KNOW ALL MEN BY THESE PRESENTS, that:
WHEREAS, Shirley L. Freedman, late of Lower Allen Township, Camp Hill, Cumbe~nd

County, Pennsylvania, died testate on May 13, 2005:
WHEREAS, Letters Testamentary for the Estate of the Decedent were duly issued by
Glenda Farner Strasbaugh, the Register of Wills of Cumberland County to the Executrix, Charlotte
A. Vacondios on June 28, 2005;
WHEREAS, Item IV of the Decedent's Last Will and Testament dated December 19, 1997,
bequeathed a life estate in the real estate located at 212 South Locust Street, Camp Hill,
Pennsylvania to the Decedent's friend, Charlotte A. Vacondios, conditioned upon Charlotte A.
Vacondios making all mortgage payments and paying for real estate taxes, maintenance and
insurance;
WHEREAS, Item V of the Decedent's Last Will and Testament directed that if Charlotte A.
Vacondios would move from the real estate or die, the real estate was to be sold and the proceeds
divided in equal shares among the following surviving residuary beneficiaries: (1) Clarence L.
Nicholson - brother-in-law; (2) Charlotte A. Vacondios - friend; (3) Steven A. Nicholson - nephew;
(4) Valerie M. Nicholson - niece; and (5) Diane N. Baker - niece;
WHEREAS, in order for the other four beneficiaries to presently realize their financial
interest in the real estate, as opposed to waiting an indefinite time for Charlotte A. Vacondios' life
estate to end, the aforementioned five beneficiaries entered into a Family Settlement Agreement
Regarding the Decedent's Real Estate whereby title to the real estate was transferred to Charlotte
A. Vacondios to allow Charlotte A. Vacondios to refinance and payoff the two outstanding
Mortgages owed by the Decedent to PNC Mortgage Account No. 040-01008109172092 and
HSBC Mortgage Account No. 9140361 and to permit Charlotte A. Vacondios to pay each of the
other four beneficiaries $10,000.00 as their share to be realized from the real estate. Attached
hereto and marked Exhibit "A" is a date-stamped copy of the Family Settlement Agreement
Regarding the Decedent's Real Estate filed with the Clerk of the Orphans' Court on December 28,
2005;
WHEREAS, Charlotte A. Vacondios distributed to each of the aforementioned four
beneficiaries $10,000.00 per person in accordance with the terms of the Family Settlement
Agreement Regarding the Decedent's Real Estate and each of the four beneficiaries
acknowledged their receipt of the distributions as settlement for receiving their interest in the
subject real estate presently, rather than waiting for Charlotte A. Vacondios' life estate to end.
Attached hereto and marked Exhibit "B" are true and correct copies of the Acknowledgments of
Distribution executed by each of the four beneficiaries;
WHEREAS, the Executrix has gathered the remaining assets of the Estate of the Decedent
and the assets consist of personal property with a total liquidation value of $21,589.11, as set forth
in the Statement of Account which is attached hereto and marked Exhibit "C";
WHEREAS, the Executrix has paid the debts of the Estate in the amount of $30,405.12, as
set forth in the Statement of Account;
WHEREAS, there is a negative balance when comparing the Estate's personal property
assets to the Estate's debts, which balance of monies owed was paid by Charlotte A. Vacondios
and thus there are no other monies available for distribution to the residuary beneficiaries;
NOW, THEREFORE, we, Charlotte A. Vacondios, Clarence L. Nicholson, Steven A.
Nicholson, Valerie M. Nicholson and Diane M. Baker do hereby stipulate that in order to avoid
the expense and time involved in the filing of a formal account, we agree that no formal account
is necessary and that the terms of this Family Settlement Agreement and Final Release shall
have the same force and effect as if the document had been filed and confirmed by the
Orphans' Court Division of the Court of Cumberland County.
THEREFORE, we do hereby release and forever discharge Charlotte A. Vacondios, the
Executrix and Jill M. Wineka, Esquire and the law firm of Purcell, Krug & Haller, the Attorneys
for the Estate, their assigns, executors and administrators, from all actions, suits, payments,
accounts, and claims whatsoever, touching upon the Estate of the Decedent.
The parties acknowledge that this Family Settlement Agreement and Final Release will
be signed and notarized separately by each residuary beneficiary. The original signatures will
be attached to the original Family Settlement Agreement and Final Release and filed of record
with the Cumberland County Orphans' Court.

