STIPULATION AGAINST LIElIIS
THIS AGREEMENT made this ~ day of July, 2006, by and
between Neidlinger Pine Homes, a sole proprietorship, hereinafter
referred to as Contractor,
AND
Larry V. Neidlinger and Mary Jo Neidlinger, hereinafter referred to
as Owners, whereby the contractor undertook and agreed to erected
and construct a dwelling on the certain lot of ground situate in
West pennsboro Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot 43, Kerrsville
Road, Carlisle, PA 17015.
NOW THEREPORE, THIS AG~E1P.M1I!NT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($l.OO) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself. himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

contained.

ALL that certain tract or parcel of ground situate in West Pennsboro Township,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at an iron pin in the centerline of Kerrsville Road (Township Road 326)
at corners common with Lot No. 44 of the hereinafter referenced subdivision plan;
thence along said centerline South 06 degrees 34 minutes 22 seconds West a
distance of 230.00 feet to an iron pin set at corners common with lands now or
formerly of John E. Schad Ie; thence along said Schad'e lands North 82 degrees
52 minutes 03 seconds West a distance of 25.00 feet to a concrete monument;
thence along same North 82 degrees 52 minutes 03 seconds West a distance of
195,00 feet to an iron pin; thence along same and lands now or formerly of Keith
D. and Kandy L Coyle South 07 degrees 07 minutes 57 seconds West a distance
of 310.00 feet to an iron pin set at corners common with Lot No. 17 A of the
hereinafter referenced subdivision plan; thence along sold Lot No. 17 A South 55
degrees 40 minutes 14 seconds West a distance of 598.21 feet to an iron pin at
boundary lines with Lot No. 46 of the hereinafter referenced subdivision plan;
thence along said Lot No. 46 North 34 degrees 19 minutes 46 seconds West a
distance of 361.67 feet to an iron pin set at the boundary lines with Lot No. 42 of
the hereinafter referenced subdivision plan; thence along said Lot No. 42 North 55
degrees 40 minutes 14 seconds East a distance of 399.30 feet to an iron pin set at
corners common with Lot No. 44 of the hereinafter referenced subdivision pian;
thence along said Lot No. 44 North 55 degrees 40 minutes 14 seconds East a
distance of 144.05 feet to an iron pin; thence along same North 61 degrees 58
minutes 45 seconds East a distance of 529.09 feet to an iron pin; thence aiong
same South 83 degrees 25 minutes 38 seconds East a distance of 40.75 feet to an
iron pin: thence along same South 83 degrees 25 minutes 38 seconds East a
distance of 25.00 feet to arrlron pin, being the place of BEGiNNING. '
BEING all of lot No. 43 of the Finai Subdivision Plan of Robert J. and Shirley A.
Yinger, and Barry L and Marjorie L Yinger and Glenn L. and Darlene K. Wareheim,
as prepared by John K. Bixler ill, P.L.S" dated August 15, 2002 and recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in
Pian Book 86, Page 138.
