendant is NICOLE TIERNEY, an adult individual, whose last known address was 31 Kenwood Court, Shippensburg Mobile Estates, Shippensburg, Cumberland County, Pennsylvania. 3. Plaintiff paid $22,185.67 to Madison Settlement Services for a 1994 Commodore Mobile Home, Vehicle Identification Number CS27473A (Exhibit 1). 4. That amount was payment in full for the mobile home and was made on behalf of defendant. 5. Shippensburg Mobile Estates required defendant to hold title to the mobile home in order to live in it in that mobile home park. 6. Plaintiff is listed as First Lien Holder on the Certificate of Title in defendant's name. (Exhibit 2). 7. Plaintiff and defendant entered an agreement governing defendant's use of this mobile home. (Exhibit 3). 8. On or about July 28, 2006, defendant abandoned this mobile home. 9. Prior to abandoning the mobile home, defendant did not pay any money for its cost or expenses. 10. Since abandoning the mobile home, defendant has not paid any tnOl18y for its cost or expenses. 11. Defendant still has title to the mobile home, even though title was only put in her name to satisfy a condition of residence in Shippensburg Mobile Estates. II 12. Plaintiff, as first Iien-holder, cannot transfer title to the mobile home, despite being its true and equitable owner. WHEREFORE, Plaintiff requests this Honorable Court issue an order transferring ownership of the 1994 Commodore mobile home with Vehicle Identification Number CS27473A to the Plaintiff. It is a 1994 Commodore mobile home on lot # 31 at SME, Shippensburg ,P A. Nicole agrees to the following: Pay monthly lot rental Pay all utilities Pay all taxes Pay for insurance on mobile home and contents. Pay for any maintenance or repair that is needed. Pay Diane rent monthly, due on the first of each month. Starting rate to be $400/month. The first payment is due on August I, 2006. The monthly rate will be increased on January 1, 2007 Mow the lawn on a regular basis. Abide by all the guidelines of SME. No one else is to live there, except her children. If others live there the rent will be increased. This agreement will be amended as needed in August, 2006. Interest rates will be added at that time. In the event of the death on Nicole, the title to the mobile home and possession of the mobile home will become the property of Diane Willis.
