Kuykendall to provided materials and perform labor necessary for new construction upon a lot of ground located at 81 Smith Road, South Middleton Township, Cumberland County, Pennsylvania, at County Parcel Number 40-15-0201-012D. See legal description attached hereto as Exhibit" A" NOW WHEREAS, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or material man, nor any other person furnishing labor or materials to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said buildings or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary, Office of Judicial Support or County Clerk within ten days after the date in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided. 2006. Sowers recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 53, page 116: BEGINNING at a spike in Smith Road (T-531) at lands now or formerly of Mae A. Books; thence by lands now or formerly of Mae A. Books, South 15 degrees 54 minutes 10 seconds East 298.13 feet to a steel pin; thence by other lands of Fred W. Sowers et ox, South 71 degrees 53 minutes 50 seconds West 145.19 feet to a steel pin on the dividing line between Lots Nos. 11 and 12 on the above mentioned plan of lots; thence by said dividing line, North 18 degrees 06 minutes 10 seconds West 294.44 feet to a spike in Smith Road (T -531); thence in Smith Road, North 70 degrees 37 minutes 50 seconds East 156.68 feet to a spike, the place of BEGINNING.
