Phone call to Dr. Daniels re: testimony on Wednesday. Phone conversation with Dr. Daniels re: what he will testify to on Wednesday. Dr. Daniels feels that while the Taylors should not be permitted to live at home alone, there is no medical reason for denying them visitation or requiring that the visitation be supervised. Rescheduling hearing. The hearing will now take place on thursday at 11; status conference is on wednesday at 9. Reviewing the law to determine whether I would be considered a necessary witness. 07/05/06 MJC Reviewed the law with respect to Rule of Professional Conduct, 3.7, relating to Lawyers as Witnesses. Determined that I am not a necessary witness and therefore would not be disqualified from advocating with respect to 3.7. Memo to GBF. Status conference in front of Judge Ebert. Atty Hogg is still pushing for one supervised visit a week; we are pushing for no restriction with respect to visitation. The hearing for tomorrow is definitely going to happen. Received and reviewed Dr. Daniel's report. Dr. feels that current placement is appropriate, but they should be permitted to receive visitors. Also conversation about transportation--Cheryl no longer feels safe transporting Taylors. I suggested having one of the neighbors drive the Taylors. Determined that residents have a right to receive visitors. Picked up the Taylors at the home. Also picked up the home's bill of rights, which includes right to visitation. Conducted hearing, calling Dr. Daniels, Bernadette Burch, Bobby Shuey, Lucy Morrett, Noel Burch and Howard Taylor as witnesses. Counselled clients of result of hearing.
