The Defendant is Mountaineer Realty of Mechanicsburg ("Mountaineer"), with a principal place of business at 321 Southview Drive, Mechanicsburg, Cumberand County, Pennsylvania. In accordance with an oral agreement, Kinney provided property management services for Mountaineer for two properties owned by Mountaineer at 16- 20 West Main Street and 48-50 West Main Street, Mechanicsburg, Pennsylvania. These services included, but were not limited to, the collection of the rent, submission of the rent to Mountaineer, and miscellaneous services such as placing ads to fill vacant apartments, filling the vacancies, making any and all necessary repairs, painting, cleaning of the apartments, and generally preparing the apartments for new tenants. Kinney was also responsible to make sure that the parking lot and sidewalks were c{ear of snow, ice and debris, and monitoring both lots in order to provide private parking for all tenants. In addition, Kinney was the primary contact with all tenants on a 24 hour, seven day a week basis. This included an immediate response for emergencies and availability for any and all maintenance issues as well as other tenant related problems. 4. Kinney invoiced Mountaineer for these services in the amount of $2,728.90 which invoices remain unpaid. Said invoices are attached hereto and incorporated herein as Exhibit "A". 5. Kinney performed certain construction work for Mountaineer at 48-50 West Main Street, Mechanicsburg, Pennsylvania in the total amount of $6,994.57. As a result of Mountaineer's failure to pay this amount, Kinney was forced to file a Mechanics' Lien Claim against Mountaineer in the Court of Common Pleas, Cumberland County, No. 06-608. A copy of the Mechanics' Lien Claim is attached hereto and incorporated herein as Exhibit "B". 6. Mountaineer eventually paid the principal amount claimed in the Mechanics' Lien of $6,994.57, but refused to pay interest, penalties and attorneys' fees as required by the Contractor and Subcontractor Payment Act, 73 P.S. §501 et sec . ("Payment Act"). A copy of the Payment Act is attached hereto and incorporated herein as Exhibit "C". 2 7. Mountaineer did pay interest at the legal rate of six percent (6%) in an amount of $182.82, and paid the filing fees and sheriffs costs of $52.07. Attached hereto and marked as Exhibit "D" is a letter dated May 11, 2006 and copy of the check satisfying the Mechanics' Lien Claim. 8. Mountaineer refused to pay the interest and attorneys' fees required by the Payment Act at the time it satisfied the Mechanics' Lien Claim. 9. In accordance with §505(c) and (d) of the Payment Act, all invoices must be paid within twenty (20) days after delivery of the invoice, and interest at one percent (1 %) per month begins to run on the eighth day following the due date for payment. Accordingly, interest would have run from at least December 1, 2005 through payment of the outstanding invoices on May 11, 2006. This is 162 days, and corresponds to interest of $372.53. Since Mountaineer paid interest of $182.82, there is a balance owed for interest under the Payment Act of $189.71. 10. Section 512(a) of the Payment Act provides for a penalty of one percent (1 %) per month for amounts wrongfully withheld. Mountaineer wrongfully withheld payment from Kinney from November 20, 2005 through May 11, 2006. This amounts to 172 days. The Act provides for a penalty of one percent (1 %) per month on the amount wrongfully withheld. This totals $395.53. 11. Section 512(b) of the Payment Act provides that: the substantially prevailing party in any proceeding to recover any payment under this act shall be awarded reasonable attorneys' fees in an amount to be determined by the court or arbitrator, together with expenses. (emphasis added) 3 12. Kinney substantially prevailed in its claim against Mountaineer in that it recovered the full principal amount for the work performed ($6,994.57). However, as a result of Mountaineer's initial opposition to paying this amount which required Kinney to engage an attorney and ultimately file a Mechanics' Lien Claim, Kinney incurred $4,004.74 in attorneys' fees and expenses. Attached hereto and incorporated herein as Exhibit "E"are the attorneys' fees and expenses incurred in the collection of the principal amount owed by Mountaineer to Kinney. COUNTI BREACH OF CONTRACT FAILURE TO PAY PROPERTY MANAGEMENT SERVICES 13. Plaintiffs incorporate herein by reference paragraphs 1 -12 above as if set forth herein at length. 14. Mountaineer owes Kinney $2,728.90 for the property management services Kinney provided to Mountaineer for which it has not received payment. 15. Mountaineer is in breach of the parties' agreement by failing to pay for the property management services. 16. Kinney has been damaged in the amount of $2,728.90 as a result of Mountaineer's breach of contract WHEREFORE, Plaintiffs demand judgment in their favor and against Mountaineer in the amount of $2,728.90, together with interest and costs of suit. 4 COUNT II UNJUST ENRICHMENT/QUANTUM MERUIT PROPERTY MANAGEMENT SERVICES 17. In the alternative to Count I above, Plaintiffs contends that Mountaineer has been unjustly enriched by the property management services provided to Mountaineer by Plaintiffs. 19. WHEREFORE, Plaintiffs demand judgment in their favor and against Mountaineer in the amount of $2,728.90, together with interest and costs of suit. 5 COUNT III INTEREST, PENALTY AND ATTORNEYS' FEES UNDER PAYMENT ACT 22.
