Collins, is an adult individual residing at 9236 Old National Pike, Hagerstown, Washington County, Maryland. 2. The Defendant, Daniel Klein, is an adult individual residing at 31 Glenfair Road, Glen Rock, New Jersey 07452. 3. On June 3, 2006, plantiff was selling auto parts and cars at Ford Carlisle Fairgrounds in Carlisle, Pennsylvania spaces KI8,K19, & K20. 4. On June 3 , 2006 the defendant was selling car memorabilia and tin signs at Ford Carlisle Fairgrounds in Carlisle, Pennsylvania space # K17. 5. June 3, 2006 was a blustery, cloudy, overcast day morning due to the cold front passing through the previous evening with heavy wind gusts. 6. The defendant failed to secure his items, the wind picked up a metal tin sign and Threw it into the passenger side door of a 1996 Lincoln Mark V 111 parked in space # K18 causing a six inch scratch all the way to the metal of the car. 7. Security at the fairgrounds was called and a report was filled out at which time The defendant agreed to pay for damages. 8. Defendant notified of estimate to repair car, changed his mind only wanted to Pay plantiffs deductable, which would have raised plantiffs premiums. 9. Defendant offered to pay 150.00 for detailing damaged car. Again changed his mind. 10. Defendant then wanted judge to decide. Defendant found negligent by Judge Paula P. Correal, judgement entered against defendant in the amount of 965.72. Defendant then filed an appeal. 11. As a result of the above facts the plantiff has incurred aggravation, inconvenience obtaining damage estimates, phone expense, travel expense, time, and faith in a gentlemans word. 12. The defendant was negligent in the following respects: 1. Failure to secure his items for sale . 2. Failing to pay for damage he originally agreed to due to his negligence. I have expectations that the original ruling by the Hon. On September 29,2006, 1 personally filed an appeal at the Prothonotary's office and in speaking with Irene I was under the impression no further action was required on my part before the actual arbitration. Therefore, 1 respectfully request that the process of the petition for the appointment of arbitrators be reopened Thank you for your consideratio , Daniel Klein cc: Cumberland County Prothonoary's Office Attn : Irene Kevin Collins RESPONSE TO COMPLAINT 1) Agreement 2) Agreement 3) Agreement 4) Agreement 5) June 3,2006 was a blustery cloudy overcast morning due to a cold front passing through the previous evening, however, by mid-moming, it had cleared and the wind subsided and then I put my merchandise out for sale. 6) My literature and tin signs which I was selling were secured on my tables, however, around 1:pm a gust of wind caused a sign to blow off the table and strike a 1996 Mark VIII parked in space #K-18 creating a six inch surface scratch to the passenger door directly under the outside mirror. 7) The defendant called security and a report was filled out. I gave them my insurance information and told the plaintiff I would contact my carrier and report it. 8) Plaintiff obtained an estimate to refinish the entire right side of his vehicle, including prior damage, which does not require refinishing due to the distance of space from the damaged area. I was advised by my insurance carrier that my policy would not respond to this loss as it would be considered an "act of god" and that the plaintiff should file a claim under the comprehensive portion of his policy for which I offered to pay the deductible. The offer was refused. 9) Defendant then offered $150.00 for detailing the damaged vehicle since the scratch could be buffed out. The offer was refused by plaintiff. 10) Plaintiff then filed suit and on July 24,2006 Judge Paula P. Correal found in favor of the plaintiff. Defendant then filed an appeal. 11) As a result of the above facts, the defendant has been held liable for something beyond my control. I paid Carlisle Productions for a swap meet space to sell my goods. The plaintiff had three spaces, all of which were used to sell vehicles. 12) The plaintiffs estimate does not reflect what the actual cost of repair would be since industry standards do not allow for painting and refinishing the entire side of the vehicle. According to industry standards, since the scratch was under the mirror, the shop should refinish the right front fender and blend into the door. This is a 10 year old vehicle and while in excellent condition as noted by the estimate, it still had normal wear and tear. Plaintiff also pointed out a scratch on the rear quarter panel and after discussion agreed it was not a result of what happened.
