STATEMENT OF MECHANIC'S LIEN CLAIM AND NOW comes 84 Lumber Company, L.P., by counsel, Bernstein Law Firm, P.C., and files this Statement of Mechanic's Lien Claim as a material supplier to a contractor, pursuant to 1he Mechanic's Lien Law of 1963, 49 P.S. Section 1101 et. seq., against 1he premises herein described, any and all buildings erected 1hereupon and 1he curtilage appurtenant 1hereto, for 1he payment of $44,276.47, toge1her wi1h interest from April 11, 2006, due it as a material supplier to 1he contractor Wlder 1he contract herein described. The following is a statement of its claim: 1. 84 Lumber Company, L.P. is a corporation organized and existing Wlder 1he laws of Pennsylvania wi1h a place of business located at 1019 Route 519, Eighty-Four, PA. 2. Owners are Milton and Cynthia Franklin, adult individuals residing at 500 Halyard Road, Enola, P A 17025. 3. Contractor is Aquilla Blank d/b/a BK Builders, whose address and place of business is 12552 Mongul Hill Road, Shippensburg, PA. Ib000577VOOl . . 4. This claim relates to materials provided by Claimant as a material supplier to Contractor upon the premises designated at 500 Halyard Road, Enola, Cumberland County, Pennsylvania, being more fully described in the Deed conveying said premises to Owner, recorded in the Office of the Cumberland County Recorder of Deeds at Deed Book Volume 1932, Page 523/545. 5. Between March 7, 2006 and April 11, 206, Claimant, pursuant to a contract with Contractor, agreed to furnish materials for new construction at the premises above described. True and correct copies of the invoices describing the materials supplied by Claimant to said premises are attached hereto, marked Exhibits "1" through "15" and made a part hereof. 6. Claimant last supplied materials to the above-described premises on or about April 11, 2006. 7. The materials supplied were utilized in the new construction at the above-described premises and were free from defect and were in accordance with Claimant's agreement with Contractor. 8. The total amount claimed by Claimant to be due is $44,276.47, together with interest from April 11, 2006, for materials provided in connection with the agreement to provide construction materials to Contractor upon the premises above described. 9. Formal Notice of Claimant's Intention to File Mechanic's Lien Claim was mailed to Owners on June 7, 2006 and again on June 15, 2006, by certified mail, return receipt requested. Certified mail was returned on both occasions as undeliverable. A true and correct copy of Claimant's Formal Notice of Intention to File Mechanic's Lien Claim, dated June 7, 2006 and June 15, 2006, and the receipt for certified mail and domestic return receipt evidencing service of said Notice upon Contractor, are attached hereto, collectively marked Exhibit "16", and made a part hereof. Service of the Formal Notice upon the Owners was finally effectuated by the Sheriff of Cumberland County posting the Formal Notice upon a conspicuous public part of the property, as evidenced by the Sheriff's Affidavit of Service attached hereto as Exhibit "1 T.
