SHIELDS WILLIAM N. COY, PATSY 1. COY, THEIR HEIRS, EXECUTORS AND ASSIGNS DEFENDANTS : ACTION TO QUIET TIlLE COMPLAINT 1. Plaintiffs, Thomas D. Kligge and Janet F. KIigge, husband and wife, are adult individuals residing at 8533 Newburg Road, Newburg, Cumberland County, Pennsylvania. 2. The Plaintiffs aver that they have no knowledge or information concerning the present whereabouts or continued existence of Defendants Dorothy A. Coy, Charles R. Coy, Jackie 1. Coy, Shirley A. Shields, William N. Coy, Patsy 1. Coy and their heirs and assigns. 3. Plaintiffs are the owners of two tracts ofland situate in the Borough of Ship pens burg, Cumberland County, Pennsylvania by virtue of a Deed dated May 12,2006, recorded in Cumberland County Record Book 274 Page 2512, a copy of which is attached hereto, incorporated by reference and marked Exhibit "A". 4. Tract 2 of the aforesaid deed is described as follows: All that certain lot of ground with buildings erected thereon, situated on the South side of Fort Street in the Borough of Shipp ens burg, Cumberland County, Pennsylvania, and bounded and described as follows, to wit: ON the North by Fort Street; on the East by lot now or forermly of John Hosfeld; on the South by a fourteen (14) foot public alley; and on the West by a twelve (12) foot public alley. CONTAINING thirty (30) feet in front on Fort Street and Extending one hundred seventy (170) feet, more or less, to said alley in the rear. 5. The Plaintiffs have caused to be completed an extensive search and examination of the records in and for Cumberland County, Pennsylvania. 6. Plaintiffs believe and therefore aver that the aforesaid premises is the same which was set forth in the conveyance from J.B. Hockersmith, Trustee under the Last Will and Testament of John E. Coffy to Charles L. Coy dated August 5,1953, recorded in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book 15 Volume "K" Page 44, a copy of which is attached hereto, incorporated by reference and marked Exhibit "B". 7. The Defendants herein named are the heirs at law of Charles L. Coy who died intestate on July 30,1958. 8. Defendant Dorothy A. Coy, et al. conveyed the adjoining premises on Fort Street to Norman C. Koontz, Jr. And Dorothy M. Koontz by deed dated October 28, 1965, recorded in Cumberland County Deed Book 21 Volume "U" Page 149, a copy of which is attached hereto, incorporated by reference and marked Exhibit "C". 9. Plaintiffs believe and therefore aver that at the time of the aforesaid conveyance, the description for the tract described in Paragraph 4 herein was inadvertently omitted. 10. Plaintiffs aver that Charles L. Coy and Defendants did not convey their interest in the aforesaid premises by recorded deed, up until the date of the filing of this Complaint, thereby raising a title objection in the form of an outstanding interest in real estate. 11. Plaintiffs aver that they and their predecessors in title have paid taxes on tax parcel 32-33-1867-022 which is partly comprised of the property in question since the Koontz purchase in 1965. A copy of the tax map is attached hereto, incorporated by reference and marked Exhibit "D", 12. Plaintiffs aver that they and their predecessors in title have been in open, notorious, continuous and adverse possession of the premises set forth in Paragraph 4 herein for a period of time in excess of twenty-one (21) years which would be sufficient to establish adverse possession by the laws of the Commonwealth of Pennsylvania. 13. The Plaintiffs desire and need to have their ownership of said property as herein- above set forth confirmed, and their title to same quieted in order to obtain good and marketable title to same. WHEREFORE, the Plaintiffs respectfully request the Court to enter an order declaring Plaintiffs, Thomas D. Kligge and Janet F. Kligge, the owners in fee simple of the premises described in Paragraph 4 of this Complaint, free and clear of any and all right, title, interest, claim or demand of the said Defendants, Dorothy A. Coy, Charles R. Coy, Jackie 1. Coy, Shirley A. Shields, William N. Coy, Patsy 1. Coy and their heirs and assigns, and further barring the said Defendants from denying, impeaching or in any way attacking Plaintiffs' title in and to the said premises described in Paragraph 4 above. II. Plaintiffs aver that they and their predecessors in title have paid taxes on tax parcel 32-33-1867-022 which is partly comprised of the property in question since the Koontz purchase in 1965. A copy of the tax map is attached hereto, incorporated by reference and marked Exhibit "D". 12. Plaintiffs aver that they and their predecessors in title have been in open, notorious, continuous and adverse possession of the premises set forth in Paragraph 4 herein for a period of time in excess of twenty-one (21) years which would be sufficient to establish adverse possession by the laws of the Commonwealth of Pennsylvania. 13. The Plaintiffs desire and need to have their ownership of said property as herein- above set forth confirmed, and their title to same quieted in order to obtain good and marketable title to same.
