OF MORTGAGE PURSUANT TO Pa. R.C.P. l06Hb)(3)
AND NOW, come Plaintiffs, Michael J. Mayer, Jr. and Dawn M. Mayer, by and
through their undersigned attorney, Scott W. Morrison, Esquire, and avers in support of their
Complaint against Defendants as follows:
1. Plaintiffs, Michael J. Mayer, Jr. and Dawn M. Mayer, husband and wife, are adult
individuals residing at 110 A Street, Plainfield, West Pennsboro Township,
Cumberland County, Pennsylvania.
2. The Defendants are State Street Corporation, formerly known as State Street Bank
and Trust (hereinafter called "State Street"), of State Street Financial Center, One
Lincoln Street, Floor 21, Boston, MA 02111 and U.S. Bank, N.A., of One Federal
Street, 3rd Floor, Boston, MA 02110.
3. The Plaintiffs are the lawful owners and in possession of the following premises,
located at 110 A Street, Plainfield, Cumberland County, Pennsylvania:
ALL THAT CERTAIN tract of land with the improvements thereon erected,
situate in West Pennsboro Township, Cumberland County, Pennsylvania,
bounded and described in accordance with a survey for Gary L. Fatherree and
Kathy Fatherree, his wife, by Eugene Albert Hockensmith, dated May 17,
1979, more particularly described as follows:
BEGINNING at a PK nail set in the center line of a 41 foot wide public street
(not street name); thence by land now or formerly of Paul B. Downs and
through an iron pin, South 06 degrees 35 minutes 00 seconds West, 128 feet to
an iron pin; thence by land now or formerly of Donald D. German, North 83
degrees 25 minutes 00 seconds West, 83 feet to an iron pin; thence by land
now or formerly of Marlin E. Haines and through an iron pin, North 06
degrees 35 minutes 00 seconds East, 128 feet to a PK nail set in the center line
of said unnamed public street, thence by said unnamed public street, South 83
degrees 25 minutes 00 seconds East, 83 feet to the place of BEGINNING.
CONTAINING 0.2439 acre.
BEING improved with a brick and aluminum siding ranch type dwelling
house known and numbered as 110 A Street, Plainfield, Pennsylvania.
UNDER AND SUBJECT to restrictions of record.
BEING the same property conveyed to Michael J. Mayer, Jr. and Dawn M.
Mayer, his wife, dated October 28, 2003 and recorded in Cumberland County
Deed Book 260, Page 2534.
4. Randy E. Crawford, a predecessor in title to Plaintiffs, mortgaged the subject
premises in the amount of $70,050.00 with First United Mortgage Services by
mortgage dated December 14, 1994 and recorded December 21, 1994 in Cumberland
County Mortgage Book 1245 Page 1170. (See Exhibit "A" attached hereto and
incorporated herein by reference.)
5. The mortgage was immediately assigned to Signet Mortgage Corporation by
assignment recorded December 21, 1994, in Cumberland County Miscellaneous Book
48B Page 344.
6. The mortgage subsequently was assigned to State Street by assignment recorded
March 15, 1996 and recorded in Cumberland County Miscellaneous Book 515 Page
838. State Street remains and is currently the last assignee of record. (See copy of
title abstract attached hereto and incorporated herein by reference and marked as
Exhibit "B".)
7. It is believed and therefore averred that U.S. Bank, N.A. purchased said mortgage
from State Street, although no assignment was recorded in the public records of
Cumberland County, Pennsylvania.
8. By deed dated July 21, 2000, and recorded August 9, 2000, in Cumberland County
Deed Book 226 Page 1030, Randy E. Crawford sold the above-described property.
9. It is believed and therefore averred that the balance due and secured by the said
mortgage was paid in full to Defendant(s) on or about August, 2000.
10. Defendant(s) have since refused to satisfy said mortgage of record and continue to do
so after having been requested by the Plaintiffs on many occasions, beginning in
June, 2006.
11. The failure of Defendant(s) to satisfy said mortgage creates a cloud upon the title of
the Plaintiffs in said premises.
WHEREFORE, Plaintiffs demand judgment against Defendant(s) as follows:
1. Declaring said mortgage null and void;
2. Order and direct entry of satisfaction of said mortgage on the record pursuant to
Pa. R.C.P. 1066(b);
3. Quieting title to said property in favor of Plaintiff and against Defendant(s) and
all persons claiming under them;
4. For such other and further relief as the Court may deem just and proper.
