STIPULATION AGAINST
WHEREAS, John & Jean Kelly, of 243 S. West Street, Carlisle, Pennsylvania,
are about to execute contemporaneously herewith, a contract with Pollard & Co.,
Inc., Contractor, of P.O. Box 66, Dillsburg, PA 17019, for the erection of a two story
residential building upon a lot of land situate in Dickinson Township, Cumberland
County, more fully described in attached Exhibit "A."
NOW, THEREFORE, this / .1'-?' day of May, 2002, before any authority had
been given by Owners to Contractor to commence work on said facilities or purchase
materials for same, in consideration of making of the above-described Contract with
Owners, and in further consideration of One ($1.00) Dollar paid to Contractor by
Owners, the receipt whereof is hereby acknowledged, it is agreed that no liens or
claims shall be filed or maintained against the Owners' property and the land
above-described by the Contractor or any of its subcontractors, or by any of the
materialmen or workmen, or any other person acting through or under them, for or
on account of any labor or materials purchased, or extra labor or materials purchased
for, towards, in or abut the erection, construction, design and improvement of said
facilities, under said contract or otherwise, the right to have, file and maintain such
liens or claims against the facilities and the land above-described, being hereby
expressly waived by the Contractor for itself, its subcontractors, all materialmen, or
workmen and other acting through or under them.
IN WITNESS WHEREOF, ye~ach of the parties have hereunto executed the
Stipulation Against Liens this ! ~ day of May, 2002.

EXHIBIT "A"
ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a Plan prepared by Rodney L.
Decker, R.P.L.S., dated September 17, 1991 and recorded in the Office of the Recorder
of Deeds for Cumberland County in Plan Book 65, Page 111.
BEGINNING at a point in eastern dedicated right-of-way line of T-465 Richland Read
at corner of Lot No. 6 on Plan of Richland Meadows; thence along Lot No. 6, North 50
degrees 15 minutes 35 seconds East 280.00 feet to a point; thence along continuing along
same, North 42 degrees 09 minutes 00 seconds East 705.79 feet to a point; thence along
lands now or formerly of John R. McKeehan, South 45 degrees 12 minutes 20 seconds
East 300.00 feet to a point; thence along Lot Nos. 15, 14, 13, 12, and 11 of Richland
Meadows, South 42 degrees 59 minutes 30 seconds West 634.72 feet to a point, thence
along Lot No. 8 on said plan, North 48 degrees 17 minutes 10 seconds West 130.83 feet
to a point; thence still along Lot No. 8 South 50 degrees 15 minutes 35 seconds West
332.16 feet to a point in eastern dedicated right-of-way line of T-465, Richland Road;
thence along said right of way line, North 48 degrees 17 minutes 10 seconds West 106.33
feet to a point; thence still along said right-of-way line of Richland Road, North 52
degrees 40 minutes 00 seconds West 46.02 feet to a point the Place of BEGINNING.
CONTAINING 5.504 acres and designated as Lot No. 7 on the Plan of Richland
Meadows.
BEING part of the same property which KIMBA, INC., a Pennsylvania corporation, by
its deed dated October 21, 1997 and recorded October 22, 1997 in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania in Deed Book 166, Page
531, granted and conveyed unto John P. Kelly and Jean M. Kelly, husband and wife.
SUBJECT to the following restrictions which shall apply to the entire Richland Meadows
as follows:
1. No Mobile Homes permitted.
2. No commercial farming permitted.
3. No unlicensed vehicles or junk yards.
4. A minimum of 1,200 square feet of living space for a ranch house and 1,800
square feet of living space for a two story house with a two care garage either
detached or attached to the principal residence.
5. No lot can be resubdivided.
