hereinafter referred to as Contractor,
AND
KENNETH E. WEAVER and SAllDRA B. WEAVER, husband and wife,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to erected and construct a single family dwelling
situate in Upper Allen Township, Cumberland County, Pennsylvania
and more fully described in Exhibit "A" which is attached hereto
and made a part hereof known as Lot 37, Witney Ridge,
Mechanicsburg, PA 17055,
NOW THEREFORE, THJ:S AGREEMENT WJ:TNESSZTHI That the said
Contractor, for an in consideration of the sum of ($1,00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto fortor on
account of any work done or materials furnished by them or ~y of
them under said contract or otherwise, for, towards, in, or\fibout
the erection and construction of the said buildings on th'E! lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant,

ALL THAT CERTAIN lot in the property known, named and identified in the Declaration,
referred to below, as "Witney Ridge P.R.D., a Planned Community," 10cated in Upper Allen
Township, Cumberland County, Pennsylvania, which has heretofore been submitted to the
provisions of the Pennsylvania Uniform Planned Community Act, 68 Pa.C.S.A. Section 5101
et seq., by the recording in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, the Declaration for Witney Ridge P.R.D., a Planned Community
("Declaration"), dated Jnne 16, 2000, recorded June 21, 2000, in Misc. Book 647, Page 1,
and as amended by First Addendum to Declaration for Witney Ridge P.R.D., a Planned
Community ("First Amendment"), dated June 28, 2000, and recorded Jnne 29, 2000, in the
Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Misc. Book 647,
Page 991, and Second Addendum to Declaration for Witney Ridge P.R.D, a Planned
Community ("Second Amendment"), dated May 10, 2001, and recorded May 16, 2001, in
the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Misc. Book
674, Page 1094, designated in such Declaration (as amended by the Second Amendment) as
Lot No. 37, described in Section 22 of the Declaration (as amended by the Second
Amendment) and shown (and described) in Exhibit D-2 Second Amendment.
BEING Lot No. 37 Final Development Plan for Witney Ridge Phase IIPlanned Residential
Development, dated February 28, 2000, last revised Jnne 12, 2000, recorded in the Office of
the Recorder of Deeds of Cum berl and County, Pennsylvania, in Plan Book 82, Page 60.
