By way of further answer, the Plaintiff was not required to mail to Defendant a Notice of Homeowners' Emergency Mortgage Assistance Act of 1983, in compliance with the Homeowners' Emergency Mortgage Assistance Act, Act 91 of 1983 prior to the commencement of this action. 2. The allegations of Paragraph 12 of Defendant's New Matter are admitted. Byway of further answer, the Plaintiff was not required to mail to Defendants a Notice of Intention to Foreclose Mortgage in compliance with Act 6 of 1974, 41 P.S. sec. 403. 3. The allegations of Paragraph 13 of Defendant's New Matter are admitted. 4. The allegations of Paragraph 14 of Defendant's New Matter are admitted. 2 5. CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE Chase Manhattan Mortgage Corporation, by its attorneys, Grenen & Birsic, P.C., files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff is Chase Manhattan Mortgage Corporation, which has its principal place of business at 3415 Vision Drive, Columbus, Ohio 43219. 2. The Defendant is Anna R. Fahnestock, an individual whose last known address is 720 Baltimore Pike, Middleton Township, Pennsylvania 17324. 3. On or about October 28, 1998, Defendant executed a Note in favor of First Mutual Corporation, in the original principal amount of $ 61,350.00. A true and correct copy of said Note is marked Exhibit "A", attached hereto and made a part hereof. 4. On or about October 28, 1998, as security for payment of the aforesaid Note, Defendant made, executed and delivered to First Mutual Corporation a Mortgage in the original principal amount of$ 61,350.00 on the premises hereinafter described, said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on November 6, 1998, in Mortgage Book Volume 1495, Page 884. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "B", attached hereto and made a part hereof. 5. First Mutual Corporation assigned all of its right, tire and interest in and to aforesaid Note and Mortgage to Chase Manhattan Mortgage Corporation pursuant to a certain Assignment of Mortgage. 6. Defendant is the record and real owner of the aforesaid mortgaged premises. 7. Defendant is in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due. Defendant is due for the October 1, 2001 payment. 8. Plaintiff was not required to send Defendant written notice pursuant to 35 P.S. 51680.403C (Homeowner's Emergency Mortgage Assistance Act of 1983 - Act 91 of 1983) prior to the commencement of this action for the reasons that the aforesaid Mortgage is insured by the Federal Housing Administration under Title II of the National Housing Act (12U.S.C. 551707-1715z-18) [35 P.S. 51680.401C(a) (3)]. 9. Plaintiff was not required to send Defendant written notice of PlaintilTs intention to foreclose said Mortgage pursuant to 41 P.S. 5403 (Act 6 of 1974) prior to the commencement of this action for the reasons that said Mortgage is not a "residential mortgage" as defined in 41 P.S. 5101 and the Defendant is not a "residential mortgage debtor" as defined in 41 P.S. 5101. 10. Defendant did not receive notice of Plaintiff's intention to foreclose pursuant to 41 P.S. § 403 (Act 6 of 1974) prior to commencement of this action. 13. Defendant had contacted Plaintiff's Homeowner's Assistance Department prior to the filing of this complaint. 14. Defendant provided copies of all documentation required by Plaintiff's Homeowner's Assistance Department in mid-April 2002. 15. Defendant has confirmed with Plaintiff's Homeowner's Assistance Department that all information was received and that no additional information or documentation was required. 16. Plaintiff's Homeowner's Assistance Department has not made a decision regarding Defendant's request, which request is still under consideration. WHEREFORE, for all the reasons set forth above, the Defendant, Anna R. Fahnestock, requests this Honorable Court to dismiss the Defendant's Complaint. Plaintiff commenced the above-captioned action by filing a Complaint in Mortgage Foreclosure on April 30, 2002. 2. In its Complaint, Plaintiff alleges that Defendant, ANNA R. FAHNESTOCK (hereinafter "Defendant"), is in default under the terms of a Mortgage Note dated October 28, 1998, in favor of Plaintiff's assignee in the original principal amount of $61,350.00 (hereinafter "Note") and a Mortgage securing said Note on real property and improvements thereon commonly known as 720 Baltimore Pike, Township of South Middleton, PA 17324 (hereinafter "Premises"). o was filed on behalf of the Defendant. relevant material facts: On or about May 29, 2002, an Answer to the Complaint in Mortgage Foreclosure In her Answer, the Defendant admits the following a. Defendant executed the Note; b. Defendant executed the Mortgage which was recorded in the Office of the Recorder of Deeds of Cumberland County; c. Defendant is the record and real owner of the Premises; d. Plaintiff has made demand for payment upon Defendant; e. The mortgage is in default. 4. Defendant states that she did not receive a Notice of Intention to Foreclose Mortgage in compliance with Act 6 of 1974, 41 P.S. sec. 403. However, as the subject mortgage is not a "residential mortgage" as defined in 41 P.S. sec. 101, Defendant is not "residential mortgagor debtors" as defined in 41 P.S. sec.101. The Act defines a residential mortgage as that with an original principal amount of $50,000.00 or less. The Defendant has admitted the execution of a Mortgage in excess of $50,000.00. 