STXPULATXON AGAXNST LXENS
THXS AGREEMENT made this 10th day of August, 2006, by and
between Neidlinger rine Homes, a sole proprietorship, hereinafter
referred to as Contractor,
AND
Larry G. Ad."''', hereinafter referred to as Owner, whereby the
contractor undertook and agreed to erected and construct a dwelling
on the certain lot of ground situate in North Newton Township,
Cumberland County, Commonwealth of Pennsylvania, and more fully
described in Exhibit "A" which is attached hereto and made a part
hereof known as Lot 49, North Newton Hills, Newville, PA 17241.
NOW THEREFORE, THXS AGREEMENT W:tTNESSBTHI That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or parcel of land situate in the Township of North Newton,
County of Cumberland and Commonwealth of Pennsylvania more particularly described as
follows, to wit:
BEGINNING at a point on the dividing line between Lot No. 50 and Lot No. 49, also being
on the northern right of way line of Camelot Lane (50 feet wide); thence along the northern
right of way line of Camelot Lane South 50 degrees 11 minutes 54 seconds West for a
distance of 75.00 feet to a point at the intersection of Camelot Lane and Sir William Drive
(50 feet wide); thence along Sir William Drive on a curve to the right having a radius of
25.00 feet, an arc length of 39.27 feet and a chord bearing of North 84 degrees 48 minutes 06
seconds West for a distance of 35.36 feet to a point; thence continuing along Sir William
Drive North 39 degrees 48 minutes 06 seconds West for a distance of 121.12 feet to a point;
thence continuing along Sir William Drive on a curve to the left having a radius of 200.00
feet, an arc length of 50.61 feet and a chord bearing of North 47 degrees 03 minutes 04
seconds West for a distance of 50.47 feet to a point on the dividing line of Lot No. 48 and
Lot No. 49; thence along the dividing line between Lot No. 48 and Lot No. 49 North 35
degrees 41 minutes 59 seconds East for a distance of 27.21 feet to a point along lands now or
formerly of Greg R. and Mary H. Shade; thence along lands now or formerly of Greg R.
and Mary H. Shade North 66 degrees 15 minutes 33 seconds East for a distance of 83.27 feet
to a point on the dividing line between Lot No. 50 and Lot No. 49; thence along the dividing
line between Lot No. 50 and Lot No. 49 South 39 degrees 48 minutes 06 seconds East for a
distance of 179.97 feet to a point on the northern right of way line of Camelot Lane, the
point and place of BEGINNING.
BEING Lot No. 49 on the Final Subdivision Plan for North Newton Hills, Phase lll, dated
March 2, 2005 and recorded April 12, 2006 in the Cumberland County Office for the
Recorder of Deeds in Plan Book 92, Page 49.
