COMPLAINT
AND NOW comes General Motors Acceptance Corporation, by its counsel, Nauman, Smith,
Shissler & Hall, LLP, to file the within Complaint based upon the following facts:
1. General Motors Acceptance Corporation, (h~reafter "GMAC") is a Delaware
Corporation having offices throughout the United States and having an office at 555 Business Center
Drive, Horsham, Pennsylvania 19044.
2. Defendant, David Ford(hereinafter "Defendant") is an adult individual presently
residing at 112 Salt Road, Enola, PA 17025-2019.
3. On May 15, 2001, Defendant entered into an Retail Instalment Sale Contract and
Smart Buy Rider with General Motors Acceptance Corporation (hereafter "GMAC") for a 2001
Chevrolet Silverado LS with Vehicle Identification Number 1GCEK19T41E 133769 (hereinafter the
Retail Instalment Sale Contract is referred to as "Contract"). A copy of the Contract is marked as
Exhibit "A", attached hereto and its contents are incorporated herein by reference.
4. Defendant, pursuant to the aforesaid Contract, agreed, inter alia, to make thirty-ftve
(35) monthly installment payments in an amount of Four Hundred Ninety and 43/100 Dollars
($490.43) each commencing on May 15, 2001, payable on the day of each successive month
thereafter, with one ( 1 ) final payment, if chosen by Defendant to purchase the vehicle, in the amount
of Nineteen Thousand Seventy-Three and 06/100 ($19,073.06).
5. Under the Contract, GMAC retained a security interest and title to the vehicle. A
copy of the Certificate of Title is marked Exhibit "B", attached hereto and made a part hereof by
reference.
6. Defendant, pursuant to the aforesaid Contract, agreed that in the event of default in
any payment due under the Contract, or the failure to comply with any term or condition thereof, that
GMAC may take immediate possession of said property, including any equipment or accessories
thereto, and for this purpose GMAC may, in any lawful manner, enter upon the premises where the
said property may be and remove same.
7. Defendant has breached the said Contract, in that Defendant has failed to make the
agreed-upon installment payments due. The present outstanding balance due GMAC from
Defendant is in the amount of Thirty-Three Thousand Seven Hundred Seventy-Four and 51/100
Dollars ($33,774.51), plus late charges.
8. Defendant, under the terms of the aforesaid Contract, agreed that in the event he
defaulted in any payment due thereunder, or failed to comply with any of the terms or conditions of
the Contract, and in the event it became necessary for the Creditor or its assignees to institute a suit
in replevin for the vehicle, Defendant agrees to pay all costs of suit and any reasonable attorney's
fees.

GMAC has made repeated demands that Defendant make the payments agreed upon,
10. The aforesaid vehicle is presently in the control and custody of David Ford, 112 Salt
Road, Enola, PA 17025-2019. Vehicles of this model and class have an average value of Twenty-
Three Thousand Six Hundred and 00/100 Dollars ($23,600.00).
WHEREFORE, GMAC prays that this Honorable Court enter judgment in favor of GMAC
and against the Defendant for:
i. Possession of the 2001 Chevrolet Silverado LS with Vehicle Identification
Number 1GCEK 19T41 E133769 or the alternative, the market value of the car
in the amount of Twenty-Three Thousand Six Hundred and 00/100 Dollars
($23,600.00); and
ii. Attorney's fees and legal expenses in the amount of Two Thousand Five
Hundred and 00/100 ($2,500.00) Dollars incurred by reason of the institution
of this action in replevin to repossess the aforementioned vehicle; all as
agreed to in the Contract dated May 15, 2001.
COUNT II - CIVIL ACTION FOR DEBT

12. The Contract provides that in the event the Defendant did not make the agreed upon
monthly payments, resulting in a default under the Contract, and GMAC was required to employ and
attorney, the Defendant agreed to pay reasonable attorney fees and Court costs.
WHEREFORE, GMAC prays that this Honorable Court enter judgment against the
Defendant and in favor of GMAC in the amount of $33,774.51, plus legal fees in the amount of
$2,500.00, plus Court costs.