5. The Defendant also states that she did not receive a Notice of Homeowners' Emergency Mortgage Assistance Act of 1983, in compliance with the Homeowners' Emergency Mortgage Assistance Act, Act 91 of 1983 prior to the commencement of this action. However, the Act is clear that no Notice is required where the Mortgage is insured by the Federal Housing Administration under Title II of the National Housing Act. (12 U.S.C. sec. 1707-1715z)[35 P.S. sec. 1680.401C(a)(3)]. Plaintiffs Exhibit"B" to its Complaint evidences thatthe subject mortgage is so insured with FHA case no. 441-5777953. 6. Although the Defendant admits default and the amount due, Plaintiff nevertheless has filed a sworn Affidavit, which is attached hereto as Exhibit "A". In the Affidavit, an authorized representative of Plaintiff certifies that the Defendant is in default under the terms of the Note and Mortgage. The testimony is based on the Loan History Report which is a business record of Plaintiff maintained in the regular course of business. 7. According to the Loan History Report, the amount due and owing by Defendant to Plaintiff is as follows: Principal $ Interest through 4/22/02 $ Late Charges through 4/22/02 $ Escrow Deficiency through 4/22/02 $ Attorneys' Fees $ Title Search, Foreclosure and Execution Costs $ 59,593.53 3,055.32 195.25 770.64 2,300.00 1,500.00 TOTAL $ 67,889.74 For a total of $67,889.74, with interest thereon at the rate of $13.06 per diem from April 22, 2002, plus additional late charges, attorneys' fees and costs. 8. The Defendant states in her New Matter that she is attempting to obtain mortgage assistance from the Plaintiff through it s Homeowner's Assistance Department. However, this is no defense to Plaintiff's foreclosure action and under the terms of the Mortgage Agreement Plaintiff is not preventing from pursing its foreclosure remedies at this time. (See, Para. 11 of Plaintiff's Exhibit "B" to its Complaint). 9. The Defendant has failed to make payments when due under the terms of the Note and Mortgage, failed to cure the default after being placed on notice and lacks any evidence to the contrary. 10. The Defendant has failed to raise a genuine issue of material fact in her Answer and has failed to offer any evidence to support her alleged defenses which are insufficient as a matter of law to defeat summary judgment. WHEREFORE, Plaintiff respectfully requests this Honorable Court grant its Motion for Summary Judgment and enter judgment in its favor and against Defendant, ANNA FAHNESTOCK, in the amount of $67,414.74, with interest thereon at the rate of $13.06 per diem plus additional late charges, attorneys' fees and costs and for foreclosure and sale of the Mortgaged Premises. Mortgagors such as the Defendant must be afforded soma protection, even if that protection only requires a mortgagee to provide notice of its intent to default· 5. Admitted. 6. The Defendant thereafter filed a Request for Production of Documents to which the Plaintiff responded by attaching a detailed Loan History showing each and every transaction on Defendant's loan, as well as the terms of the mortgage contract set forth in the Note and Mortgage. On or about July 24, 2002, Plaintiff filed a Motion for Summary Judgment, Brief in Support of its Motion for Summary Judgment, and Praecipe for Listing Case for Argument. 5. There having been no discovery performed in this matter, on or about August 12, 2002, Defendant sent to Plaintiff a Request for Production of Documents, asking for "All documents in your custody or control or in the custody or control of your attorneys, of whatever nature, signed by Defendant in conjunction with the real estate transaction for which the subject mortgage was executed." In addition, Defendant requested "All records, reports, summaries or other writings in your custody or control or in the custody or control of your attorney or insurer, which relate to the Defendant's mortgage loan account, whether produced prior to or subsequent to execution of the subject mortgage." 6. On or about August 19, 2002, Defendant received Plaintiff's Response to Defendant's Request for Production of Documents, which contained the Note and Mortgage dated October 29, 1998 and a Loan History as of May 21, 2002. All of these documents had been available to Defendant as attachments to prior pleadings. 7. Because it was not possible for Defendant to properly prepare for arguments scheduled for August 28, 2002, Defendant filed a Motion for Continuance on or about August 20, 2002. In the Motion for Continuance, Defendant stated that he had contacted the attorney for the Plaintiff requesting concurrence in the motion and Plaintiff's attorney had not responded as of that date. A copy of this Motion is attached hereto as Exhibit "A." 8. On August 23, 2002, Defendant's Motion for Continuance was granted by Order of the Court signed by George E. Hoffer, President Judge, a copy of which is attached hereto and made a part hereof as Exhibit "B." 9. Due to the Court Order of August 23, 2002, Counsel for the Defendant did not appear at oral arguments on August 28, 2002. 10.
