Clifford, the alleged incompetent is (a) Twenty years of age (b) Is unmarried (c) Is domiciled at Carlisle Barracks, Carlisle, Pennsylv~.nia (d) Is not a patient in a mental hospital, but has been a patient at the Polyclinic Hos- pital, Harrisburg, Pennsylvania, <~nd in other hospitals since June or 1966. 3. The names and addresses of the next o kin of the al- leged incompetent, all of ~r.~hom are sui juris, and ~.~~,ill be entitled. to sh<re in the :alleged incompetent's estate if he died intestate, are t~~'illia<li E. Clifford, Ph.D. (hereinafter Petitioner), with an address of500 Penn Valley Road, Narbeth, Pennsylvania 19072. 2. The incapacitated person, and the subject of this Petition, is Mark F. Clifford (hereinafter "incapacitated person"), who was declared incompetent by Order of the Court on January 28, 1969. A true and accurate copy of the Petition for Appointment of Guardian and corresponding Order of Court is attached hereto as Exhibit "A." 3. By that same court order, Farmers Trust Company (now Manufacturers and Traders Trust Company), was appointed as guardian of the ESTATE. 4. To date, no guardian of the PERSON has been appointed for the incapacitated person. 5. The Petitioner is the sister of the incapacitated person, and is, therefore, interested in his welfare. ~ 6. The incapacitated person resided at Forest Park Health Center, 700 Walnut Bottom Road, Carlisle, Pennsylvania, under the medical care and supervision of Joseph Pion, M.D., from 1972 until July 28, 2006. 8. The incapacitated person currently resides at Fox Subacute at Clara Burke, 251 Stenton Avenue, Plymouth Meeting, Pennsylvania, 19462, and is under the medical care and supervision of Jeffrey Heit, M.D. 9. The names and addresses of the presumptive adult heirs and next-of-kin ofthe alleged incapacitated person are as follows: William E. Clifford and Marie A. Clifford! The Petitioner knows the names and addresses of no other presumptive adult heirs of the incapacitated person not set out above. On or about June 12, 1966, the incapacitated person was in a motor vehicle accident. 11. Injuries from that motor vehicle accident resulted in Mark F. Clifford's current incapacity. 12. Because ofthe severity of his mental condition and state, the incapacitated person lacks the capacity to make or communicate any responsible decisions concerning his estate or person and, even with the assistance of other persons or services, would not be able to participate in the making of any decisions concerning his person. 13. Petitioner brings this Petition, because while a guardian of the ESTATE was appointed to look after the incapacitated person's financial affairs3, no one has been appointed as guardian of the PERSON, and someone needs to be responsible to make personal and medical choices for the incapacitated person consistent with his best interests. 14. A description ofthe functional limitations and physical and mental condition of the incapacitated person was sought by Petitioner in the form of a sworn statement of the incapacitated person's medical providers. A copy of this statement is attached as Exhibit "D," and incorporated herein by reference. 15. Petitioner is not aware that the incapacitated person signed any powers of attorney or advanced health care directives or in any other way designated anyone to serve as his agent over any of his personal affairs or as his surrogate over his medical care, or that he designated in writing his wishes with regard to health care, including the use or refusal of life-sustaining treatment. 16. Petitioner believes and therefore avers that the physical and mental condition of the incapacitated person, as stated in the physician's statement attached as Exhibit "D" herein, is such that the incapacitated person would be harmed by his presence at the hearing on this Petition. 1 7. As the incapacitated person is unable to make known or communicate his wishes, as there are no known powers of attorneys or advanced health care directives executed by the incapacitated person, and as no presumptive heir or living next -of-kin desires to assist the incapacitated person other than 3 A consent of the current guardian of the ESTATE is attached hereto as Exhibit "C" and incorporated herein. 3 Petitioner, there are no less restrictive alternatives available other than the appointment of Jane E. Clifford. Ph.D.. as plenary guardian of the PERSON of Mark. F. Clifford. 18. The name and address of the person to whom Petitioner asks to be appointed plenary guardian of the PERSON is: JANE E. CLIFFORD, Ph.D., 500 Penn Valley Road, Narbeth, Pennsylvania 19072. As required by C.C.O.c.R. 14.2-1, the proposed plenary guardian's consent to serve as plenary guardian of the PERSON is attached as Exhibit "E" and incorporated herein. 19. Other than her sole status as sister of the incapacitated person, the proposed guardian has no interest adverse to the incapacitated person.4 21. The gross value of the incapacitated person's estate is $399,950. 22. The incapacitated person does not have an income. 23. No other Court has assumed jurisdiction in any proceeding to appoint an emergency, limited or plenary guardian of the PERSON for the incapacitated person to the best of the knowledge and information of the Petitioner. WHEREFORE, Petitioner prays and respectfully requests this Honorable Court, pursuant to the provisions of Chapter 55 of the Probate, Estates and Fiduciaries Code (20 Pa. C.S.A. 95501, et seq.), to award and issue a Decree to appoint the said Jane E. Clifford, Ph.D., as the guardian of the PERSON of the said Mark F.
