For dates of death on or after January 1. 1995, the tax rate imposed on the net value of transfers to or for the use of the survivin9 spouse is 0% [72 P.S. 89116 (a) (1.1) (ii)]
The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent,
or a stepparent of the child is 0% [72 P.S. 8 9116(a)( 1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. 89116(1.2) [72 P.S. 89116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblin9S is 12% (72 P.S. 8 9116(a)(1.3)]. A siblin9 is defined, under Section 9102, as an
individual who has at least one parent in common with the decedent, whether by blood or adoption.

Smith. The Trustee shall
be mindful of, and take
into consideration to the
extent it deems
necessary, any additional
sources of income and
principal available to
Mary Jo Smith. At the
time of the decedent's
death on May 8, 2005,
Mary Jo Smith was
approximately 71 years of
age. In the Trustee's
opinion, the income from
the trust, in addition to
her other sources of
income {teacher's
pension, social security
and investment income},

sufficient to cover all
her needs for health,
maintenance and support.

of Craig Smith, her son.

years of age and
severally disabled with

Craig's medical expenses
are currently provided by
governmental assistance.
No part of this trust can
be used to supplant or
replace public assistance
benefits from any state
or federal agency. After
Mary Jo Smith's death,
the income of the trust,
in addition to
governmental assistance,
should be more than
sufficient to provide for
his care, support and
maintenance without any
principal distributions.
In the opinion of
Wilmington Trust Company,
Trustee, no principal
distributions are planned
or contemplated for
either Mary Jo Smith or
her son, Craig Smith.
After the death of Craig
Smith, the principal and
accrued income is to be
distributed outright to
the Christian Missionary
Alliance. See Schedule J
for calculation of
charitable distribution.
Schedule K was calculated
on the life of Craig
Smith since he is the
younger of the two
beneficiaries and both
are taxable at the lineal
rate of 4.50%. The
