SMITH, Defendants ACTION IN ASSUMPSIT COMPLAINT Plaintiff, Members ls` Federal Credit Union (Members 1'), by its attorneys, Gates, Halbruner & Hatch, P.C., files this Complaint demanding payment for outstanding amounts due under an unsecured loan, alleging in support thereof the following: 1. Members 0 is a credit union, organized and existing under the Federal Credit Union Act, with a principal office located at 5000 Louise Drive, Mechanicsburg, Pennsylvania 17055. 2. Defendants, Pamela A. Bear and William S. Smith are adult individuals, both having a last known address of 56 Mountainview Terrace, Newville, Cumberland County, Pennsylvania 17241. 3. On or about January 13, 2005, Defendants obtained an unsecured loan (the "Loan") from Members 1" in the original principal amount of $21,312.32, as evidenced by a Closed-End Note executed by the Defendants, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference. 4. Under the terms and conditions of the Closed-End Note, Defendants agreed to repay the Loan pursuant to the Closed-End Note, together with interest at the annual percentage rate of 13.50% by way of regular monthly payments of principal and interest of $493.61, to commence on March 1, 2005, and continuing on the first of each month thereafter. 5. Defendants are in default of their obligation to make payment of the amounts due to Members 1st under the Closed-End Note for, inter alia, failure to make the monthly payments due Members 1 st under the terms and conditions of the Closed-End Note. 6. Defendants are in default because payments of principal and interest due December 1, 2005, and monthly thereafter are immediately due in full. See the Demand Letter of July 21, 2006, directed to Defendants, a copy of which is attached hereto as Exhibit "B" and incorporated herein by reference. 7. Despite demand for payment, the balance due Members 1st under the Closed-End Note remains unpaid. 8. The amount due to Members I" under the Closed-End Note as a result of Defendants defaults as of July 21, 2006 is $24,233.29 itemized as follows: a. Principal $ 19,319.47 b. Interest as of July 21, 2006 $ 1,049.70 c. Attorneys' Fees and Costs $ 3,863.89 Total Due $ 24,233.29 9. Defendants also agreed under the terms of the Closed-End Note that in the event of default thereunder, Defendants would pay all reasonable costs, fees and expenses incurred by Members 1 st as a result of the institution of these legal proceedings up to 20% of unpaid principal and interest. 10. Despite Plaintiffs demands, Defendants have failed and continue to fail to make payments of all amounts due to Members 1st under the terms and conditions of the Closed-End Note. WHEREFORE, Plaintiff, Members I' Federal Credit Union, demands judgment against Defendants, Pamela A. Bear, and William S.