FAMILY SETTLEMENT AGREEMENT REGARDING THE DECEDENT'S
REAL ESTATE OF THE ESTATE OF SHIRLEY L. FREEDMAN. DECEASED
KNOW ALL MEN BY THESE PRESENTS, that:
WHEREAS, Shirley L. Freedman, late of, Lower Allen Township, Cumberland County,
Pennsylvania, died testate on May 13, 2005;
WHEREAS, Letters Testamentary on the Estate of the Decedent were issued by Glenda Farner
Strasbaugh, the Register of Wills of Cumberland County to the Executrix, Charlotte A. Vacondios on June
28, 2005;
WHEREAS, at the time of her death, the Decedent was the sole owner of real estate ("real
estate") located at 212 South Locust Street, Camp Hill, Cumberland County, Pennsylvania 17011;
WHEREAS, in the Decedent's Last Will and Testament dated December 19,1997, the Decedent
bequeathed a life estate, in her real estate, to her friend, Charlotte A. Vacondios, conditioned upon
Charlotte A. Vacondios making all mortgage payments and paying for all real estate taxes, maintenance
and insurance on the real estate;
WHEREAS, in the Decedent's Last Will and Testament, if Charlotte A. Vacondios would move
from the real estate or die, the real estate was to be sold and the proceeds divided in equal shares
among the following surviving beneficiaries:

EXHIBIT "A"
WHEREAS, all of the aforementioned beneficiaries have agreed that Charlotte A. Vacondios
should receive title to the real estate in exchange for paying $10,000.00 to each of the other four
beneficiaries;
WHEREAS, in order for Charlotte A. Vacondios to obtain the funds necessary to pay the
$10,000.00 to each of the four beneficiaries, she will have to obtain a Mortgage on the real estate;
WHEREAS, the representative for the potential lender, Cody Financial, indicated that title should
be deeded from the Estate's name into Charlotte A. Vacondios' name, so that the loan can be deemed a
refinance loan;
THEREFORE, owing to the requirements of Cody Financial, the other four beneficiaries agree
that title can be transferred from the name of the Estate of Shirley L. Freedman to Charlotte A. Vacondios
and in order to facilitate the refinancing loan and for Charlotte A. Vacondios to obtain the monies
necessary to buyout the beneficiaries. Such agreement is conditioned that in the event Charlotte A.
Vacondios is not granted a loan through Cody Financial, title to the real estate will be transferred back
into the name of the Estate and any costs related to preparation or recording of the second Deed will be
paid solely by Charlotte A. Vacondios.
The parties acknowledge that this Family Settlement Agreement will be signed and notarized
separately by each of the five beneficiaries. The original signatures will be attached to the original Family
Settlement Agreement.

THOUSAND ($10,000.00) DOLLARS as a distribution of the sums of money owed to him in payment of his
one-fifth interest in the real estate located at 212 South Locust Street, Camp Hill, Pennsylvania 17011 and
as payment in accordance with the beneficiaries' Family Settlement Agreement Regarding the Decedent's
Real Estate filed on December 28, 2005 with the Register of Wills of Cumberland County. The

no way waives any objections Clarence L. Nicholson may wish to later assert against the administration of the

THOUSAND ($10,000.00) DOLLARS as a distribution of the sums of money owed to her in payment of her
one-fifth interest in the real estate located at 212 South Locust Street, Camp Hill, Pennsylvania 17011 and
as payment in accordance with the beneficiaries' Family Settlement Agreement Regarding the Decedent's
Real Estate filed on December 28, 2005 with the Register of Wills of Cumberland County. The
acknowledgment of the distribution of Ten Thousand ($10,000.00) Dollars is made without prejudice and in
no way waives any objections Diane M. Baker may wish to later assert against the administration of the Estate
of Shirley L. Freedman.
